HOME OCCUPATION CONDITIONS AND CRITERIA
ALL HOME OCCUPATIONS SHALL COMPLY WITH THE FOLLOWING CONDITIONS AND REQUIREMENTS:
1. No one, other that the resident of the dwelling shall be employed on the premises in the conduct of the Home
Occupation.
2. The Nome Occupation shall be conducted entirely within the enclosed area of the main building and shall not occupy
more than 25% of the total area of the structure.
3. A Home Occupation shall not be conducted within an accessory structure. 'There may be storage of equipment of
supplies in an accessory structure. Garage space may be used for the conduct of a Home Occupation only when it does
not interfere with the use of such space for the off-street parking or vehicles required by Chapter 9.160 of the Zoning
Ordinance.
4. There shall be no outdoor storage of equipment, machinery, supplies, materials, or merchandise.
5. There shall be no sales activity, either wholesale or retail, except mail order sales, nor shall there be the maintenance of
an office open to the general public.
6. There shall be no supply of hazardous materials stored on the premises at any given time (i.e. pool, chlorine, paint
thinner, etc.), unless the hazardous materials are stored in a manner approved by the State Fire Marshal or any other
regulating agency.
7. There shall be no dispatching of persons or equipment to or from the subject property, including the use of vehicles
which operate to and from the prernises.
S. No vehicles or trailers, except those normally incidental to residential use, shall be parked at the residence at any time.
9. There shall be no use of any mechanical equipment, appliance, or motor outside of the enclosed building or which
generated noise detectable from outside the building in which it is located that is related to the business.
10.. There shall be no signs or other devices identifying or advertising the home occupation.
11. In no way shall the appearance of the building or lot be so altered, or the home occupation be so conducted, that the lot
or building may be reasonably recognized as serving a non-residential use (either by color, materials, construction,
lighting, sounds, vibrations, etc).
12. No Home Occupation shall create a nuisance by reason of -noise, odor, dust, vibrations, fumes, smoke, electrical
intert'erance, traffic, or other causes.
13. The use shall meet reasonable special conditions as established and made of record in the Home Occupation Permit, as
may be deemed necessary to carry out the intent of this section.

Dear Ms. Cruickshank,
PGA West Residential Association, Inc. Board of Directors reviewed your e-mail dated December 2, 2015, with regard to
My Palm Springs Concierge, the proposed in-house business that you would like to operate at 80-327 Oak Tree. The
residence is owned by Mr. & Mrs. Brian Karl. The Board considered the request and determined that the business, My
Palm S rin s Concier e, as described in your e-mail of December 2, 2015, is consistent with the established criteria for
the operation of a business within the Association.
As you know, the Association is entirely residential and the Association's Declaration of Covenants, Conditions and
Restrictions ("CC&Rs") do not allow commercial use. However, due to changes in law and technology, the Association
recognizes that it is possible that some types of businesses can be operated within the Association without altering or
impacting the residential character of the Association. These businesses are the kinds that are operated using nothing
more than a telephone line, fax machine, and personal computer.
It is only this type of business, without any outward indication of business activity, that is currently permitted pursuant to
California law and the CC&Rs, to be operated within homeowner associations. The reason they are permitted is that they
have no impact on the surrounding community and have been determined to be "incidental to residential use".
The Association's position is that those businesses that have as outward indication of business activity will be prohibited
from the Association. For these purposes, "indication of business activity" includes, but is not limited to the following: a)
storing business related items in the garage which prohibits the parking of vehicles; b) having deliveries (e.g. more than
once or twice a month); c) having business related foot and vehicular traffic in and out of the home; and, d) solicitation.
Furthermore, any business in the Association must be entirely contained within the residence. For example, a business
that operates from a spare bedroom by use of a telephone and personal computer is acceptable.
Accordingly, so long as your business can be operated by the guidelines set forth herein, you will be allowed to operate
your business out of the Oak Tree home within the Association. Please note that the Association has made this decision
pursuant to current California law and reserves the right to revoke this decision if the law, or other circumstances,
mandate said revocation.
