of Coachella, at a Study Session held on February 15, 1984, established
a fact-finding ad hoc committee to research the pros and cons of possibly
locating a medium security State prison in the immediate vicinity of
Coachella. This Committee will serve to provide as much input as possible
to insure every aspect of this issue has been studied thoroughly.
Since this issue will have a significant effect on your community
and other surrounding communities, we are hereby requesting that you
appoint a representative(s) from your Council to serve on this Committee.

On behalf of the City Council, I wish to express our
gratitude for the generous donation towards a Children's
Park Fund in La Quinta Park. As you know, your donation
of $1,125 in 1983 was used to purchase a swing set for
the very young children, and will be placed in the park in
the near future. We have requested that the Coachella
Valley Park and Recreation District relay suggestions to
the City regarding equipment which is needed for the Park.
We will let you know when the equipment has been chosen
and placed in the Park for use by La Quinta's children.
Once again, let me express our utmost thanks for
the generosity of the La Quinta Women's Golf Auxiliary on
behalf of the Council and many citizens of La Quinta who

Subject: Charlie's C.U.F.
Charlie Soffa asked me to meet with him because he was
very upset about the whole process and the decision relating
to the renewal of his CUP Conditional Use Case #2394).
He * quite understand why he was denied renewal and
he is upset about the lack of communications between him-
self and City staff. He claims he wasn't informed when
the decision would be made after we postponed it a couple
of times) and he also was not informed in writing what the
Council decision was this is true). He also wanted a hearing.
I spent about an hour with him, and then some time with
Frank Usher reviewing the case. Without going into details,
I think Charlie's cone*rn *have some legitimacy; for some
there is reasonable justification by staff.
Whatever....here's a man who has lived in La Quinta for
more years than any of us, who has done much for the community,
who contributed to the formation of the city, and who is
quite ill. Charlie is quite emotional about this issue;
I think it is affecting his health.
From what I understand, the C.U.P. does not authorize Charlie
to move on his project; he'll still need a tract map if he
he wants to proceed. He knows this, but still wants the
extension of the C.U.P. SO....if we grant the extension:
it'll make Charlie happy and may improve his health; and
it will not commit the City to any development approval.
Consequently, I would like to recommend that we place this
item back on the agenda for our first meeting in March;
that we reverse our previous decision and grant the exten-
sion. I think it would be a decent thing to do!

Subject: Various Street Improvement Projects
The City Engineer, Community Safety Coordinator and I have examined
several locations within the City which require improvement as soon
as possible. We currently receive approximately $102,000 per year
in gas tax. Our construction and maintenance costs should be
expected to come from within this amount. This will mean some
priorities will have to be set for various improvements. I have
asked the City Engineer to prepare estimates, and in some cases to
prepare plans and specifications, for various improvements. This
will help us in setting the improvement priorities.
The projects, from north to south, are the following:
Jefferson Street and Westward Ho Drive
The southbound lanes of Jefferson Street, at the intersection with
Westward Ho Drive, have deteriorating asphalt caused by standing
water from landscape irrigation to the west on Westward Ho Drive.
This condition can be corrected through the installation of a
concrete swale running to the east and pad extending to the south
from the intersection.
Washington Street and Highway 111
As you know, Dr. Tynberg has declined participation at this time
in the one-quarter share of the cost of intersection and signal
installation improvements which are attributable to his property.
There is no way to require this until his property is developed,
without an assessment district.
It appears that it will be necessary for the City to cover this
share of the cost. It will also be necessary to assure that the
City will be reimbursed for advancing this amount. This can be
done through an assessment district. A simpler and more direct
way would be to get Dr. Tynberg to execute an agreement which
would be binding on him or his successors in interest for reimburse-
ment when development occurs on the property. We will prepare such
an agreement and attempt to obtain Dr. Tynberg's agreement to it.

Washington Street Profile
It would be useful to have a profile for the grade of Washington
Street prepared, from Highway 111 to Eisenhower Drive. This will
enable the City to plan properly for drainage along this portion
of Washington Street and for the installation of underground
utilities. The City Engineer has been requested to prepare a
proposal for the preparation of this profile.
Washington Street and Eisenhower Drive
The City Engineer has prepared the necessary drawings and design
for the intersection of Washington Street and Eisenhower Drive
and the traffic signal consultant is currently preparing the plans
and specifications for the installation of the traffic signal.
We expect to call for bids on the traffic signal within four 4)
weeks.
Avenue 50, Eisenhower Drive to Washington Street
On the northerly side of Avenue 50, we recently had a drywell
reconstructed in an attempt to accept landscape irrigation water
flowing from the Lago La Quinta portion of the La Quinta Country
Club. This water has previously ponded on the asphalt in the
westbound lane, causing severe deterioration to that area. The
reconstructed drywell has again silted up and it is not accepting
water as it should.
This situation can be resolved through the placement of an overflow
drain pipe under the pavement to the south side of Avenue 50, where
it would drain into another, new drywell. Also, if the capacity of
this drywell were exceeded, any overflow water would travel in a
newly constructed concrete gutter to drain across the Duna La Quinta
property to the flood control evacuation channel.
We will also attempt to reduce the amount of excessive water flow
coming from the Country Club.
Calle Tampico, Avenida Bermudas to Avenida Navarro
This portion of Calle Tampico is severely deteriorated and is in
need of reconstruction. We are proposing that this area be
repaved. The City Engineer is preparing a cost estimate for this
project.
Calle La Fonda Calle Estado
The travelled portions of Calle La Fonda and Calle Estado are in
reasonably good condition, except for portions of the south side
of Calle Estado. However, the pavement in the central area,
between the islands, is in very poor condition. Also, Southern

California Water Company will be placing water meters in the
islands at each end of these streets. Between the islands, our
own plumbing contractor will install the necessary connections
for landscaping and will need to open the streets for this
purpose.
We will be proposing to have the central portions and the southerly
portion of Calle Estado repaved, with an overlay after the water
lines have been installed, with the entire street being covered with
slurry seal in order to achieve uniform protection and appearance.
The striping of parking spaces and repair of damaged curb would then
be done as part of the same contract.
When this work has been completed, landscaping of the median
islands on Calle Estado and Calle La Fonda will be done. We have
received a recommendation that the simplest and least costly
maintenance of the islands would involve the planting of lawn and
trees, similar to the landscaping on the island in front of the
La Quinta Arts Center on Calle La Fonda.

1. Review of Political Reform Act of 1974. Applicable to Public Officials.
Decisions of public officials and employees are to be free of any influence
of the officials' private interests. This is the goal of conflict of interest
laws. To ensure that decisions are made solely in the public interest,
officials must disclose certain private financial interest and not participate
in the decision making process where their private financial interests are
sufficiently related to the decision or where their private interests might
otherwise make the official biased.
There are a nurr*er of laws which define conflict of interest standards.
The Political Reform Act of 1974, Government Code Section 81000 and following,
is the most comprehensive. It provides no public official at any level of
state or local government shall make, participate in making or in any way attempt
to use his official position to influence a governmental decision in which he
knows or has reason to know he has a financial interest." 87001) * An
official has a financial interest if it is reasonably foreseeable that the
decision will have a material financial effect, distinguishable fr*n its effect
on the public generally, on any business entity in which the public official
has an investment of more than $1,000.00, on any real property in which the
official has an interest worth more than $1,000.00, on any source of income
aggregating $250.00 or more in value within 12 months prior to the time when
the decision is made, or upon any business entity in which the official is a
director, officer, partner, trustee, employee or holds any position of manage-
ment.
Beyond these basic definitions, the Political Reform Act bec*s highly
ocoplicated. In practical te:* any time an official has an interest in a
business, a piece of real property, a source of income, or has recently
received a contribution of $250.00 or more relating to a matter ocoing before
the City Council, he or she should consult with the City Attorney in sufficient
time prior to the official's participation in the decision to allow the City
Attorney to analyze the technical rules of the Act so as to be able to participate
freely or abstain with a clear conscience.

The Political Reform Act provision relating to disclosure and disqualification
apply to rn*r*ers of the City Council, Planning C*tmission and the City Manager
only. Gov. Code 87200. Reorganizing that other city officials and e:ployees
also participate in decision making which nay have a material effect on their
financial interest, the Act enables cities to adopt ordinances designating certain
*loyees required to make certain ino*ne and property disclosures. The enclosed
ordinance is submitted for such purposes. Its provisions and disclosure categories
are self-explanatory.

Subject: Traffic Report
It seems all of us feel an urgency to take some steps to
deal with traffic problems in La Quinta, as they relate to
speed limits, signs and controls. I have taken the liberty
to develop the attached study and recommendations for our
deliberations.
It seems when there is a written document to which we can
relate... and which we can change, modify, add to or delete
from, etc., etc. etc......action is more likely to follow.
So, please look upon this as a point of departure to move
us to action; it1s the only concrete set of recommendations
we have at this time.
I am asking the City Manager to place this on the agenda
for our next meeting. I suggest we then decide 1) are
there items on which we can act now? 2) which items do we
want to deal with later on,perhaps in a special meeting?
3) which items do we want to eliminate totally; or 4)
do we want a special session to deal with the whole problem
of flTraffic!!?
Whatever action we take, I hope it'll result in a safer,
rational traffic pattern for our city..

Subject: SPECIAL REPORT Traffic near La Quinta Park
This report is in response to a request by members
of the City Council regarding traffic problems near the
La Quinta Park, specifically at the intersections of
Avenida Montezuma at Avenida Navarro and at Eisenhower
Drive at Avenida Montezuma.
The following action has been taken regarding your
request:
1. It is common practice to have any traffic problem
of this type studied by a traffic engineer, an expert" in
traffic matters. I do not feel so qualified to render such
opinions by myself. An attempt to recruit the services of
the Riverside County Roads Department, Traffic Engineering
Section, to do that work for us was made. We were advised
by that section that it was impossible for them to provide
such services within the next two months due to a backlog
of other work.
2. This matter was brought up before the La Quinta
Traffic Safety Committee at its meeting of February 9, 1984.
Based on the data available to the committee which includes
the Institute of Transportation Studies recent report,
traffic accident statistics and reports, and warrants there
is no serious'1 traffic problem that needs immediate action
in the area of the park. Using all guidelines and practices
available to any other traffic safety committee it would be
reasonable and prudent to recommend no action at this time.
3. The design of these two intersections, which were
laid out many, many years ago when the tract was recorded,
is to be considered unique. That is because we have both
intersections being the convergence point for five separate
traffic routes. Typically, an intersection will usually
only consist of four or three traffic routes merging at a
common point. Redesign of the intersections can then be a
method for helping to eliminate the potential for accidents.
4. The proper and warranted traffic control signage
for these intersections has been installed and Functioning
under the au species of the Riverside County Roads Department.

5. One-way streets have been suggested as a possible
solution to the problems at these intersections. The Traffic
Safety Committee discussed this idea back in July of last
year. However, Mr. Haley, the traffic engineer from I.T.S.
recommended against the use of one-way streets in this area
reference I.T.S. Traffic Safety Evaluation report for La
Quinta, page 43, Suggested one-Way System Around Town park.1')
To quote Mr. Haley from that report, To one-way these
streets would appear to be applying more control than necessary."
6. As an alternative to one-way streets, the Traffic
Safety Committee discussed another possible solution. That
solution would be to eliminate Avenida Montezuma around the
south side of the park. That could be accomplished by cul-
de-sacing both ends where they meet with Eisenhower and at
Avenida Navarro.
The thrust of this plan would be to make both intersections
into typical four-way intersections. Access to Avenida Monte-
zuma on the south side of the park would be off of Avenida
Mendoza. Sufficient turning area would be provided on both
ends. It would also be desirable to change the name of that
portion of Avenida Montezuma to a *1court" or place11 name,
perhaps Montezuma Place.
An added advantage to this plan would be that thru traffic
around the south side of the park would be eliminated and much
additional parking would be available for athletic events or
visitors to the park. I would also like to call to the
attention of the City Council that this would mean increased
safety since the ballfield and the playground are both located
on the south side of the park. This would prevent vehicles
from zooming through that area as I have so often personally
witnessed during night sporting events.
The plan would also include blocking off both ends of
Avenida Montezuma south) by using improvements such as curb-
ing and gutters filled in with landscaped planters with walk-
ways. This would help to satisfy other City Council objectives
by helping to beautify downtown La Quinta. Crosswalks would
also be planned to facilitate pedestrian safety to each side
of the park.
It is my recommendation to the City Council that one of
the following courses of action be decided upon to resolve
this situation:
No. 1: Implement no changes at this time since no
APPRO** changes are warranted per recent studies.
No. 2: Adopt Item #6 as noted above and direct staff

RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA PROVIDING FOR
MITIGATION OF LOCAL SCHOOL IMPACTION
WHEREAS, the Desert Sands Unified School District
provides valuable educational services to the residents
of La Quinta; and
WHEREAS, the Board of Trustees of that District
has taken the public position and has informed this City
Council that its school facilities and educational services
are being seriously impacted by increasing student popula-
tion, and that most of this increase results from construc-
tion of new residential housing units within the Desert
Sands Unified School District; and
WHEREAS, this City Council has been informed
by the District that as the public agency bearing official
responsibility for providing educational services within
this City, the District's ability to meet the public's
educational needs is now impaired and without additional
financial assistance will deteriorate further, which condi-
tion of inadequacy is called herein 1impaction"; and
WHEREAS, by law all residential subdivisions
must be consistent with the City's General Plan, which
General Plan has as one of its primary objectives the pro-
vision of adequate school facilities; and

Subject: Planning for Oak Tree West
As you know, I have made an effort to stay out of the
affairs of the Planning Commission. However, I feel
a need to communicate with you regarding the major pro-
ject which is now before you.
It seems highly inappropriate to me to re-zone, make
master-plan changes, etc. for areas which are not only
NOT within our city limits, but also still in the sphere-
of-influence of another city. I know it is legal to
proceed; but legality should only be one criteria of
our behavior. This action will create ill-will with our
neighboring city to the East and generally give La Quinta
an undesirable image.
I would respectfully suggest that we table all official
discussions and decisions relating to this project until
we have reached an agreement with the City of Coachella
regarding our respective spheres-of-influence and have
indeed obtained the area of the project as part of our
sphere-of-influence through LAFCO action.
Thank you for giving consideration to my concerns.
