Kiedrowski, Executive Director Mj DBte: November 13, 1986 Subject: Authorization for Payment La *uinta Stormwater Project, Phase 2 East Channel) On June 27, 1986, former Executive Director Frank Usher signed an agreement between the Agency, Coachella Valley Water District and William Young Crystal Canyon of La Quinta) which authorized the District to pay an amount not to exceed $4,503,000 as payment in full for flood control facilities to be constructed for Phase 2 of the flood control project. The agreement further provided for construction to be substantially underway by November 1, 1986, and completed by November 1, 1987 As a result of the Tentative Tract Map change from Crystal Canyon to Heritage Club, which was approved by the Council October 7, 1986, Mr. Young has requested an extension of time to begin work on Phase 2 of the flood control project. The Water District is now requesting that a revised Agreement be executed between involved parties, with the only change being that construction begin by January 1, 1987, and be completed by January 1, 1988, a delay of approximately two 2) months. RECOMMENDATION rt is respectfully recommended that the Redevelopment Agency authorize the Executive Director to execute the revised Agreement between the Agency, Coachella Valley Water District and Crystal Canyon of La Quinta, in the amount of $4,503,000 on behalf of the Agency. Subject to the following conditions, we will recommend to the La Quinta Redevelopment Agency that it authorize the District to pay an amount not to exceed $4,503,000 as payment in full for the flood control facilities to be constructed on the above referenced project, including the connection southerly of the development to connect to Agency1s flood control facility currently under construction: 1. Any payments from the contingency of $196,269, included in the above amount, will only be made after approval of the change order by the District on behalf of the Agency. 2. Any reduction in prices and quantities from the estimate of J. F. Davidson Associates dated April 7, 1986, copy attached, shall be credited to the Agency. 3. Proposals for engineering, construction staking and soils engineering will be provided to document the amounts in the J. F. Davidson estimate. No payments shall be made in excess of the amounts in the estimate. 4. The drainage system for the Cove area west of Crystal Canyon shall be sized for the hundred year recurrence interval storm on the entire area south of Calle Sonora. This results in double 66 inch diameter pipes and double 66 and 72 inch pipes into Crystal Canyon* 5. Payment and performance bonds in the amount of the entire flood control project shall be provided to the District. 6. Certificates of insurance in the amounts required by the District for work under Specification No. 85-4 La Quinta Storiim*ater Project, Phase), shall be provided naming the District, Agency and City as additionally insured. Progress payments will be made monthly after lien releases are provided to the District based on estimates approved by the District. 8. Easements for flood control will be provided to the District prior to any payments. 9. The quantities and hydraulics for the grading plan will be verified by Bechtel Civil, Inc., and approved by the District. Any changes that result in reductions in total cost shall reduce the amount paid by the Agency for the flood control facilities. 10. The flood control facilities shall be constructed substantially in accordance with J. F. Davidson's plans dated April 9, 1986, as modified to reflect a change to a lot development program, except as modified by Bechtel or the District. 11. Construction shall be substantially underway by January 1, 1987, and completed by January 1, 1988. The Agency has sufficient funds on deposit with this District to fund this flooding control construction as part of the regional flood control system.
