CULTURAL ARTS COMMISSION MEETING
DATE: November 12, 1998
ITEM TITLE: Bear Creek Channel Art Piece - La Quinta Arts Foundation
RECOMMENDATION:
As deemed appropriate by the Commission.
BACKGROUND AND OVERVIEW:
On October 4, 1994, the La Quinta City Council approved an allocation of $5,000 from the
Art In Public Places Fund to support an on -going program with the La Quinta Arts Foundation
"Youth Art Works on Public Land". The first project was going to be completed at Eisenhower
Park (Attachment A).
At the April 4, 1995 City Council meeting, it was requested that the project site be relocated
to the Bear Creek Bike Path. The $5,000 was still committed to the project (Attachment B).
On August 1, 1997 Jerry Herman, Community Development Director received written
correspondence from Ms. Terri Triviso requesting that the Bear Creek Channel Project be
placed on the Art in Public Places Commission Agenda (Attachment C).
On September 8, 1997, Ms. Terri Triviso addressed the Art In Public Places Commission with
an update and to recommend that when an artist is selected, the Art Foundation will bring their
recommendation, design and request for additional funds back to the Commission (Attachment
D).
Ms. Claudia Gambel from the La Quinta Arts Foundation had been invited to attend the August
13, 1998 Cultural Arts Commission meeting for an update on the project. Ms. Gambel no
longer works for the La Quinta Arts Foundation and that position will be filled by the end of
September. Once the new staff member is on board, the Commission will be given a report
on the project.
Ms. Jana Barbier from the La Quinta Arts Foundation has been invited to attend the November
12, 1998 Cultural Arts Commission meeting to present an update on the project.

The alternatives available to the Commission are:

3. Allow the Art in Public Places Committee (APP) to utilize ftuids from the APP Fund to match
existing and future donations received from other civic organizations to implement the progmuL
FISCAL 51PLICATIONS:
Commitment of an amount of $5,000 of Art in Public Funds. Future commitments of funds would require
Council authorization for exact amount.
The Art in Public Places Committee at its meeting of September 12, 1994, reviewed a proposal by the La
Quinta Arts Foundation to employ the youth of La Quinta in various areas of the City to create art work
in their own area of the community. 'The program would utilize different local artists to oversee each
project and instruct the youth. The youth targeted for the program would be those in their junior and senior
year of high school. The program would be on -going throughout the year with an evaluation at the
completion of each project. The APP Committee has chosen the Mini Park at Eisenhower and Avenida
Colima as the site for this first pilot project with other sites to be determined at a later date and brought
to Council for their review and approval.
In addition, local civic organizations will be asked to donate funds to help implement the program to make
the program unique to La Quinta and to generate interest in the community to make the program successful.
The City would then match the ftuids raised by committing APP funds. (At the present time, VIVA
Foundation has committed $5,000 to the Mini Park. 1"he APP would like to match this amount W develop
a total of $10,000 to be used on the Mini Park project.)
At this time, the APP Committee is asking Council to:
1. Support the concept of the program, "Youth Art Works on Public I and ";
2. Approve the Eisenhower/Avenida Colima Mini Park as the f= location to start the program; and,
3. Allow the Art in Public Places Committee (APP) to utilize ftmds from the APP Fund to match
donations received from other civic o ns to implement the program.
Following Council's approval for the above, the Committee will return for Council approval, regarding the
specific art work as well as the amount of APP funds needed.
FINDINGS AND ALTERNATIVES:
The alternatives available to the City Council are:
1. Approve the recommendation as presented;
2. Modify the recommendation as deemed appropriate by the City Council;
3. Provide alternate direction to the Art in Public Places Committee,
4. Deny the recqFmnendation.

At that time Council approved the Art in Public Places Committee's recommendation (additional information
provided in City Council staff report -Attachment 1) for the Eisenhower/Avenida Colima Mini Park as the location
for the first project. It was explained, at that time, that what the students would be installing would come back
before the Council for their approval.
Since that time, the Foundation has received additional funds for the project (no additional funds are being
requested of the City). Subsequently, the Foundation requested the project be expanded. The Foundation
presented a request to the APP Committee to relocate the project to the Bear Creek Bike Path. The project would
still utilize local teenagers, with local artists assisting in the designing and creation of the covered rest stops along
the path. The covered rest stops would be three dimensional and would provide shade at different locations. The
location and number of stops to be constructed would be determined after a design and costs had been determined.
This design would then be presented to Council for their approval.
The Foundation plans to hold a community meeting where the project would be explained in more detail. The high
school students selected for the project would be required to do a historical and geographical research of the City
La Quinta and collect artifacts to be used in the structures. Judy Bocca will be the first local artist to work with
the students to design and fabricate the shade structures.

The recommendation of the Committee is based on the determination that the additional funds would provide an
opportunity to do a more visual project and involve more of the community for this first project which will warrant
the relocation to a larger area.
The options available to the Council are as follows:
I . Approve the project as recommended by the Art in Public Places Committee;
2. Deny the request;
3. Refer the matter to staff for additional information.

Thank you for taking the time out of your busy schedule to meet with Susan
Francis, Kay Wolff and me regarding the Bear Creek Public Art Project which is
part of our Youth Art Works Educational Outreach Program. We appreciate
your input and suggestions for proceeding with plans to implement our first rest
stop along the Bear Creek Channel Bike Path.
Per your suggestion, we are formally requesting that the Bear Creek project be an
agenda item at the Art in Public Places Commission meeting in September. As we
expressed to you at our meeting on July 18th, the Foundation is committed to
completing the project and has budgeted $16,000 for the 1997/98 fiscal year - $5,000
of which is money that was granted to the project by the City of La Quinta's Art in
Public Places Commission. At this time we are asking the commission to
demonstrate their support of the Youth Art Works Program by allowing us to
retain the $5,000 grant already committed by the City for use in the completion of a
Bear Creek public art rest stop.
Currently our committee is determining the process by which to evaluate new Bear
Creek designs as Judy Baca has communicated that she can't complete the project
and has instructed us not to use concepts developed under her leadership.
However, research done by high school students in the summer of 1995 remains an
integral component of any new design considered by the Foundation's Youth Art
Works committee.
Your assistance in presenting our request to the Art in Public Places Commission is
greatly appreciated. Should you have any questions or concerns please do not

I Community Development Director Jerry Herman informed the Commission
that Mr. Lopez was unable to attend the meeting, but Ms. Terrie Traviso of
the La Quinta Arts Foundation was in attendance to discus the proposed art
piece for the Bear Creek Channel.

2. Ms. Traviso passed out a brief summary of the Youth Artworks Program.
information on their first project Shadow Walk. and the current project. Bear
Creek Channel. Ms. Traviso reminded the Commission that the City Council
had given the Foundation $5,000. based on the Commission's
recommendation. for these programs. The Foundation still has this money
and she was requesting that the Commission allow the money to remain in
their fund so that the project can be brought to fruition. She went on to
explain that since the departure of the director of the Foundation at that time,
the artist also withdrew from the project. They are working to make use of
the research that was done by the students in 1995. They have formed a new
committee to select a new artist for the project. Once that has been done, a
recommendation will be made to the City'.
Chairman Walling asked if the first project was site specific. Ms. Traviso
stated it was for the art piece at the top of the Bear Creek Channel Bike Path
at the top of the Cove. Discussion followed regarding the history of the work
that had been completed so far.
4. Community Development Director Jerry Herman clarified that the
Foundation was before the Commission at this time to ask that the funds be
kept with the Foundation. When an artist is selected, they will bring their
recommendation, design, and request for any additional funds, if needed,
back to the Commission.
5. Commissioner Shamis asked if there was a time frame for the art piece. Ms.
Traviso stated they hoped to have this completed by the end of this school
year.
6. Chairman Walling stated that the Commission was to speak with Mr. Ray
Lopez regarding additional art pieces on the Channel. Staff suggested that
Mr. Lopez be contacted to make a recommendation for additional sites. Ms.
Traviso stated it was her understanding that when the project was first
formed, there were to be eight sites under this Youth Art Works program.
7. There being no further discussion, it was moved and seconded by
Commissioners Shamis/Reynolds to approve the extension of the $5,000 and
the project. Unanimously approved. Ms. Traviso stated she would see that
progress reports were sent to the Commission.

ITEM TITLE: City Council Action on Work Plan
RECOMMENDATION:
As deemed appropriate by the Commission.
BACKGROUND AND OVERVIEW:
At the October 20, 1998 City Council meeting, the City Council adopted the Cultural
Arts Commission 1998/99 work Plan (Attachment A). The item for re -consideration
by the Council "Meet A La Quinta Artist" was discussed by the Council and agreed
upon to be included in the Work Plan with a modification of the program being offered
every two months instead of monthly. It was also recommended that the artist be
introduced at the Mayor's Luncheon sponsored by the Chamber of Commerce or the
Chamber mixers.
There was also a change to the "Update of the Master Plan", the adopted change was
that the title read "Review Mater Plans".
The City Council then approved the Work Plan. The Commission may now begin work
on the identified projects.

The alternatives available to the Commission are:

RECOMMENDATION:
As deemed appropriate by the Commission.
BACKGROUND AND OVERVIEW:
There is a Temporary Art Program Contract adopted by the City Council (Attachment
A). Several Commissioners have been told by artists that the contract is too restrictive
and the costs associated with the program are the responsibilities of the artist.
Therefore, the existing contract has not been implemented by artists.
The Cultural Arts Commission has received approval from the City Council, in the form
of the approved Work Plan, to review the contract and make recommendations to the
City Council on revising the Contract.
The process will involve researching other Temporary Art Contracts that are acceptable
to the artists, and presenting a draft copy of the City of La Quinta's revised contract
for review by the City Attorney before submitting it to the City Council for approval.
ALTERNATIVES:
The alternatives available to the Commission are:
1 . Begin revision of the Temporary Art Contract;
2. Do not revise Temporary Art Contract;
3. Provide staff with alternative direction.

ACCEPTANCE AGREEMENT
This Temporary Loan and Acceptance Agreement (the "Agreement") is entered into this
day of 5 1998, by and between the City of La Quinta ("City")

WHEREAS, the City wishes to accept,and the Artist wishes to loan on a temporary basis)
an artwork more fully described in Exhibit "A" attached hereto and incorporated herein by this
reference; and
VaIEREAS, the City desires to increase public awareness and exposure to the arts in a
cost-effective manner for the general welfare and benefit of the City's residents; and
WHEREAS, the Artist is interested in making the temporary loan to the City to be
displayed at the City's discretion; and
WHEREAS, the display of the artwork is of mutual benefit to the City and the Artist,
NOW, THEREFORE, the parties hereto agree as follows:
1. The City shall accept the temporary loan of the artwork described in Exhibit "A" for a period
2. Artist agrees that the City shall have sole and absolute determination as to the location and
placement of the artwork. In the event Artist does not approve of the proposed location this
Agreement may be cancelled.
3. Transportation of the artwork to the exhibition site, proper installation, proper de -installation,
and removal of the � artwork from the exhibition site shall be the responsibility Of the Artist.
City shall bear the reasonable cost of such transportation, installation, &-installation and
removal. "Reasonable cost" means those sums set forth in Exhibit "B", which is attached
hereto aqd,incorporated by this reference. All plans and installations for the artwork shall be
approvelthe app�opr.iate City and/or other government officials.
4. Artist shall provide City with written instructions for appropriate maintenance and
preservation of theartwork. During the exhibition period, City shall, be responsible for the
maintenence of the artwork. City shall take reasonable steps to utilize the maintenance
procedures and/or methods described by Artist and set forth on Exhibit "C", which is attached
hereto and incorporated herein by this reference, but City reserves the right to decline
implementation of any or all, or any part thereof, of such procedures and/or methods if
circumstances, including but not limited to considerations of cost, render such implementation
unreasonable. In the event City declines to implement such procedures and/or methods, Artist
may undertake such procedures and/or methods at Artist's sole expense.
City shall insure the artwork aagainst damage or loss in the amount of dollars
and no/100ths ( _), which the parties agree is the fair market value of the artwork
and the extent of the City's liability in the event of damage or loss. City's obligation to
provide insurance is solely for the duration of the exhibition period and only while the artwork
is located on City property, excluding installation and de -installation. Artist is responsible and
liable for any damage or destruction that may occur during transportation of the artwork to
and/or from the exhibition site, during installation, and during de -installation.
6. The exhibition period set forth in Section I above may be shortened or lengthened in duration
by mutual agreement between the Artist and City. Notwithstanding the foregoing, City
reserves the right, in its sole discretion and with or without cause, to decline or terminate
exhibition at any time.
7. Artist may sell the artwork during the term of this Agreement and, if so sold, may assign his
or her rights under this Agreement. However, under no circumstances shall sale of the
artwork terminate this Agreement or adversely affect City's rights hereunder including, but
not limited to, City's right of possession. Artist shall notify City immediately upon sale of the
artwork and include instruction regarding the party to whom the artwork should be released
upon expiration of the exhibition period.

RECOMMENDATION:
Authorize the expenditure for additional pages in the Community Services Department
Winter/Spring brochure for Public Art Work.
BACKGROUND AND OVERVIEW:
In the Cultural Arts Commission 1998/99 Work Plan, the task of developing a Public
Art Program Brochure was approved by the City Council. It was approved that current
publications be utilized for the promotion of the City's Public Art pieces.
The Community Services Department has three annual brochures (Attachment A) that
have a distribution of 9-10,000 each, being delivered to residences in La Quinta and
distributed to various businesses. By including the Public Art information in the
Community Services Brochure, the information will be delivered to the public and not
create a piece of material that is published just once. The information in the brochure
can be updated and modified each season.
The cost to include additional pages in the Community Services Brochure will not
exceed $1,000 for the four pages. The printer requires a minimum of four pages. The
cost includes color pictures and text.
Should the Commission determine that they would like to use this vehicle to publicize
the Public Art pieces, the information will need to be submitted to the Community
Services Department by December 1, 1998.

ITEM TITLE: Bus Stops in La Quinta

BACKGROUND AN OVERVIEW:
The most recently constructed bus stops in La Quinta have been conditioned to include
a piece of art work as a part of the structure.
The stop on the northwest side of Highway 111 and Jefferson, in front of Home
Depot, is awaiting installation of the art work. Mr. Art Fernandez has been
commissioned to produce the art work for the stop. He was commissioned by the
developer and not the City.
Any further bus stop development will be conditioned for art work. Staff has
recommended that the developers be notified of the Cultural Arts Commission and the
artist bank.

Subcommittee Report
November 2. 1998
Artist Participation Day
As Chair for the subcommittee sponsored by the Cultural Arts Commission, it is my
pleasure to report the success of the City of La Quinta's celebration of "Arts and
Humanities Month". The Artist Participation Day was well received by the students,
teachers and artists.
On October 28, 1998, from 9:46 to 11:42 a.m. at La Quinta High School, our invited
guest artists made their presentations in three assigned classrooms. The students
rotated every 35 minutes through the three classrooms. Approximately 300 students
attended the program.
Alber De Matteis, (Metal Sculpture and Mosaic Towers at Fritz Burns Park) presented a
slide show focusing on the History of Sculpture through the ages. It was excellent and
the students were totally absorbed.
Phil Cordova (Photography)* presented new technology in photography and the art of
taking the best photos.
Bill Ware(Metal Sculpture and Oil Painter, Conquistador at Rancho La Quinta) focused
on painting techniques and the business aspect of being an artist. Students asked
questions and learned from the experience.
In attendance were Karen Wheeler, head of the Art Department at the High School,
respective teachers and Commissioners Reynolds and Shamis. At the conclusion of the,
program, the artists, Commissioners and the Community Services Director had lunch at
the Citrus Course, as a token of appreciation for participating in the program.
Karen Wheeler was delighted with the program and interested in the Cultural Arts
Commission on behalf of the City Council for the event. She also suggested a joint
venture of the Poster Competition in our schools, using the approved City of La Quinta
bird, flower and tree. The schools would submit their best works to the Cultural Arts
Commission who would then appoint a panel of judges to recommend to the City
Council, a final winner. Just a thought, there are many reasons and ways to promote
this idea, which will certainly bring our community together, which is what we all want.
On October 29, 1998, at the La Quinta Middle School, from 9:49 to 11:30 a.m.,
Commissioners Shamis, Reynolds, Community Services Director Dodie Horvitz met Craig
Taylor and the three artists scheduled for the morning presentations.
Marsha Gibbons (Ceramist and Mural Designer, La Quinta Car Wash) brought her
portfolio as part of her presentation. On the wall, she had photos of the entire process.
As a teacher in Cathedral City High School, she certainly knew how to reach the
students.
Steve Rieman (Metal Sculptor) brought in a maquette to show the students his most
recent submission for a public art project.
Barbara Serranella (Author) who lives in PGA West was a delight and encouraged our
students to attempt creative writing, especially on subjects they know. She also
recommended reading and we all enjoyed her presentation and the questions that
followed all the artists who spoke.
At both schools, we asked for feedback. All parties involved were very pleased on both
days and we all look forward to the 1999 celebration of the National Arts and
Humanities Month using different artists and forums.

VOICES FROM THE FIELD is a free, day -long symposium which will
bring public art experts and enthusiasts together in a lively discussion of
issues and trends which affect the field today. Speakers will include
artists, administrators, and private development art consultants in case
study examination and panel discussion which showcase public art
programs and projects along the West Coast.
Presenters confirmed to date include: Jack Mackie, Artist, Choir of the Seattle
Art in Public Places Committee and internationally known as a public art pioneer
and innovator; Diane Morgan, Arts Administrator for the City of Palm Springs
and Chair of the Palm Desert Civic Arts Committee; Mary Dolden Vealle,
Private Art Consultant, San Francisco, & art advisor to the Gardens of El Paseo;
Mineko Grimmer, Los Angeles, Artist, & creator of a major new sculpture for the
Gardens of El Paseo; and, John Nagus, Palm Desert Community Arts Manager,
and former art consultant to major private developments in Canada.
The event will be held Friday, November 20 from 10:00 am until 4:00 pm and
will be held in the Community Room of the Palm Desert Public Library, 73-510
Fred Waring Dr.
