Location: Portion of La Quinta Hotel Tennis Villas*Tract, Located
Along the South Side of Avenida Fernando Between Avenida
Obregon and Calle Mazatlan.
Request: Approve the Final Record Maps and Accept the Letters of
Credit Guaranteeing the Completion of Improvements
Applicant: Landmark Land Company
Tentative Tract Map No. 18765, Revised No. 1, consists of 72 statutory
condominium units of 19.1 acres. The final map for Tract 18765-2
contains one lot with 25 condominium units on 2.56 acres.
The City Engineer has determined that the final record map and improve-
ment plans are consistent with Tentative Tract Map No. 18765, Revised
No. 1, which was approved by the City Council on November 2, 1982, and
are also in compliance with the state and municipal requirements. The
City Engineer has also approved the amounts of the required Letters of
Credit guaranteeing installation of improvements.
STAFF RECOMMENDATION
The Community Development Department recommends that the City Council
approve Final Tract Map No. 18765-2 and accept the Letters of Credit
guaranteeing the construction of sewer, water, street and drainage
improvements.

governing conditions related to building and construction activities
including those certain documents specifically described in said
Exhibit A, save and except certain specified portions which are
hereinafter deleted, modified or amended within various Chapters of
said Title 8, of which documents being adopted by reference copies
are on file with the Community Development Department and the same
are also hereby adopted and incorporated as fully as if set out
at length herein.

Applicant: Landmark Land Company
Request: 1. To construct a one-story, 8000-square-foot, golf
course maintenance building.
2. To abandon portions of Avenida Obregon and Calle
Tampico.
On January 23, 1985, the Applicant appealed the Planning Commission
decision to deny the above-referenced matters. The appeal letter is
attached.
On January 8, 1985, the Planning Commission conducted public hearing
on the Plot Plan and Street Vacation requests and unanimously denied
both applications. The attached Staff Reports provide background
information reviewed by the Planning Commission when it considered
these matters.
The Planning Commission discussion on this project focused on the
following issues:
o Premature nature of vacation request as it relates to
coordination with flood improvements.
o Piecemeal nature of vacation request with only two small
segments being part of Applicant's request.
o Compatibility of proposed maintenance building with
surrounding residential area.
Concerns relating to the type and amount of traffic
generated by the proposed use, especially in light of
existing circulation pattern in the surrounding area
and relating to the main point of access.
o Concerns regarding appropriateness of building d
including its orientation towards the mountain.

o Concerns regarding adequacy of parking.
o Concerns about the Applicant's ability to comply with
Fire Department requirements for access and fire flow.
o Concerns regarding perimeter fencing and landscaping,
as well as the Eisenhower/Tampico landscaping situation.
a Concerns regarding noise and other operational factors
associated with the maintenance facility.
In general, it was the consensus of the Commission that there were
problems with the project as currently proposed. However, since both
the Applicant and surrounding property owners pushed for a decision
and there appeared little indication of substantive changes, the
Commission deemed it necessary to deny the requests.
The following persons appeared for the Applicant requesting approval
of the requests:
o Andy Vossler, Landmark Vice-President, noted the Applicant's
willingness to change the entry to Tampico, review fencing
and on-site landscaping and make certain other modifications.
He stated that the facility was a necessity, not a luxury,
and that it would be an asset to the neighborhood.
o Brian Curley, Planner for Landmark, described the proposed
metal building and its design advantages.
o Peter Sherman, Counsel for Landmark, stated that the City
could not require Eisenhower/Tampico landscaping as part of
this project because it was not reasonably related to the
proposed use.
The following persons appeared in opposition to the request:
o Bruce Robinson, Obregon resident and property owner, acting
as spokesman for the neighbors, objected to the improper
maintenance facility location, noise level increases, detri-
mental impacts to residences, storage of potentially hazardous
fuel and pesticides, possible undesirable effects of workers
in the neighborhood, and other features of the project. He
stated that another location would be more appropriate.
o Maurice Bridler, Alvarado resident and property owner, agreed
with Mr. Robinson1 5 objections and stated that the building
should be within the project so that the users of the golf
course would be the ones putting up with any detrimental
impacts occurring frojn its own maintenance fac ility.
o Frank Murphy, area property owner 36 lots), stated that this
use should not be allowed in an R-l Zone.
o Other neighbors to the proposed project were in attendance,
but did not speak.

Subsequent to the Planning Commission decision on the project, there
has been considerable activity by the Applicant to modify the proposal
to overcome the opposition evident at the hearings.
a Applicant has revised the site plans calling for a two-phase
development scheme. Principal changes in the plan include
change the main entrance to Tampico from Obregon; changing
the golf course access point in Phase 2); providing berm,
block wall, new landscaping along east property line in
Phase 2); relocating chain link fence along dike in Phase 2).
a Applicant has revised exterior building elevations changing
from a metal building to a stucco exterior, including several
vertical and horizontal offsets elements with a tile mansard
roof.
a Applicant has submitted a letter copy attached) proposing to
immediately install as part of conditions for approval) land-
scaping and walkway per a plan submitted See Exhibit D New)].
The letter requests the City to maintain the area. The letter
also proposes to contribute to the cost of a signal at Eisenhower
and Avenue 50. Landmark further requests the City to require
La Quinta Country Club to improve its maintenance facility across
from the Hotel entrance.
a Applicant has met with Bruce Robinson in an effort to respond
to neighbors' concerns and, according to Mr. Robinson, there
will be little or no objection to the project as a result of
the above referenced changes and other agreements" made with
the Applicant.
a Applicant has submitted a letter from Coachella Valley Water
District requesting vacation to CVWD of pertinent right-of-way
adjacent to project site. A revised exhibit shows the revised
request.
In considering this appeal, the City Council has the following
alternatives available:
1) Deny the Plot Plan and Street Vacation, as currently
recommended by the Planning Commission. It would be
necessary for Staff to prepare findings to support such
an action.)
2) Refer the matter back to the Planning Commission for
additional consideration, including possible conditions
for approval. This can be done based primarily on the
modifications which have been made since previous
Commission review which may be substantial and which nay
change the Commission recommendation. If this is done,
the appeal hearing should be continued probably to
March 19 to allow Commission consideration on March 12.)

need direction as to when to prepare conditions i.e.,
for Council on February 19 if not referred to Commission;

Dear Madame Mayor:
Enclosed please find our Appeal of the La Quinta Planning
Commission's denial of our applications for a request to
vacate portions of Calle Tampico and Avenida Obregon, Street
Vacation No. 84-005, and a request to construct a golf course
maintenance building at the southeast corner of Calle Tampico
and Avenida Obregon, Plot Plan No. 84-088.
We believe that the Commission did not have an opportunity to
fully consider our applications, and denied the proposed
project based upon the lack of information regarding the design
and use of the proposed facility.
During the preceding nine months, Landmark has worked with
the City staff in developing our plans for this project.
Time is now of the essence for our gaining approval and
commencing construction of the proposed building.
We look forward to this opportunity to bring this matter before
the City Council, for your consideration and approval, which
will enable us to complete this project and properly and
adequately maintain our golf courses which are an essential
part of the La Quinta Hotel and neighboring developments.
Landmark will continue to work with our elected officials and
staff during the pendency of this proceeding in an effort to
achieve an equitable resolution of this matter.

Dear Mr. Usher:
This proposal is a confirmation of the discussions between Frank Usher,
Larry Stevens, Andy Vossler and Ernie Vossler on January 9, 1985.
As a part of the conditions of approval for plot plan #84-088 Maintenance
Center for the La Quinta Hotel Golf Club,) Landmark Land will:
1. Immediately install and pay for the landscape along Eisenhower and
Tampico Streets as outlined by the attached Exhibit A." The
materials used should be decided by the City Planning Department.
As per our discussions, long term perpetual maintenance costs must
be considered. We feel the City should pay for the maintenance of
the area as outlined on Exhibit A."
2. Landmark Land will pay up to 50% of the cost of the signalization
traffic light) at the corner of 50th and Eisenhower and the entrance
to Santa Rosa Cove. This is to be done as soon as reasonably possible.
The remaining 50% of this project would be provided by other developers
or the city of La Quinta. Also, as a part of this proposal, it is
requested that the City would assume the responsibility to finish
Eisenhower to full width from Club La Quinta" on the North to the
intersection of 50th and Eisenhower on the South. This is to be done
as soon as reasonably possible.
Landmark Land would certainly appreciate the help of the City to require the
La Quinta Country Club to clean up *nd to permanently beai'tifv the e.ntrnnrp
to their maintenance center which occurs directly across from the entrance
to the La Quinta Hotel.

environmental impact* associated with the proposed road vacation. It appears
that the vacations th*nselves will not create a significant *pact on the
envir*m*t provided that adequate provision is made for cul*sacs, including
turnarounds, at necessary points along the roads rights-of-way.
5. Project Description: The A*licant is requesting to vacate a small, triangular
portion of Avenida *regon in fr*it of L*s 5 and 6 of Blod* 44 and to vacate a

vacations are intended to facilitate construction of a golf course maintenance

General Plan Consistency: The vacation of beth Calle Tar**ico and Avenida 1'regon
could be considered to be in ccoplianoe with the adopted Circulation El*nent since
60-footwide, local streets are not shown on the general Plan. This does not,
however, mean that other general circulation standards could be considered in making
the determination of General Plan consistency.
public Benefit: Ultimately, the abandonment of public rights-of-way in this area
will be necessary to facilitate anticipated changes to the flood control syst*;
however, final plans for the flood * in this area are not yet CcOplete.
As a result, it is difficult to fully and adequately assess the irr*acts to roads in
the area. Principal concerns related to public benefit should be local circulation
needs, particularly those related to emergency vehicles. It would appear that, based
on a preliminary understanding of the ultimate road configuration in the area, abandon-
ments of these roads would not significantly affect local circulation or emergency
vehicle access provided that provision is made for adequate cul*e-sac turna** for
any cul*e-sacs that would occur as a result of road changes.
It does, however, a**ear that a pieceeeal approach to vacating these roads to facilitate
private development could add short-term disadvantages to circulation since improvements
associated with the private develo*r*nt could provide t*tporary blockages to existing
rights-of*y. of coroe, it should be noted that the condition of existing inprov*r*nts,
particularly the flood crossing at T***)ico are currently only ljmited in their accessi-
bility.
Future Use: The future use of these portions of Calle T&pico and Avenida Obregon
seem sariwhat limited. They principally provide local circulation to a limited number
of lots. It does, howver, appear that the anticipated, ultimate road configuration
would provide aduuuate access for residential type develope*ts. The nature of the
area m*icates that the volume of traffic generated by residential uses would not be
large enough to reguire Avenida obregon and Calle Ta*ico to connect with each other.
E*ironmental *iew: The road vacation has been reviewed for environmental concerns
and pertinent coments are included under the heading Environmental Assessment"
with the Backgrcxind section of this report. Briefly, the only a*parent mitigation
necessary for the vacations appears to be provision for adequate cul-de-sacs and
associated turnarounds.
Additienal R*: It se*ns evident that the ultimate road configuration in the
area will be adjusted primarily to acc*rdate future flood irrproveeents. Nevertheless,
there is significant concern that the pi**l abandonment of these rights-of-way is
not advantageous to the City's needs, nor to those of surrounding residents. It seems
necessary, in order to fully and adequately assess the potential ir*pacts of adjustments
to the area circulation pattern to have a c*lete proposal fr* the water district and
I*x**k Land *pany for abandonment, so that ade*uate coordination can be made with
these changes propsed in the area.

5. Project *scription: The Applicant proposes to construct a golf course
maintenance building of a*rcxirnately 8,000 square feet with an overall height
of 14'6". Floor plans suirnitted indicate areas within the building for open
storage, a saall shop, *rts storage, a *nall office, and *loyer locker and
restr'* areas. Outside the building are sandpits and areas for other seasonal
outdoor storage. E*cterior elevations suuitted indicate the building will be of
nietal constccction with the wall panels being white, a decorative strip which is
green, with a bronze-colored *tal roof. Overhead doors are sh*m along the west
building elevation. A parking lot consisting of 16 parking spaces is shown along
the south side of the building. Entry to the fenced parking and building area is
swcwn fr*ri Avenida Obregon. A 6' high, block wall is proposed along the south
property line, but all reuainng peri't*ter property lines are fenced with chain-
link fencing. Access frcin the facility to the gol* course is **wi' at the north
end of the project. Proposed landscaping consists of a planter along the south
property line and retention of existing trees off the site) along the east
property line. Plan*** note that the exact location of the future flood control
channel and its dike are * at this tiir*. Plans also indicate location of

was filed after the C*nity Develo**nt Director interpreted the existing R-l Zoning
regulations to allow golf course maintenance buildings as a typical accessory building
for golf course facilities which are permitted in the R-l Zone. This interprttation
noted that the *lf cousse maintenance facility shall be contiguous to the golf course
in order to be considered accessory. The Planning Q***ssion does have the option to
differ with this interpretation as part of the review of the plot plan application.
There are a n*it**r of concerns with respect to this devel*xrent proposal which need
to be carefully reviewed prior to taking action. These concerns principally include

Traffic and Circulation: Concerns related to traffic and circulation *ere discussed
to some degree in the associated report on the road vacation re*uest. of particular
concern here is the type of traffic *Alich **ould be generated by the proposed golf
cousse main*nce facility and its difference from typical residential devel*irent.
There is concern that the proposed access from Avenida Cbregon will result in traffic
of a more * nature o*niflg to this site. That traffic could inclix]e larger
vehicles delivering landscaping supplies, fertilizer, sand and related materials and
tanker trucks delivering gasoline to the underground storage tanks. It does not
appear it woiild be appropriate to bring such traffic along *ntezuma and *regon into
the subject site. In addition, eaployee traffic *ould not be typical of that traffic
flaw occrrs in the area. As a result, it appears to us that if the use is to be
alloeed, traffic *)0uld be encouraged to OoOe in from Calle Tartpico rather than
Avenida *regon. Although, emergency vehicle type access and a gate for that access
appears to be necessary on Avenida *regon.
As noted in the report prepared for the road vacation re*iest, there are concerns
ab*t the timing of cul*e-sac and related i't*roveeents *hich are part of the future
flood irrproveeents to the area.
Parking: s*en parking spaces are proposed as part of the project. There is no
definitive basis upon which to base parking reguir*r*ts for this type of facility.
Staff has visited a number of similar uses in the area over the last six to eight
* *st of the* facilities provide a similar nubeer of parking spaces and it
appears the nubeer proposed is reasonable. However, concern dces exist relative to
the continued use of these parking *paces for their designated purpose. cbservation
of other facilities indicates that over tin* the parking spaces end i*p being used for
activities associated with the maintenance facility and that parking typically occrs
outside of the fen*d-off maintenance facilities. This WOuld be particularly undesirable
if the Avenida Cl,regon entrance is the only one provided because the parking *uld then
be Ocurring alci*g a typical residential street. If the access is moved to *rtpico,
the concern would be lesser based on existing developeent, but should be a considera-
tion in light of future development in that area.
Building Design: The proposed building is of netal construction with a l* height of
approximately 14'6". This building is typical of others observed during staff visits
to sooe more facilities in the valley. However, all of those structures i*re located
within the projects to *hich they were accessory. There is concern that the use of
this type of building along the perTh*ter of a project where the principal exposure
is to residential uses, whidi are not part of the project being served by the mainte-
nacce facility needs to be considered in the building design. The use of the *

type building of this size nearly 8,000 square feet) may not be appr*riate to
and o*patible with this single-f*nily area. Oonsiderations to different types
of building exteriors and to reorienting the building are appropriate. *ilile it
is possible that some upgrade to the building materials, particularly the roof,
could be considered, it should be noted that there are substantive concerns related
to building design and orientation that need to be resolved.
Building Use and Pelated Activities: There are a number of activities typically
associated with a maintenance operation, especially one of this size and soope,
*ich can be detrimental to the surrounding residential area. *ile sate of these
have been discussed as part of other issues, it is ipportant to note that noise,
outside storage and the tiu* of proposed operations se*n particularly ino*tpatile
with the area. With the orientation of overhead doors facing to the west dirtctly
towards large * it can be anticipated that some deflection of noise to the
surrounding area will occur. There does not apaear to be any reasonable way to
mitigate this incea** noise as long as the proposed building orientation is retained.
There are several areas currently proposed for outside storage of certain materials;
prapably sand, some landscaping and associated materials. If these are re*ed in
the areas shown, it is likely they w*d have limited ittpact. However, observation
of other maintenance activities indicates that these storage activities are, from
time to time, likely to spill over into other areas of the site and these can be
particularly unattractive to surrounding residential areas if proposed buffering
of fencing and landscaping is inade*uate. The proposed hours of operation *uld
likely generate significant noise early in the mornurg'. This noise is not typical
of residential areas; particularly as early as 6:00 to 6:30 in the morning. It
a*ears that the plao*r*nt of hours restriction on the use, while enforceable, *ld
be counter productive to typical operations of this sort. In general, it appears
that there are a number of activities associated with the proposed use *hich *ould
be inopatible with the surrounding area. *lile conditions of approval could mitigate
these to some *ct*t, it is nevertheless apparent that all of them canaot be c*rpletely
mitigated.
Timing Problems: The proposed design is to some extent dictated by flood improvetents,
both existing and proposed, for the area. The existing channel, *A*ich must be main-
tained for the present, is in effect the east *dary of the project. *en new
inprovetents are installed estimated to be at least a year in the future) to the west
of the proposed building, the existing ittprovetents will be abandoned. It seems that
the approval of this building without kna*ing the full extent of future flood inprove-
ments is premature. The Applicant's apparent need for the golf course maintenance
facility can probably not be adeguately coordinated with flood in*rovetents in the
area.
*d Vacation: There is an associated road vacation application with this project
and that would have to be approved in order to aoccitxodate the preposed project. As
noted in the separate report, there are problems with tuning and the pieo*nal nature
of the road vacations which need to be considered.
Lalliscaping at Eisenhower and Tatpico: There have previously been discussions with
the Applicant *ceriing the need to i!r*rove the road right-of-way, including
associated l*caping, along Eisenhower and Tampico frontages for the existing golf
course facility. *ile it is difficult to directly associate such an inprovetent
condition with this facility, it is nevertheless a concern that needs to be evaluated.

that 1250 * fire flow will be necessary for the area. It does not a*ear to us,

nent can be satisfied. This furr indicates to us that the proposed use is not
likely to satisfy necessary requir*t*ts nor to achieve necessary O*tpatibi1ity with
a typical single-family residential area.
In conclusion, it apaears that there are significant pntl*us with the proposed use.
*iile it is possible to make irodif ications to the pr*sed project to mitigate at
least some of the concerns identified, it is not likely that all of the concerns
identified can be fully mitigated. N*ertheless, it is possible to work with the
Applicant to resolve, to the eteent feasible, the identified probl*ns unless it is
the QItmissionus perception that the subject property and its location are sixr*ly
unsuitable for the proposed use. If the latter is the case, it is frankly not
beneficial to continue to work on design alternatives and this would indicate the
project application shaild be denied. NOIE: The Staff can prepare findings to go
with such an action.)

LA QUINTA, CALIFORNIA, REPEALING ORDINANCE NO. 33
WHICH ESTABLISHED A HUMAN RELATIONS COMMITTEE.
WHEREAS, on February 5, 1985, the City Council adopted Ordinance
No. establishing a Community Services Commission, the function and
duties of which supercedes all duties of the Human Relations Committee
established by Ordinance No. 33) and renders the functions of said
Committee obsolete;
NOW, THEREFORE, the City Council of the City of La Quinta, California,
does ordain as follows:
SECTION 1. Ordinance No. 33, creating and establishing a human
relations committee, is hereby repealed in its entirety.
SECTION 2. EFFECTIVE DATE. This Ordinance shall be in full force
and effect thirty 30) days after passage.
SECTION 3. POSTING. The City Clerk shall within 15 days after
passage of this ordinance, cause it to be posted in at least the three
public places designated by resolution of the City Council; shall certify
to the adoption and posting of this ordinance; and shall cause this
ordinance and its certification, together with proof of posting, to be
entered in the book of ordinances of this City.

The City Council of the City of La Quinta does ordain as follows:
SECTION 1. Section 4.10 of Riverside County Ordinance No. 348
which was adopted by reference by this City Council by Ordinance No.
5, operative August 29, 1982) and Lower Coachella Valley District
Official Zoning Plan Map No. 41, as amended, are further amended by
rezoning from A-l-l0 to R-l-12,000 that certain parcel shown and
depicted for such rezoning on the map which is attached to and made a
part of this ordinance, and which attached map is labeled Exhibit *1,
Change of Zone Case No. 84-013".
SECTION 2. EFFECTIVE DATE. This ordinance shall be in full force
and effect thirty 30) days after its adoption.

Subject: Financial Assistance to La Quinta Sports and Youth
I have met with representatives of the La Quinta Sports and Youth
Association regarding improvements at the temporary baseball fields
on Avenue 52.
There will be nine diamonds of various sizes. The needed improvements
are:
9 Chain-link Backstops
10 Team Benches
6 Bleacher Sets
2 Portable Restrooms
The cost of these improvements is estimated to be $17,283. All
improvements will remain the property of the City, and can be relocated
to the site of permanent baseball fields expected to be at the location
of the new school.
I am recommending that the City appropriate $17,500 for these improve-
ments in Fiscal Year 1984-1985. This will enable the improvements to
be completed for the 1985 season. I will be recommending that the City
appropriate $2,500, or the difference between the amount used and $20,000
for Fiscal Year 1985-1986, for additional improvements and portable rest-
room rental.
Adoption of the accompanying Resolution is respectfully recommended.

Subject: PROPOSAL HIRING OF FIRE MARSHAL
The City of La Quinta needs a more comprehensive level of fire marshal services
if the provisions of the Uniform Fire Code are to be met as adopted by the City
Council.
RECOMMENDATION:
Based on meetings and research, Larry Stevens and I highly recommend that the City
of La Quinta enter into a contractual agreement with the Riverside County Fire
Department and Cathedral City for the purpose of establishing a half-time position
of fire marshal in La Quinta the other half to be hired by Cathedral City).
The fire marshal would provide plan checking in a timely manner for developers.
He would greatly benefit all departments as he would be available for advice and
guidance on all fire related matters that come before the city.
Attached for your review is a salary schedule. Our fire marshal cost would be
approximately $27,000 per year.
Also attached is a Position Duties Statement and a Fee Schedule for fire marshal
inspections. If the Council chooses to adopt the fee schedule, it would help
offset the cost of the fire marshal.

Subject: School Impact Fees for the Coachella Valley Unified
School District
The Coachella Valley Unified School District CVUSD) has requested that
the City of La Quinta establish school impact fees benefiting that
District, as the City has done relative to the Desert Sands Unified
School District DSUSD).
The accompanying resolution is identical in its approach to what was
done for the DSUSD. I am informed verbally that the fee which the CVUSD
wishes to establish is the same as that for the DSUSD, or $628.00. The
resolutions do not specify the amount which may be charged. If the
Council wishes this to be done, the resolution may be modified. I believe
that a maximum fee amount should be established.
Adoption of the accompanying resoluti.on, with the establishment of a
maximum fee, is respectfully recommended.

On February 5, 1985, The City Council adopted Resolution #85-8,
establishing an Interim Cotmunity Infrastructure Fee $4,000 per
unit and $1,000 in The cove area.) Following This Council action,
and while reviewing The 1984 Legislation, I discovered The
addition of Goven*ment Code Section 65962, which reguires a prior
noticed Public Hearing and a sixty 60) day waiting period
prior to taking any action enacting or increasing a fee on
residential developeent. Governnent Code Section 65962 contains
provisions for adoption of a fee as an Urgency Measure wiThout
hearing, without two Thirty 30) day extensions following
noticed hearing.
Because of Government Code Section 65962, which becan* effective
January 1, 1985, it is rea*rn*nded that The Council adopt The
enclosed Resolution, which is similar to Resolution #85-8, except
That it adds a new item 7 adopting it as an Urgency Measure.
The staff will also be reguesting that you adopt the Thirty 30)
day extensions at The apprQpriate tirr*.
* will be coordinating all of this with the eventual adoption
