CULTURAL ARTS COMMISSION MEETING

ITEM TITLE: La Quinta Court Proposed Art Project
RECOMMENDATION:
As deemed appropriate by the Cultural Arts Commission.
BACKGROUND AND OVERVIEW:
The La Quinta Court Development will be located on the southeast corner of
Washington and Highway 111. The developer, Mr. Dale Frank has provided
information regarding the art piece he would like to have incorporated into the La
Quinta Court project.
Mr. Frank has submitted two concepts for consideration by the Cultural Arts
Commission in addition to the fountain that is incorporated into the project
(Attachment A).
The first choice, as submitted by Mr. Frank would be to commission Bruce Beasley to
produce a sculpture "Outreach III" that would be incorporated into the water feature.
The water feature's estimated cost is $55,000 and the sculpture is $75,000 for a
total of $130,000. Mr. Frank has also submitted in his proposal the architect's cost
for the fountain at $10,000 making the total project cost $140,000. The project is
scheduled to pay $10,000 toward the Art in Public Places fees. With the La Quinta
Court's APP fees of $10,000, the Commission is asked to consider two items: the
"Outreach III" sculpture and the additional $130,000 needed for this project be
allocated from the APP fund toward this project.
The second choice, as submitted by Mr. Frank would be to commission Bruce Beasely
to produce a sculpture, Ceremony II for a cost of $40,00. With the cost of the
fountain, architect and art piece the total price would be $105,000, with $95,000
being asked to be allocated from the APP fund.
Should the Cultural Arts Commission not recommend Mr. Frank's art piece be funded
from the APP account, the water feature will be the only art feature located at the
La Quinta Court, per a conversation staff had with Mr. Frank.

ALTERNATIVES:
The alternatives available to the Commission are:
1 . Make a recommendation for City Council consideration that the La Quinta
Court art piece consist of "Outreach III" and the water feature, with an
allocation of an amount not to exceed $130,000 from the Art in Public
Places account to supplement the fees paid by the La Quinta Court
project toward the art project; or
2. Make a recommendation for City Council consideration that the La Quinta

project toward the art project; or
3. Make a recommendation for City Council consideration that the La Quinta

Dear Ms. Horvitz:
This letter is in reference to Art in Public Places for the La Quinta Court project.
Enclosed is a letter from Conway Architecture regarding our proposed design for the Art in Public
Places requirement As explained in Conway Architectures letter our proposal consists of a terraced
water chain type series of low fountain platforms with possible sculpture integration in the
fountains.
Enclosed is a brochure depicting various sculptures and information, including costs, from Mr.
Bruce Beasley who is the architect's first choice. Also enclosed is information from a second artist
Mr. Bruce Thomas that would be the architect's second choice.
It is my intent to work with the City of La Quinta to enhance the artistic nature of the project I
would hope the city elects to support the fountains as drawn and urge the city to select a significant
sculpture element I believe the proposed design will enhance the artistic nature created by the
existing project's design. As with anything scale has a direct correlation to cost.
I present the altematives for the city's selection based on the city's ability to provide funding to
cover the cost approved
The estimated cost for the Art in Public Places element of the project is as follows (see attached
documentation).

If the city were to appropriate a reduced amount for the art in public places element it is my
proposal that the art be reduced to the water element only. I believe this to be the predominant
feature. The scale of the terraced water chain type series of low fountain platforms to be built would
be dependent on the budget approved Please be assured that I will cooperate with the city to the
greatest extent possible. I will do every thing within my control to reduce the final cost for this
work.
To summarize, all of the choices will blend with the artistic effect created by the building rotunda
element at the comer. Knowing the importance of this comer and the city's indication that
additional funds can be provided at the city's discretion, I present these alternatives for review and
determination by city staff and city council.

Dear Mr. Reiter
I spoke to Jim Haack and he asked me to present a size and price range for the La
Quinta Court Development. I believe that you have seen the book and other
material that we sent to Jim.
The $25,000 budget would buy a piece like Bateleur II (in the catalog page 128) or
Partisan II (see enclosed photo) Pieces of this size would need to go up on the patio
area between the fountain and the building. These would go on a pedestal
approximately 30" high, and you could see them from the street, but it would not be
realistic to say that they would have any real impact except from viewers on the
patio.
The next size option would be Ally II or Ceremony II. Ally II (see enclosed photo) is
9' tall and Ceremony II is 10' tall. I am enclosing a poor quality picture of the first
version of Ceremony II, which shows it in a park in Germany. The later version is
taller and is shown in the drawing of Ceremony II. Ceremony II and Ally II are
$40,000. Both of these would stand alone without a pedestal and would be seen
more from the street although they are not as large as Jim spoke about preferring.
Outreach III is the piece that would be the best size. It is 152" high x 100 wide. It
would be very prominent from the street and would be a real signature for the
corner. It is $75,000. The photo is of a smaller and somewhat different version of

I would like to thank you in advance for your time and attention to our project. Per our
conversation of 10/9/00 please find enclosed a schematic fountain plaza plan for the proposed
Art in Public Places installation at the La Quinta Court Development. As you may remember
our project is located at the corner of Washington Street and Highway 111. I have also enclosed
a view of the corner building to give you a sense of the architectural character of the project.
We have received both site development and specific plan approval and are currently under
construction. Our rough overall project completion date is March/April of 2001.
Our proposal consists of a terraced water chain type series of low fountain platforms organized
on a radius that relates to the corner rotunda and fronted by a plaza that extends to the corner.
We anticipate integrating an informal arrangement of boulders and paving to soften the
fountain and relate the installation to the adjacent landscaping better. In addition a single
sculpture or perhaps a series of smaller multiples would be incorporated. We envision the
sculpture playing an active role with the water and perhaps also moving with the wind.
We are in negotiations with two artists and expect to finalize our decision with in the next two
weeks. At that point we will integrate the sculptural component, make any adjustments
necessary to the fountain and plaza, and submit this proposal for council approval. We
discussed the possibility of being added to the November 9 agenda.
Please take a moment to review the enclosed and give me a call to discuss our plans. I would
very much like to get your feedback on our proposal, on navigating the city process
successfully, and on funding opportunities beyond our mandated percentage of construction
costs.

BACKGROUND AND OVERVIEW:
The Cultural Arts Commission is an advisory commission to the City Council in the
area of the arts. One of the functions of the Commission is to take public input
regarding proposed projects and work within the City's process to address the project
in the appropriate manner. Historically, when an unsolicited art project is proposed for
public display at a City facility, the project concept has been considered by Art in
Public Places Commission. Should the Commission deem the project appropriate and
the artist capable of producing the desired results, a recommendation was then
forwarded to the City Council for consideration.
In the past, artists have provided unsolicited art concepts for the Commission's
consideration for project sites that were not identified or approved by the City Council.
The artists were informed that when a project or project site was identified, they
would be contacted concerning the process.
At the October 12, 2000 Cultural Arts Commission meeting, the Commission reviewed
an unsolicited proposal by Mr. Cain to provide a series of art work along the Bear
Creek Trail. The Commission voted to have Mr. Cain present his concepts directly to
the City Council for consideration. In the past, artists have not presented their
concepts to the City Council for consideration without a recommendation from the
Commission.
The Commission may wish to reconsider the action of directing Mr. Cain to present his
ideas directly to the City Council. The Commission may wish to consider the following
items when discussing the proposal by Mr. Cain: the project site and proposal, the
appropriateness of the artwork at the site, Mr. Cain's ability to produce original
artwork and meeting the legal requirements for a City -sponsored project.

At the October 12, 2000 Cultural Arts Commission meeting, the Commission made the
recommendation that the Jefferson Street bridge railings be constructed with an artistic
component, similar to the Washington Street bridge railings. This recommendation was to
forwarded for City Council consideration.
The Jefferson Street Bridge Railing project was placed on the November 7, 2000 City Council
meeting for consideration (Attachment A). Staff will provide a verbal report of the actions
taken by the City Council at the November 7 meeting regarding this project.
As stated in the staff report for City Council consideration, should the City Council desire the
Jefferson Street Bridge railings be designed and constructed by Navarete Studios, concepts
for the bridge railings will be brought to the Cultural Arts Commission for review and
recommendation for City Council consideration.
ALTERNATIVES:
The alternatives available to the Commission are:
1 . Continue to support the Jefferson Street Bridge railing project and the Navarete
Studio to provide design concepts; or
2. Prgvide staff with alternate direction.

not to exceed $3,000 with Navarrete Studio to provide artistic bridge rail design for
the bridge over the All -American Canal.
FISCAL IMPLICATIONS:
The current available balance in the Arts in Public Places fund (Account No. 701-000-
300-290) is approximately $250,000. Before award of a contract, City staff will
request any necessary appropriation.
None.
On May 5, 1998, the City Council approved a contract with Juan and Patricia
Navarrete to design bridge railing enhancements for the Washington Street bridge. The
Navarrete's were commissioned to provide bridge rail enhancements, as depicted in
Attachment 1.
Jefferson Street is currently being reconstructed from Highway 1 1 1 to Avenue 54 as
Project No. 99-05. Included within the scope of this project is the reconstruction of
the bridge over the All -American Canal. Considering the recent success of Navarrete
Studio's design enhancements to the bridge rail on the Washington Street bridge over
the La Quinta Evacuation Channel, City Council directed staff to pursue a similar
treatment to the Jefferson Street bridge rail over the All -American Canal.

On October 12, 2000, Public Works staff presented the concept of enhancing the
bridge rail to be constructed over the All -American Canal on Jefferson Street to the
Cultural Arts Commission. The bridge rail design would be similar (but not the same)
as that designed for the Washington Street bridge. The Cultural Arts Commission was
unanimously in favor.
Should the City Council desire, a Request for Proposals (RFP) can be prepared and
approved. This process would take approximately four weeks to process and about
six weeks to advertise to allow artists to respond. The total amount of time needed
to complete the RFP process is fourteen to sixteen weeks (four months).
Due to the time constraint for the Jefferson Street project, an alternative to the formal
bidding process would be to negotiate directly with Navarrete Studios. According to
the City Council's approved bidding procedures, an informal bidding process may be
followed for contracts from $2,500 to $10,000. This direction would also be
consistent with providing a bridge rail design similar in concept to the bridge rail design
that was completed for the Washington Street bridge.
Should the City Council direct staff to negotiate directly with Navarrete Studios, once
the terms of the Agreement have been determined, City staff would present the
Agreement to City Council for consideration. Subsequently, when concepts were
submitted by the artist, they would be presented to the Cultural Arts Commission and
City Council for final approval prior to commencing fabrication.
The alternatives available to the City Council include:
1 . Authorize City staff to negotiate the terms of an Art Purchase Agreement in an
amount not to exceed $3,000 with Navarrete Studio to provide artistic bridge
rail design for the bridge over the All -American Canal; or
2. Authorize City staff to develop a Request for Proposals and advertise the project
for the Professional Selection Process of an artist to complete the design of an
artistic bridge rail consistent with the bridge rail on the Washington Street
bridge; or
3. Provide staff with alternative direction.
