A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LA QUINTA, CALIFORNIA, UPHOLDING A
PLANNING COMMISSION ACTION BY MODIFYING
THE LIGHTING PLANS FOR VILLAGE USE PERMIT
2000-004, AMENDMENT NO. I

APPLICANTS: A.P. LENCH II, MICHAEL BRAUCKMANN, AND
EILEEN VILLEGAS
WHEREAS, the City Council of the City of La Quinta, California, did, on
the 7th day of May, 2002 hold a Public Hearing to consider the request of A.P. Lench
II, Michael Brauckmann, and Eileen Villegas appealing a March 26, 2002 Planning
Commission approval of lighting plans for Village Use Permit 2000-004, Amendment
No. 1; and,
WHEREAS, the Planning Commission of the City of La Quinta, California,
did, on the 26th day of February, 2002, hold a duly-noticed Public Hearing, and on
March 26, 2002, hold a duly noticed Public Meeting to consider the request of
Chapman Golf Development, L. L.C. for a Village Use Permit, Amendment No. 1, and
more particularly described as:
APN'S: 770-190-001, 770-181-002, 770-181-003,
770-181-004
WHEREAS, at said City Council Public Hearing, upon hearing and
considering all testimony and arguments, if any, of all interested persons wanting to
be heard, said City Council did make the following Mandatory Findings of approval to
justify said Village Use Permit 2000-04, Amendment No. 1:
1. The lighting design of the facility as modified is compatible with the surrounding
development and consistent with the Municipal Zoning Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
La Quinta, California, as follows:
1. That the above recitations are true and constitute the findings of the City
Council in this case;

2. That it does hereby uphold the Planning Commission's action with modifications
to the lighting plans for Village Use Permit 2000-004, Amendment No. 1 for the
reasons set forth in this Resolution, which modifications are described in the
attached condition.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La
Quinta City Council, held on this the 7th day of May, 2002, by the following vote, to
wit:

MISCELLANEOUS
1. Prior to issuance of a building permit, submit for approval by the Community
Development Director, a revised Illumination Study modifying the March 26TM,
2002 Planning Commission approved Illumination Study by illustrating six poles
(but no more than eight) 12 foot high each with twin 100 watt lamps with
three inch shields (to shield potential light source illumination to the properties
to the north of the parking lot). The six (or eight) poles are to be located in the
landscape planters along the center aisle of the parking lot. A field verification
shall ensure that the source of the light is not visible from the adjoining
residential properties.
