FISCAL IMPLICATIONS: The First Amendment would provide for payment of up to $15,000 if an office building is not 50% completed by January 31, 2001. If, however, an office building is constructed, then the Agency would generate approximately $3,400 per year in tax increment revenue: these tax increment payments would continue until the Project No.2 Redevelopment Plan expires in 2039. BACKGROUND AND OVERVIEW: In January, 1991, the Agency entered into an Owner Participation Agreement OPA) with La Quinta Real Estate Partnership i.e., formerly TS Restaurants of Hawaii and California, Inc., the Participant") The OPA required the Participant to develop a 17,500 square foot restaurant and office development in phases; the first phase involved the development of a 8,500 square foot restaurant and associated parking, to be completed within 18 months or by July of 1992. In conjunction with restaurant construction, the Participant was also required to make improvements to the Coachella Valley and Deep Canyon Storm Channels. The second phase involved the development of a 9,000 square foot office building and associated parking. Pursuant to the OPA, office building construction was to commence no later than January, 1994, and be completed no later than January, 1995. The Agency's responsibility was to fund $250,000 of storm channel improvements. This payment was made in 1991. To-date, the Participant has constructed a restaurant of 12,000 square feet in size; however, the office component has not been constructed. In January, 1996, Agency staff contacted the Participant to discuss their nonperformance in regard to the Phase 2 improvements and inquired as to their plans for developing the office component. FISCAL IMPLICATIONS: None. Currently the 49 single family homes are being managed by the Agency's housing redevelopment consultant, RSG. The new contract with Merox Corporation, d.b.a. La Quinta Real Estate is not expected to generate any additional management costs. Further, property management activities are fully funded from rental income. BACKGROUND AND OVERVIEW: In March, 1 996, the Agency Board reviewed a status report regarding the La Quinta Housing Program Program"). The Program involves Agency ownership and management of 49 single family homes located in the Cove. The Agency purchased these homes in 1 995 and has continued to rent them to qualified Section 8 family households. The Agency intends to sell these homes on a limited basis as the home resale market dictates. To date, interim property management services have been provided by the Agency's housing and redevelopment consultant, RSG. After discussing the report, the Agency Board directed staff to initiate the process to solicit proposals for property management and real estate services. On April 22, 1 996, staff circulated a Request for Proposal RFP") to nine 9) property management and real estate firms. C AGENDA CATEGORY: BUSINESS SESSION: 3 COUNCILIRDA MEETING DATE: November 19,1996 CONSENT CALENDAR: ITEM TITLE: STUDY SESSION: Consideration of a request to approve the purchase of PUBLIC HEARING: a single family residential property at 52-445 Avenida Mendoza to retain the Agenoy's CC&R's and Second Trust Deed against the property RECOMMENDATION: Approve the acquisition of the property located at 52-445 Aven ida Mendoza at a Trustee's Sale scheduled for November 26,1996, at 10:30 a.m. and authorize the City Manager to appropriate the funds from the Low Mod Account in an amount not to exceed $95,000. FISCAL IMPLICATIONS: Should the Agency elect to purchase this property at the Trustee's Sale it will be resold to a new not yet identified) qualifying very low, low, or moderate income household. The Agency may incur up to an additional $10,000 in acquisition expense utilizing housing funds) related to unpaid principal, interest, and miscellaneous fees that have been incurred by the first trust deed lender until the time of the foreclosure sale. BACKGROUND AND OVERVIEW: On December 28,1994, Julia Grafton the Owner") purchased the property at 52445 Avenida Mendoza from Stockman Development. The Stockman Development Housing Program was a joint development between Stockman Development and the La Quinta Redevelopment Agency the Agency") for the development and resale of single family homes to very low, low, and moderate income families. The involved property was the last of fifteen 15) single family homes constructed by Stockman Development in cooperation with the Agency. The Owner secured a first trust deed in the amount of $78,765 from Directors Mortgage Loan Corporation and a silent second trust deed in the amount of $34,632 from the Agency as a qualifying low income household. The silent second trust deed was to be forgiven over a forty 40) year period provided that the Owner was not in default. The Agency's housing consultant, RSG, has maintained watch over this particular Owner/property due to her previous payment history. The Owner has been in default once before due to her failure to make payment on the first trust deed. The Owner cured the previous monetary default. FISCAL IMPLICATIONS: Annual funding requirements will range from $500,000 to $1,000,000 per year, depending upon loan demand and availability of Department of Housing and Urban Development mortgage funds. The source of the Agency's revenue would be the Agency's Affordable Housing Funds. This program would be reviewed on an annual basis and will be subject to subsequent Agency Board appropriations. BACKGROUND AND OVERVIEW: In 1995, the La Quinta Redevelopment Agency sold over $22 Million in tax allocation bonds to raise capital in order to fund a proactive affordable housing effort. As part of the bond issuance process, the Agency approved a list of proposed housing programs that included a multitude of components. One component involved establishing a rehabilitation program to provide low interest loans to assist single and small multi-family up to four units) property owners with property rehabilitation and improvement activities. A second component involved expanding the Agency's current second trust deed mortgage program to encompass non-new development project-specific residential purchases. In April 1996, the Agency Board reviewed a program outline and directed staff to proceed with the formulation of a comprehensive housing program. La Ouinta Housin?
