RE: Proposed residential addition at 556=625`Riviera in PGA West
Dear Mr. Baumann:
I am sending this letter to you to follow up on our conversation of July 28 in regard
to the above. I have spoken to Mark Harold, Building and Safety Manager, regarding
your situation and have received a copy of your plans from him to review.
As we discussed, the lot on which your unit .is situated is a common lot shared by
several other residential structures, what is referred to as a condominium map. These
maps are designed to transfer fee simple ownership of the basic building footprint and
limited surrounding areas (patios, etc.) to the buyer, with the remaining open areas
set out as common interest property. This common property is usually maintained by
a homeowner's association. However, the individual property owners also maintain:
a common interest in such open areas and are assessed dues in order to maintain
them. In reviewing the area delineated on the site plan submitted with your
application, there are no established property lines that relate to the boundaries as
shown. It does appear that the area is based on a metes and bounds survey, which
was prepared for some reason which I cannot discern.
The area within the boundaries 'would not be considered as a parcel or lot for
purposes of calculating lot coverage allowance. The method we would use is to
assess the entire area of the common lot and all structures located thereon. Your unit
is located on Lot 7 of Tract 24801, which is a 3.29 acre parcel with 13 Highlands
units plotted on it. As I discussed with you by phone, the current lot coverage
maximum for the RL district is 40%; however, this requirement will be increased to
50% effective September 3, 1998. The specific plan for PGA West is silent on lot
coverage, so the RL zoning takes precedence.
In terms of lot coverage, Lot 7 contains 143,312 square feet of land area. If divided
among the 13 units located on this lot, each unit would theoretically be permitted just
over 4,400 square feet of building area under the 40% coverage rule and just over
5,500 square feet under the 50% rule. Please note that building area also would
include any common. area structures, such as pool equipment and restrooms, etc.

However, these are minor structures and there is only one pool associated with Lot
7. Although the exact building coverage is not known, based on the average unit
sizes located on this lot, it is probable that your proposed addition is under the 40%
coverage, as your total building area with the addition is about 4,050. square feet.
I am including a copy of the portion of the final map for Tract 24801, which shows
Lot 7, along .with a letter sent last year to Mr. Rob Pitchford on the City's position
relating to room additions and guest houses. If you have any additional questions
