Itis the property owners responsibility to notify contractor of all property lines, setbacks, easements and foundations prior to commencement of work. 2. DELAY. The contractor shall be excused for any delay in completion of the contract caused by acts of God, acts of the owner or the owner's agents, employees, or independent contractors, stormy weather, inspectors, extra work, failure of the owner to make progress payments promptly, or- other contingencies unforeseeable by or beyond the reasonable control of the contractor. 4. LABOR AND MATERIAL. Theconiractor shall pay all varied charges for labor and material incurred by contractor and used in the completion of the project, but may delay this obligation for bills received in any period during which the owner is in arrears in making progress payments to the contractor. 5. EXTRA WORK. Should the owner direct any modification or addition to the work covered by this contract, or should it become necessary during the completion of this project for contractor to add to, alter, or deviate from the above specifications; such modification or additon to the work covered by this contract directed by the owner, or any necessary additon, alteration, or deviation from the above specifications will become an extra charge over the sum mentioned in this contract and owner shall pay for same weekly as such additional work, alteration or deviation progresses. 6. ACCIDENT OR CALAMITY: If the project is damaged by an accident, disaster or.calamity; such as fire, flood, landslide, subsidence, orearth- quake, or by theft or vandalism, any work done'by contractor in restoring project`shall be paid for by owner weekly as stated in paragraph 5 hereof. 7. INSURANCE: Contractor shall carry Workers' Compensation Insurance for the protection of contractor's employees during progress ofthe work. Owner shall obtain and pay for insurance against injury to his own employees, if any; and persons under owner"s direction, and persons on the work site at owner's invitation. Said policies shall name the contractor as insured. 8. RIGHT TO. STOP. WORK: ContractoCsha11 have the right to stop work•if any payment.sha11 not by. made timely to contractor under this agree- ment: contractor may keep the job idle until all payments are received. Furthermore, the contractor may, at his option, terminate the contract and the owner shall be liable to the contractor for breach of contract. 9. LIMITATIONS: No action of any character arising•from or related to this contract, or the performance thereof, shall be commenced by either party against the other more than one year after completion or cessation of work under this contract. 10. ASSIGNMENT: Neither party may assign this contract without written consent of the other party 11. ATTORNEY FEES' In the event the parties hereto become involved in litigation arising out of the contract, or performance or breach thereof, the court in such litigation, or in a separate sun: shall award reasonable costs, expenses and attorney's fees to the prevailing party. The court shall not be bound by any court fee schedule, and may in the interest of justice, award the full amount of costs, expenses and attorney's fees incurred in good faith. 12.
