Mr. Mayors
Despite your public apology concerning the much publicized Ethnic slur you
recently made about a large segment of the La Quinta and Coachella Valley
community, I would like to express my personal dismay and indiation at
your inexcusable ignorance. It is shocking to me that there are so many
Baiers in this valley and across the nation who also share your ignorance.
It is a sad state of affairs that in the land of freedom and uality, both
are still selective. I would like to believe that there are people who are
free of prejudice and discrimination. The reality is that all of u are
subject to our own. But that does not give us the liberty. right, or priv
ilege to engage in deliberately offending any group, and much less when
it involves someone in public office. Society is too replete with Baiers".
Ignorance, uch as you expressed publicly about wetbacks", inspired me
to write the enclosed composition. I felt it very fitting to dedicate it
to you in the title I selected.
Please read this composition before the full council. Should there be

I had the experience of viewing Fred Wolff on Channel 10 April 24.
I considered the praiseworthy statements the local Fire Departent
were in order but do not feel the personal remarks concerning our ayor were
necessary.
I do not know the cost of this half hour program on but if it doesn't
cost anything I believe the old adage still applies: something for free

Subject: Human Relations Commission
At our last Council meeting, Frank Usher and I were assigned to
develop recommendations for a Human Relations Commission. Here
are my ideas, submitted for your consideration. I suggest we
act soon to establish this commission in order to implement the
commitment made that evening.
1.0. Role of the Commission
1.1. Advise the Council on fair employment practices
and affirmative action.
2. Assure compliance with the U.S. Civil Rights Act and
related State statutes.
1.3. Mediate intergroup problems which may arise in the
operation of city government.
1.4. Actively promote positive intergroup relations within
the city.
1.5. Assist minority groups in the community to become
active in civic affairs.
1.6. Generally, promote a climate of harmony and cooperation
among all residents within the city.
2.0. Composition of the Commission
2.1. Seven members appointed to staggered terms.
2.1.1. 3 one year terms; 2 two year terms; 2 three year
terms 2.1.2. Subsequently, all terms hall be three years.
2.2 Membership shall reflect all ethnic groups in the
community.
2.3. The commission shall elect its own officers.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
LA OUTNTA, CALIFORNIA, AENDINC THE CITYS ZONING
ORDINANCE BY ADDING THERETO PEGLLATIONS RELATING
TO HOME OCCUPATIONS.
The city council of the City of La Quinta, California, does
ordain as follows:
SECTION 1. Riverside County Ordinance No. 348 which was adopted
DV reference by this city council by OrdInance No. 5, operative
August 29, 1982) hereby is amended by amending SECTION 21.36 thereof
defining home occupations, and by adding thereto a new section, to be
numbered SECTION 1S.42, to read, respectIvely, as follows:
SECTION 21.36. HOME OCCUPATIONS. A home occupation is a
business use which is customarily conducted in a residence,
provided that such use is clearly incidental and secondary to
the prinCiDal use of the dwelling as a residence and that the
business use does not change the character of the dwelling or
adversely affect any other dwelling or the environment in the
vicinity. A home occupation may be engaged in provided that
it is conducted in compliance with the criteria and reQuireentE
so c h in Se+ion 12.42.

the total area of the structure.

of hazardous materials stored on the premises
at any given time i.e., pool chlorine, paint
thinner, etc.).
7) There shall be no dispatching of persons or
equipment to or from the subject property,
including the use of coTnIrercial vehicles which
operate to and from the premises.
No vehicles or trailers except those normally
incidental to residential use shall be stored
or parked on the site.
9) There shall not be involved the use of commerciEL
vehicles for delivery of materials or items to
or from the premises, other than a vehicle riot

10) There snall be no use of any mechanical equipmr.t,

or lot be so altered, or the home occupation be

reasonably recognized as serving a nonresidential
use either by color, materials, construction,
lighting, sounds, vibrations, etc)
13) No home occupation shall create a nuisance bv
reason of noise, odor, dust, vibration, fumes,
smoke, electrical interference, traffic or other
causes.
14) The use shall meet reasonable Special conditions

b) Procedure.
1) Applications. An application Qr maintaining a
home occupation shall be filed ith the Plannin9
Department On forms provided by the department.
Anyone desiring to make a formal application for
a home occupation shall include the following
information:
a The location and address of the proposed
occupation;
b. The nature of the home occupation; anG
c. Any additional information requested by the
Director of Community Development.
2) Filing Fees. When the application for a home
occupation is filed, a fee of Thirtv-five and
No/lOOths $35.00) Dollars shall be paid to the
City for the purpose of defrayinQ the costs
incidental to the proceedings.
3) Revew and Investcarons: Decistons. The

of the Citv which mjcht have interest in, or
ursdiction over, some phase of the proposed
occupation, shall mae any necessary invest igat
and shall grant or deny a permit therefor in

section are met. The permit, if granted, shall
specifically identifv the occupant as permittee
and describe the nature of the home occupation
thereby allowed. Home occupation permits shall
not be transferable bv the designated permittee
to any other person.
4) Decisions Final. The decision of the Director
shall be final and shall become effective ten

5) Appeals. Any person or body, public or private,
may appeal the decision of the Director to the
Commission. Such appeals shall be filed wiLh
the Planning Deoartment within ten 10) davs

6) The decision of the Commission On an appeal
shall be final and not subject to further appeal
to the City Council.
7) At such time as a home occupation permit has been
granted, the Director shall notify the License
Department of such fact, stating in such notifica-
tion the effective date of the permit.
c) Annual Reviews. All borne occupation permits granted
rursuant to this section shall be reviewed annually
by the Director in order to ascertain whether or not
all the conditions and criteria set forth in subsection
a) of this section are bein9 met and complied with at
all times. If, at the time of such annual review or
at any other time, it is found that any of such condi-
tions and criteria are not beina met and complied wIth,
the permit may be revoked by the Director after the
permittee has been given five 5) days written notice
of the Citv's intention to do so, and has been afforded
the opportunity for a due process hearing by the DirLotor
or the Director's designee. Any such revocation is
sub ect t Deal as provided in subsections b) 5 d

SECTION 9 FFFECTIVE DATE This ordinance shall be in full fors
and effect thlrtv 30) days after passage.
SECTION 3. POSTING. The City Clerk shall within 15 davs after
passage of this ordinance, cause it to be posted in at least the 3 pui
places designated by resolution of the Citv Council; shall certify to
the adoption and posting of this ordinance; and shall cause this
ordinance and its certification, together with proof of posting, to be
entered in the book of ordinances of this City.
The foregoing ordinance was approved and adopted at a meeting of
the Citv Council held on this day of 1983, by the
following vote.

We have received a substantially reduced quote from the Robert F.
Driver Company relative to liability and property insurance for
Fiscal Year 1983-1984. The premium for liability insurance is
$800 below the premium for the past year and the premium for
property insurance is $504 lower. These premiums are, in essence,
minimum premiums, and they will probably be the lowest premiums
which we will experience.
Renewal of this insurance coverage is respectfully recommended.

The CTtrity safety Coordinator has arranged for the preparation of the
agreement regarding District Attorney prosecution services. The
agrement provides that the Distrit Attorney shall provide prosecution services
regarding the prosecution of violations of the City crinunal ordinances
This is a standard formal agreement and it will provide for prosecution of matters
such as illegal dumping and other mis dranor violations.

Subject AMERICAN RED CROSS DISASTER ACTION TEAM RROGRAM
The American Red Cross offers a wide range of beneficial services
to our community. In the area of disaster planning they have a fairly
new program called the uDisaster Action Team.
The Disaster Action Team is much like a Neighborhood Watch Program
coupled together with some disaster response training. Members of the
Disaster Action Teams respond to persons burned out of their homes to
large scale disasters such as earthquakes and floods. The team and its
members provide initial care to the victims of disasters until the Red
Cros can respond with additional assistance.
Anothe important aspect of the Disaster Action Team i to establish
basic data for disaster funding and recovery efforts through the Red Cros.
As an example, a Disaster Action Team member can write vouchers for food
and shelter on the spot" for a family burned out of its home.
During the City Council study session on May 2, Ms. Torre Sullivan
from the Riverside County Headquarters of the American Red Cross will make
a brief presentation regarding the Disaster Action Team program. Please
ask her about the Disaster Action Team if you have any questions.
It is my request that the City Council adopt the Disaster Action
Team concept as a part of the disaster plans for La Quinta and that the
City Council help in supporting and promoting this program in La Quinta.

Subjeci: MONTHLY UPDAT APRIL 1983
This past month has been a vei'y busy one for the Community Safety
Department. Progress is being made on a variety of project and several
new projects have also been started. Increased participation by the
citizens of La Quinta are providing additional help for many of our
ongoing programs.
CRIME: During the past month the Citizen Task Force on Crime has
been rejuvenated and will join forces with city staff to expand and improve
the anti-crime programs.
The sheriff1s department statistics for the month of March were most
impressive. Compared to March of 1982 figures, this March there was a
71% decrease in burglaries and an overall crime reduction of
ANL CONTROL: Thirteen dogs were captured and impounded this past
month through the use of animal traps and two dog sweeps. More sweeps are
scheduled for next month. The Citizen Task Force on Animal Control will
be working on another rabies and licensing clinic for late in May.
TRAFFIC SAflTY: The recent approval of a Traffic Safety Committee
will help substantially in studying and correcting traffic safety problems
in La quinta. Recruitment is underway for the citizen positions on this
valuable committee.
ABAT1MET PROGRAMS: The abandoned vehicle program has resulted in
the removal of eight vehicles thus far. Seven of these eight vehicles were
moved voluntarily and only one had to be towed away by our contract tow
service.
Due to the excessive growth of grass on vacant lots which poses a
severe fire hazard, we are adopting a weed abatement program.

PARAMEDICS. A committee has been formed to research and study the
idea of a La Quinta based paramedic service Euch as the adjoining cove
communities have. There appear to be many benefits of siich a program
and a report will be prepared for Council review on this matter.
LITTER CONTaOL: Illegal dumping appears to be somewhat controlled
at the present time with fewer complaints being received. Use of the
sheriff's airplane and four-wheel drive patrol units are helping in this
endeavor. Signage has been posted in areas previously prone to illegal
dumping and this too may be helping.
Several streets were recently re-cleaned along their shoulders by
our contract roadside maintenance person. Unfortunately, the roadsides
are still frequently littered by carelessly disposed of beverage containers
and other assorted debris.
In summary, citizen complaints still continue to be a constant source
of work for the Community Safety Department. Specifications for a city
radio and communications system are being developed. Planning for the
83k FT budget is also taking place. No word yet from Toyota on the
free" vehicles we requested. A burglar and fire alarm System for City
Hall is being planned and may be donated" to the City if all goes well.

OF PROCEDUF FOR COUNCIL MEETINGS AND RELATED
FUNCTIONS AND ACTIVITIES, REGARDING TIMES AND
LOCATION OF REGULAR STUDY SESSIONS.
BE IT RESOLVED by the City Council of the City of La Quinta,
California, as follows:
SECTION 1. Section 1.4 of the Rules of Procedure for Council
meetings is hereby amended to read:
1.4 STUDY S:SSIONS
Members of the Council may meet in a regular Stuy
Session at 3:00 p.m. in its regular place of meeting on
the Monday preceding the first and third Tuesday of each
month. If such a day is a holiday recognized by the City,
the Study Session shall be held at the same time and
place on the preceding Friday. See 10.1)

10.1 SCFL--DL-*Ll OF STLjDY SESSIONS
Those Council Members v.c are able to attend will meet
in the Councils regular place of meeting at 3:00 p.m. on
the Monday the first and third Tuesdays of each
month for the purpose of reviewing the agenda for a Council
meeting and meeting and conferring with City commissions,
civic organizations and City officials relative to pending
City business. If such a day is a holiday recognized by
the City, the Study Session shall be held at the same time
and place on the preceding Friday.
The time or place for study sessions as specified above may
be atered by thffi Council or by the Mayor or individual
occasions when appropriate to the convenience of the Council
Members, provided that when this occurs, written notice 0
the change shall be delivered personally, or by mail to each
local newspaper general circulation, radio or television
station at least 24 hours before the study session to be held
at the changed tLme or location. Each. Council Member shall
be notified of the changed time or location ersonally or
whatever means tie Mayor or City Manacer deem appropriate.
SECTION 3. The Lity Clerk shall, as soon as practicable following
aCoti0n or this- Resction, give notice of this rule change to al
arties and media agecles listed in the scond paragraph of Section 10.1
5 set out above.
