VETERINARY SERVICE AGREEMENT
CITY OF LA QUINTA

PLACEMENT AND CONDITIONS
A. THE SERVICE PROVIDER MUST BE A LICENSED VETERINARY CLINIC.
B. DURING ON -DUTY ANIMAL CONTROL OFFICER HOURS:
MEDICAL / INJURED PETS
Valley Animal Clinic/Valley Kennel will provide care to make the animal
comfortable while ownership is being determined. If ownership cannot be
determined, Valley Animal Clinic/Kennel will perform euthanasia or
release the animal to City of La Quinta Animal Control for proper
disposition.
2. Injured animals left beyond the time allotted, pursuant to D-3 and D-4
herein above, will incur boarding charges of $15.00 per day, chargeable to
the, City of La Quinta.
C. AFTER HOURS AND HOLIDAYS:
1. Service provider agrees to maximum of forty-five (45) minutes response
time, upon notification by La Quinta Police Department/Animal Control.
2. Valley Animal Clinic/Kennel will treat and care for sick/injured animals
for a fee not to exceed $40.00. (See Page 2)
3. The emergency treatment will include medications, supplies and boarding
until the next Animal Control Officer comes on -duty, or
twenty-four (24) hours, or when the injured animal is capable of being
picked up and transported, whichever is later.
4. Valley Animal Clinic/Kennel must notify La Quinta Animal Control to
pick-up any injured animal brought in by La Quinta Police Department no
later than the next regular working day.

D. STRAYS (INJURED OR WELL) BROUGHT INTO THE PET RESCUE CENTER.
Pets brought into the Pet Rescue Center and accepted into the program and injured pets.
When animals, either well or injured, are brought into the Pet Rescue Center by
employees of the Building and Safety Department of the City of La Quinta, the
following charges will be charged to the City:
FEES
1. Veterinary exam fee $15.00
2. Boarding fee (unlimited stay) 25.00
INJURED ANIMALS
Once an injured animal is brought into the center, every effort should be made to locate
the owner. If an owner is located, the owner will be required to make all arrangements
and assume financial responsibility for the animal, with the approval of the Animal
Control Officer prior to an authorized release. Valley Animal Clinic/Valley Kennel will
vaccinate the pet when it is brought in, to insure the safety of pets currently in the Rescue
Center. If the owner is located, they will assume responsibility of all fees incurred.
Owner must show receipt of license before we will release the animal. If the owner
refuses to assume the financial responsibility and pay all applicable incurred fees, the
animal will remain under the ownership of the Pet Rescue Center, and the City of La
Quinta will assume financial responsibility not to exceed $40.00.
TERMS OF AGREEMENT
Valley Animal Clinic/Valley Kennel will enter into a contract as agreed in document for
the period of 5 years. Should Valley Animal Clinic/Valley Kennel or the City of La
Quinta wish to terminate its obligation under this agreement�with or without cause, it may
be done by either party by written notice. 7104

INDEMNIFICATION
Each party shall hold the other harmless from liability or damages resulting from its own
acts or omissions of its officers or employees in performance of this agreement. The
veterinarian shall name the City of La Quinta as an insured on the veterinarian's errors
and omissions and general liability policies.
THE UNDERSIGNED AGREES TO THE VETERINARY SERVICE AGREEMENT OF THE
CITY OF LA QUINTA, AND WILL COMPLY WITH THESE RULES AND REGULATIONS.
FURTHERMORE, THE UNDERSIGNED VETERINARY SERVICES AGREES THAT ANY
FAILURE TO COMPLY WITH THESE RULES AND REGULATIONS BY THE OWNER,
OR ANYONE ACTING AS AN AGENT OF THE OWNER, SHALL BE
CAUSE FOR TERMINATION OF THIS AGREEMENT. THIS AGREEMENT MAY BE
CANCELED BY EITHER PARTY BY GIVING A THIRTY (30) DAY WRITTEN NOTICE
TO THE OTHER PARTY.

WELL ANIMALS
Animals are brought into the Pet Rescue Center and the following will take place.
a. Examination by a staff veterinarian.
b. First vaccination DHLP-P-C.
C. Fecal examination.
d. Behavioral evaluation.

RELEASE
By signing this document you are giving the Pet Rescue Center, located at 46-920
Jefferson, Indio, California, permission and all rights to said pet listed below. We are
releasing the City of La Quinta of any liabilities, claims, damages, losses or expenses for
said animal. The Pet Rescue Center will be responsible for the care and safety of this
animal and will not release responsibility of said animal until a permanent residence is
found.

I . Valley Animal Medical Center will provide care to make the animal comfortable
while ownership is being determined. If ownership cannot be determined, Valley
Animal Medical Center will perform euthanasia or release the animal to The City of
La Quinta Animal Control for proper disposition.
2. Valley Animal Medical Center is a 24-hour emergency faculty. All animals brought
in during emergency hours will be treated as emergencies. It will be the
responsibility of the attending veterinarian to determine treatment plan. If animal is
diagnosed as non -creatable, the animal will be euthanized.
3. Examination fee will be $75.00, per case.
4. Medical treatment of an injured or ill animal is to be authorized by the City of La
Quinta. An estimate will be presented with charges accrued at a 50% discount.
5. If owner is located, the owner will be responsible for all fees. If the owner refuses to
assume the financial responsibility and pay all applicable fees, the animal will
remain under the City of IA Quinta.
6. Valley Animal Medical Center must notify the City of La Quinta Animal Control to
pick-up any injured animal brought in by La Quinta Police no later that the next

TERMS OF AGREEMENT

INDEMNIFICATION
Contractor shall defend, indemnify and bold harmless the City, its officers, employees,
representatives and agents ("Indemnified Patties"), from and against those actions, suits
proceedings, claims, demands, losses, costs, and expenses, including legal costs and
attorneys' fees, for injury to or death of person(s), for damage to property (including property
owned by City) and for errors and omissions committed by Contractor, its officers, employees
and agents, which arise out of Contractor's negligent performance under this Agreement, except to
the extent of such loss as may be caused by City's own negligence or that of its officers or
employees. In the event the Indemnified Parties are made a parry to any action, lawsuit, or other
adversarial proceeding in ay way involving such claims, Contractor shall provide a defense to the
Indemnified Parties, or at the City's option, reimburse the Indemnified Parties their costs of
defense, including reasonable attorney's fees, incurred in defense of such claim. In addition,
Contractor shall be obligated to promptly pay any final judgment or portion thereof rendered
against the Indemnified Parties.

THE CITY OF LA QUINTA, AND WILL COMPLY WITH THESE RULES AND
REGULATIONS.
FUTHERMORE, THE UNDERSIGNED VTERINARY SERVICES AGREES THAT ANY
