AGREEMENT BETWEEN THE CITY OF LA QUINTA
AND THE COUNTY OF RIVERSIDE FOR VECTOR CONTROL SERVICES (EXCEPT
MOSQUITOES) AND PLAN REVIEW SERVICES
PROVIDED THROUGH THE HEALTH SERVICES AGENCY,
DEPARTMENT OF ENVIRONMENTAL HEALTH
This Agreement is entered into between the City of La Quinta (hereinafter referred to as
"City"), and the County of Riverside, through its Health Services Agency, Department of
Environmental Health (hereinafter referred to as "County").
WHEREAS, City desires the County to provide Vector Control Services that include
plague surveillance, fly control, rodent and cockroach control, advice and assistance, community
awareness and abatement projects, complaint response, public presentations, consultations, public
education with flyers and booklets, and in enforcing Riverside County Ordinances No. 523, 527,
650 and 657 as said ordinances have been adopted by City.
WHEREAS, City desires the County to provide detailed plan review and design of
subsurface sewage disposal systems as well as periodic requests for engineering assistance in the
review of water limes, sewer limes or assistance to the City on technical engineering issues related
to the provision of water and sewer within the city boundaries in accordance with County
guidelines entitled Waste Disposal for Individual Homes, Commercial and Industrial and the
current Uniform Plumbing Code.
WHEREAS, County has personnel with sufficient training and expertise to provide such
services; now, therefore,

2 The parties agree as follows:
3 1. SERVICES TO BE RENDERED. County shall furnish personnel, materials and

supplies to perform the following services: (The County shall not respond to the following citizen
5
6 complaints within the City without prior approval from the City Manager or his designee.)
7 A. Domestic Rodent Control Services:
8 1) Investigate all reported infestations of domestic rodents. Offer advice
9 on correct methods as may be necessary to ensure control, including
10
pest abatement for Rattus rattus and Rattus norve� only; elimination
11
12 of harborages and attractants; and education/consultation.
13 2) Maintain a program of public education, consultation, and assistance in
14 preventing, detecting and eliminating domestic rodent and ectoparasite
15
infestation.

17 B. Fly Control Services:
18 1) Investigate citizen complaints concerning flies and animal waste; take
19 action to eliminate fly breeding sources where practical, including legal
20
action if required, i.e. issuing citations, follow-up contact with the
21
offending party when necessary, and appearing in court as witness.
22
23 2) Cooperate with agriculturists, farm groups, civic groups, schools,
24 industries and other interested parties in solving area fly problems,
25 providing area chemical control only if the city approves it.

C. Other Vector Control Services: Respond to requests for assistance and to
27
28 citizen complaints with information and advice, providing legal action

where necessary and practical to eliminate source problems. County will
not provide chemical or biological treatment of house vectors. Other
vectors include but are not limited to, cockroaches, food -infesting pests and
insects, ticks, mites, lice, fleas, and bed bugs; venomous insects such as
bees, wasps, yellow jackets, hornets and ants; other venomous arthropods
such as scorpions and spiders, and vertebrate pests and vectors such as
native rodents, rattlesnakes, pest birds, bats and skunks, among others.
D. Overflowing Sewage: Investigate all complaints of overflowing sewage
and abate the situation if justified; including legal action if required, i.e.
issuing citations, follow-up contact with the offending party when
necessary, and appearing in court as witness.
E. Environmental Engineering Plan Review/Technical Assistance: Provide
Environmental Engineering/Technical Assistance to the City, at their
request, at the rate of $81.00 per hour, to be paid by the City, as set forth
on Attachments A & B, including water line layout, sewer line layout
and/or assistance in meetings involving public or private projects.
F. Plan Review Services: Provide for review of subsurface sewage disposal
system designs and replacement systems within the city boundaries and
perform onsite inspections, if requested by the City, to complete the design.
Requests for subsurface sewage disposal design review or replacement
systems shall be accompanied by a city application or building permit and

shall be presented, in person, by the proponent to the Bermuda Dunes
offices of Environmental Health for review. The proponent shall be
responsible for payment of any applicable, current County fee for the type
of review requested at time of submission of request.
G. Trash and Garbage: Investigate all complaints of illegal storage of
household trash and garbage, i.e. solid waste, and abate the situation if
justified, including legal action if required, i.e. issuing citations, follow-up
contact with the offending party when necessary, and appearing in court as
witness. This does not include hazardous waste, concrete, wood,
construction or demolition materials or debris, abandoned vehicles, tires,
scrap metal, motor vehicle parts, or any other items not defined as
household trash and garbage.
2. CHARGES AND PAYMENTS.
A. For and in consideration of the rendition by County of those services
specified in Section 1, A through G, City agrees to pay County at the rate
of $50.00 per hour for the cost of services rendered and at actual costs
to County for pesticides and supplies. The amount of $50.00 per hour
shall be deemed to be the total hourly cost to County to provide said
services, including any travel time.
B. County shall submit itemized billings for the items as outlined in
attachment "A" of Agreement to City on a quarterly basis, for all
services rendered. City agrees to pay all such charges within sixty (60)
days of receipt of itemized statements therefore.

C. Payments for plan review or engineering review/technical assistance

shall be paid as specified in Section 1, E and F above.

D. It is agreed and understood that the fees for those services as specified in
4
Section 1, G herein are payable directly to County by the applicant for
5
6
services.
7
3. PERSONNEL.
8
A. The services provided by County shall be performed by County personnel
9
under the control and direction of County. To the extent that City officers
10
or employees may also participate in any of the activities herein provided
11
12
for, or that peace officers of City (whether working by contract or as City
13
employee) may be called upon to render services, aid or assistance within
14
the boundaries of City, or otherwise to perform law enforcement functions,
15
any expenses thereof shall be borne by City.
16
B. In the event City wishes to have a County representative available to
17
18
provide testimony or otherwise provide expertise at a City sponsored
19
meeting, City will give a minimum of three (3) days notice to the County.
20
City shall be responsible for payment to County of an hourly rate of $50.00
21
per hour for attendance, including travel time. County will bill for any of
22
23
the above -rendered services with its quarterly billing statements as noted in
24
Paragraph 2, above.

4. HOLD HARMLESS
A. County agrees to defend, indemnify, and hold harmless City, its officers,
agents and employees from and against any and all liability, damages,
costs, losses, claims and expenses resulting from County's intentional or
negligent act or omissions arising out of activities undertaken pursuant to
this Agreement.
B. City agrees to defend, indemnify, and hold harmless County, its officers,
agents, and employees from and against any and all liability, damages,
costs, losses, claims and expenses resulting from City's intentional or
negligent act or omissions arising out of activities undertaken pursuant to
this Agreement.
5. ENTIRE AGREEMENT. This Agreement is intended by the parties hereto as a
final expression of their understanding with respect to the subject matter hereof and as a complete
and exclusive statement of the provisions hereof and supersedes any and all prior and
contemporaneous agreements and understandings, oral or written, in connection therewith. This
Agreement may be changed or modified only by an instrument in writing signed by both parties.
6. RECORDS. County agrees to maintain records and documentation of the services
rendered and supplies used pursuant to this Agreement for a period of five (5) years. Such records
or copies thereof, shall be accessible to City for review upon reasonable notification by City.
7. SEVERABILITY. If any provision of this Agreement is found to be invalid, void,
or unenforceable, the remaining provisions shall nevertheless continue in full force and effect
without being impaired or invalidated in any way. One or more waivers by either parry of any

provision, term, condition or covenant shall be construed by the other party as a waiver of a
subsequent breach of the same by the other party.
8. TERM AND RENEWAL. This Agreement shall be for the initial term of one year
from July 1, 1994 to June 30, 1995. Thereafter, the Agreement shall continue from month to
month until terminated upon thirty (30) days written notice given by either party to the other.

FIRST AMENDMENT TO CONTRACT FOR VECTOR CONTROL,
OVERFLOWING SEWAGE, TRASH AND GARBAGE, AND PLAN REVIEW SERVICES
COUNTY OF RIVERSIDE AND CITY OF LA QUINTA
WHEREAS the County of Riverside (County) and the City of La Quinta (City) have previously
entered into a written agreement between them on November 29, 1994 with County to finnish vector
control (excluding mosquito abatement), overflowing sewage, trash and garbage, and plan review services
to City on the terms and conditions specified therein;
The parties now agree to amend that contract in the following manner.
1. In paragraph 2A the rate to be billed to the City by the County for services
rendered shall be $112.00 per hour.
2. In paragraph 3B the rate to be billed to the City by the County for attendance of
County personnel in court shall be at the rate of $112.00 per hour.
In all other respects the language of the agreement remains unchanged.
