PLANNING COMMISSION MINUTES 1 MARCH 28, 2017 Associate Planner Carlos Flores presented the information contained in the staff report, which is on file in the Design and Development Department. He stated that a redlined version of the proposed changes to the previous Conditions of Approval had been distributed to the Commission prior to the meeting. Chairperson Bettencourt declared the PUBLIC HEARING OPEN at 6:08 p.m. PUBLIC SPEAKER: Nolan Reggio, Diversified Pacific, Rancho Cucamonga, CA - introduced himself and stated that he represented the applicant. He said that the applicant accepted the updated Conditions of Approval and he was available to answer the Commission's questions. Discussion followed regarding the location of two-story homes within the project, building setbacks, applicant's options for additional time extensions to which staff stated the applicant can apply for additional extensions provided they do so prior to the expiration date; questioned the applicant's obligation regarding dust control and staff responded that the applicant is in compliance. Planning Manager Perez stated that the municipal code addresses dwellings located next to a project, city, county or track boundary and that they shall be limited to one story if an existing one story is within 50 feet of the common property line unless there is a street separating the two. He stated that in this instance, they do not have a one-story home that is within 50 feet of the project boundary of this tract. Chairperson Bettencourt declared the PUBLIC HEARING CLOSED at 6:35 p.m. Motion - A motion was made and seconded by Commissioners Quill/Blum to adopt Resolution No. 2017-005 of the Planning Commission of the City of La Quinta, California approving a time extension for Site Development Permit 2014-1004, Site, Architectural, and Landscaping Plans for the Estates at Coral Mountain. Wireless Telecommunications Facilities Inventory Planning Manager Perez presented the information contained in the staff report, which is on file in the Design and Development Department. Commissioners discussed the look of certain older cell towers to which staff responded that an ordinance was adopted in 2011 requiring cell towers to be PLANNING COMMISSION MINUTES 2 MARCH 28, 2017 stealth or camouflaged. Discussion continued regarding how to deal with the appearance of cell towers that were approved prior to the 2011 ordinance; and the responsibility of maintaining a cell tower to which staff stated that it is usually the responsibility of the wireless carrier or cell tower owner. Commissioner Quill suggested that since the property on which Cell Site 15 is located (78136 Francis Hack Lane) is owned by the County of Riverside that staff contact the County to determine what conditions apply to the site. Planning Manager Perez indicated that the next step would be to contact the applicants and establish a timeframe for compliance with permit conditions and exhibits; and to proceed with revocation or modification of the permit if compliance is not achieved within the timeframe. Commissioner Quill stated that he would like to see a legal determination as to whether or not a minor use permit for a change to a cell tower facility is sufficient to modify the conditions of approval to require some form of camouflage. PUBLIC SPEAKER: Brian Tracy, Retail Net Lease Properties - introduced himself as the owner representative for La Quinta Square and explained their plans for the new cell tower to be located on the property located at 78611 Highway 111. Planning Manager Perez indicated that based on the next steps moving forward, staff would provide a report to the Commission and explained the process to deal with any sites that remain out of compliance. CORRESPONDENCE AND WRITTEN MATERIAL - None COMMISSIONER ITEMS Chairperson Bettencourt presented a report on the 2017 League of California Cities Planning Commissioners Academy. Commissioner Blum requested staff provide an update regarding the 22-acre site located on La Quinta Drive west of Walmart. Commissioner Quill shared information regarding a Salton Sea bus tour scheduled for April 11, 2017. Chairperson Bettencourt shared information regarding the Vista Santa Rosa Commission meeting to be held on March 29, 2017. EXECUTIVE SUMMARY • The applicant requests conditional use permit approval for the operation of a urology medical office at 47474 Washington Street (Attachment 1). • The applicant proposes an amendment to the Omri and Boni Specific Plan to allow the proposed use, originally approved for office and restaurant uses. BACKGROUND The subject site parcel configuration was created in 1989 with Tract Map 24230. A conditional use permit is required for use of this commercial site per the conditions of approval for Tract Map 24230. The Omri and Boni Specific Plan 2001-052 was approved in 2001, which consists of the design and use of a 9,044 square foot Page 1of3 commercial restaurant and office building on a 1.09 acre parcel at the northeast corner of Washington Street and Lake La Quinta Drive. The project included approval of Site Development Permit 2001-690 and Conditional Use Permit 2001-56. The building operated formerly as the "Figue" restaurant and is currently vacant (Attachment 2). PROPOSAL & ANALYSIS The applicant is proposing remodeling and converting the existing building to operate a urology medical office (Attachment 3). The proposed office operations include a small lab, exam rooms, special procedure rooms, a physician office, administrative offices, a multipurpose room, and a small outpatient surgery center. The office would operate from Monday through Friday between 8 A.M. and 5 P.M. with 35 employees. The Specific Plan is specific to the use of the building as a fine dining restaurant and commercial rental office. A specific plan for the original approval was required by the CR (Regional Commercial) zoning of the property at the time and in order to encroach within the required building setback from Washington Street. The underlying zoning of the project site is currently Community Commercial District. The applicant proposes to amend the Omri and Boni Specific Plan to allow for all uses permitted in the Community Commercial District in La Quinta Municipal Code Section 9.80.040, including medical offices (Attachment 4). The building site is improved with 62 parking spaces. A total of 52 spaces are required for the use of the building for medical offices. There is sufficient parking available at the subject site for the proposed medical use and surplus of 12 parking spaces. The applicant proposes improvements to the site that include a new trash enclosure, entrance canopy, carport, generator, desert landscaping, removal of wood siding, and repainting of building (Attachment 4). The improvements will be reviewed under separate permits by City staff. AGENCY & PUBLIC REVIEW Public Agency Review: This request was sent to all applicable City departments and affected public agencies on December 14, 2016. All written comments received are on file and available for review with the Design and Development Department. Authority and Scope LA QUINTA, CA In accordance with CELSOC Planning and Zoning guidelines section 65450 Specific Plans, a planning agency or property owner may cause the preparation of a specific pion for the development of a particular piece of property. The Omri and Boni Specific Plan demonstrates implementation of commercial zoning criteria consistent with the General Plan in bath land use and intensity. Approval of the Omri and Boni Specific Plan is subject to city council Findings as listed in the Clty of La Quinto zoning Code section 9.240 Specific Plans. B. Purpose and Intent The purpose of the enclosed site development permit submittal for the Omri and Boni Restaurant Commercial Development is to ensure that this proposed development satisfies the requirements of the City of Lo Quinto Zoning Code and all allowances which may be granted as a part of the Specific Plan approval process. The proposed development is consistent with the approved General Plan, pprotects the public health, is compatible with adjacent zoning and uses, and is suitable and appropriate for the subject property. The following preliminary site development, building development, signage and landscape documents depict the character of the development. C. Project Overview The Omri and Boni Restaurant is located in the central Coachella Valley within the incorporated City of La Quinto (see exhibit 1 — regional map). The site is bounded on the south by Lake La Quinta Drive, west by Washington Street, east by Caleo Bay and north by vacant commercial land (see exhibit 2 — vicinity map). The site is currently undeveloped and has a minimum of landscape features, generally on the west and south sides as part of the original entrance to the Lake Lo Quinta Project. The project will develop a single building consisting of a fine dining restaurant and an attached commercial rental office building. Additionally appropriate parking and landscape improvements are planned on the easterly portion of the site. D. The Process and Findings The following four required findings are necessary to approve the project: Consistency with the General Plan The proposed development is consistent tin use and intensity with the General Plan. Public Welfare. The plan or amendment will not create conditions materially detrimentol to the public health, safety, and general welfare. The proposed project is consistent with city development standards, engineering standards and fire department requirements designed to protect public welfare. Land Use Compatibility. The specific plan is compatible with zoning on adjacent properties. The proposed development is consistent with the commercial character and uses of the properties and major arterial streets surrounding the subject parcel. Property Suitability. The specific plan is suitable and appropriate for the subject property. The project is located at the intersection of Washington Street and Lake La Quinto Drive, a major arterial and a local collector street, a location of which the General Plan Finds appropriate for the type and intensity of the proposed project. DEVELOPMENT PLAN Existing Site — Zoning Characteristics The subject site is located in the central Coachelio Valley within the incorporated City of La Quinia. The site is bounded on the north by undeveloped commercial land, east by Colea Bay, south by lake I.o Quinto drive and west by Washington Street, The site is zoned CR- Regional Commercial and is consistent with the General Plan designation M/RC — Mixed Regional Commercial. The project site is currently vacant. The site has on significant features and only a minimum of landscape development along the frontage at Washington and Lake Lo Quinta. Three sides of the site are improved with curb, gutter and sidewalk, Fire hydrants have been installed as part of the original tract development in accordance with City of La Quints standards. Architecture Land Use — Site Plan The site plan with building location is shown on exhibit 5 —Site Plan. This specific plan proposes a single building located on the westerly side of the property with the required parking located between Caloo Boy and the building. Circulation through the parking area is via a connecifng drive located along the northerly portion of the property. The parking demand calculation is based upon a usage factor of one car per 3 seats and an additional allocation of staff Pori ing, Because of the usage timing nature of the development, the parking for the use of the office complex is part of joint usage of the facility. It Is intended that the offices will be in operation farm 7am to 5 pm and the restaurant from 5:30 pm to 11 pm weekdays, with the restaurant having slightly expanded hours on the weekends. Overview The design intent of this project is to projecl a modernist contemporary vision of a fine dining experience. The juxtaposition of the sculpture of the architecture with nearby other architectural forms creates a view of the La Quints — Washington corridor experience thol is significant of inclusion as part of the Arls Center locotion. The project is self- conlained and anticipates no odditionof construction. B. Architectural Guidelines The building consists of a simple and direct palette of colors and materials. The use of basic type materials displays the honesty of material use consistent with contemporary architectural forms. Only one building is anticipated in this submittal. Roof Lines and Screening Roofs are sloping and flat and incorporate screening elements to hide the multitude of equipment required by a ic.Oourant. Additional screening walls at ground level provide privacy for other "back of house" operations. Services have been segregated from public uses to provide a positive personal arrival experience. Architectural Features The office building is located to take advantage of the views to the north and east and to provide an idenlification element for southbound traffic on Washington. Locating the polio/waiting area outside the bar area an the west side of the building continues the theme of openness. The large glass areas on the west side of the building allow for dramatic views of the locat mountains and the lights of the village and developments on the west side of Washington. Decorative and appropriate tooled and construction joints to minimize normal cracking and enhance applied and integral colors is part of the basic design of the project. Concrete block walls Natural grey concrete block laid in running bond with tooled horizontal and struck vertical joints forms the core division wafts and decorative planter walls. Glass Walls Glass walls of tinted glass and clear anodized aluminum Form the wall facing the street and the walls of the office spaces. Corrugated Metal The wall Facing the parking area is covered with corrugated metal laid horizontally in a gentle curve. The openings set in a random pattern are of aluminum frame with colored glass inserts. Stucco Smooth Finish stucco is used as an accent material in light warm grey. SIGN CRITERIA Only a minimum of signage is proposed for the project. A simple "OMRI AND BONI" to identify the restaurant and a simple placement of non self illuminated identification on the cost and west facades of the office space will provide appropriate graphics. The landscape design and implementation of the project will meet the City of La Quinta Design Guidelines for and zone planting. B. Carried throughout the project, the landscape design shall follow a Mediterranean and desert theme.
