SUBJECT: MINOR USE PERMIT 98-096
Dear Mrs. Moran:
On November 3, 1998, the City Council adopted Resolution 98-123 approving your request
to close portions of Avenida Bermudas between Calle Arroba and Calle Nogales and those
interconnecting streets to the west approximately 200 -feet for the Greater Coachella Valley
Soap Box Derby on April 10 and 11, 1999. Based on approval of the street closure by the
City Council, the Community Development Department approves MUP 98-096, subject to
the following conditions being completed by April 1, 1999:
Obtain a building permit for temporary structures and electric power prior to any
installation. The Building and Safety Department can be reached by calling 777-
7012.
2. The City, and its employees, shall be additionally insured for this event in the
minimum amount of $1,000,000.00. A copy of the Certificate of Insurance shall be
submitted to the Community Development Department.
3. Permits for temporary structures (e.g., tents exceeding 200 square feet and/or
canopies exceeding 400 square feet) shall be obtained prior to installation. If you
have any questions, the Fire Department personnel can be reached by calling 863-
8886 (Planning and Engineering). Fire lanes shall be established and/or maintained
during the special event.
4. Written notices shall be sent to property owners and occupants in the immediate
area notifying them of the special event and any special parking provisions. A copy
of the notice shall be submitted to the Community Development Department.
5. An encroachment permit shall be obtained from the Public Works Department to
close public streets and/or to place off-site signs in the City's rights-of-way.
6. The applicant is responsible for all traffic control measures and devices required by
the approved traffic control plan. Under the request of the applicant, the Public
Works Department will provide any or all of the measures and devices required by

this condition (traffic control plan, rental of traffic control devices and
setup/takedown of the devices) for fees previously established by City resolution.
Additional conditions are:
7. Temporary trash receptacles shall be provided so. that trash/debris can be deposited
accordingly. The site shall be left clean of any litter at the close of the event(s).
8. Permission to park vehicles on private property shall be obtained prior to the event
commencing.
9. Portable restrooms shall be provided to accommodate guests and volunteers.
Restroom facilities shall be accessible to the physically challenged.
10. The serving of food at the event shall be subject to the rules and requirements of
the Riverside County Health Department.
11. Before any cranes, forklifts, or other aerial equipment are raised, please check for
overhead wires. Please note that California Title 8, Electrical Safety Orders,
specifies the closest distance that unqualified electrical workers ,can get to
electrically energized conductors. Unqualified electrical workers can get no closer
than six (6) feet to Imperial Irrigation District distribution lines and no closer than ten
(10) feet to transmission lines. People operating boom type lifting or hoisting
equipment can get no closer than 10 feet to distribution lines and 17 feet to
transmission lines.
12. If ground excavation is required, please contact Underground Service Alert (USA)
at 1-800-227-2600 or 1-800-422-4133. The service is free of charge provided USA
is given at least two days' notice.
13. Portable generators, if used, shall be shielded to prevent accidental contact with
guests. Extension cords shall be secured to the ground to prevent tripping.
14. Noise created by the event shall not be physically annoying to adjacent property
owners.
15. A maximum of 30 directional signs, not exceeding nine square feet, are permitted,
subject to the provisions of Section 9.160.060 (Items C, D, and F through H). 'No
other temporary outdoor signs are permitted unless first approved by this
Department.
16. By holding the special event, the applicant agrees to indemnify, defend and hold
harmless the City of La Quinta in the event of any legal claim or litigation arising. out
of the City's approval of this project. The City of La Quinta shall have the right to
select its defense counsel in its sole discretion.
The City may elect to add Conditions to this application request to mitigate any problems
that arise not previously addressed herein.

The Special Projects Contingency Account (101-251-663-000) has $7,900 available
for Community Services Grants, contingent on prior City Council action, or the
General Fund Reserves Account (101-000-300-290) can be utilized.
BACKGROUND AND OVERVIEW:
The Greater Coachella Valley Soap Box Derby has requested and received Community
Service Grant assistance for the 1999 Soap Box Derby in the amount of $1,600 for
franchise fees. The Greater Coachella Valley Soap Box Derby is also requesting the
City provide funding for the In -Kind services in the amount of $3,308 for street closure
traffic control devices and public noticing of event (Attachment 1).
In the past, the City fees for the In -Kind Services in the amount of $2,450 have been
allocated from the AB939 account due to the recycling element being incorporated into
the event. This year, the organizers will not be including the recycling element in the
event, therefore the AB939 funds cannot be used.
The increase from the past years amount is due to the event being increased from one
to two days.

9.60.170 Special Outdoor Events.
A. Outdoor Events. Within residential districts, special outdoor events shall include, but are not
limited to pageants, fairs, carnivals and large athletic events, religious or entertainment events, block
parties, and large neighborhood or community gatherings in temporary outdoor facilities.
B. Standards. Special outdoor events are permitted in residential districts as indicated in Table 401
provided the following requirements are met:
1. Approval of a minor use permit shall be required for events to be attended by more than 50
people, including participants and spectators.
2. Regardless of the number of attendants, activities conducted on property owned by or. leased
to the city or on public rights-of-way may require an encroachment permit issued by the Public
Works Director.
3. The event may be permitted for a period not to exceed ten consecutive days. Events conducted
by a single permittee or group which occur more than twice in a calendar year are not
considered temporary and shall not be eligible for a minor use permit.
4. A cash bond or other guarantee for removal of the temporary use and cleanup and restoration
of the activity site within seven days of the activity conclusion may be required.
5. Applications for permits or certificates required by. Paragraphs A. and B. of this Section shall
be referred by the Community Development Department to other affected departments, cities
or public agencies as may be appropriate for review and comment.
6. Signs for the event shall be allowed as follows:

a. Maximum of one temporary banner per street frontage, not to exceed 32 sq. ft.
b. Maximum of one temporary portable sign on- or off-site on private property, not to exceed
55 sq. ft.
c. Maximum of 30 off-site temporary directional signs, 9 square feet in area, subject to the
provisions of Section 9.160.060, Paragraphs C through H with the exception of Paragraph
E.
d. Maximum 15 . bunting signs, with maximum size to be approved by the Director of
Community Development.
e. Posting period, locations, and related details shall be as approved in the temporary use
permit for the event.
f. Other signs and advertising devices, such as pennants, flags, and A -frame signs are
prohibited.
7. Related issues, including but not limited to police and security, food and water supply, use of
tents and canopies, fugitive dust control, sanitation facilities, medical services, noise, signage,
. fire protection and traffic control, shall be satisfactorily addressed by the applicant, as required
by the Director, Sheriff, Fire Chief or health officer in their administration of other city codes.
Such other codes may require the applicant to obtain permits such as building, electrical, health
and tent permits.
9.60.180 - Manufactured Housing and Mobilehomes
A. Purpose. This Section is intended to provide standards and criteria for the placement, design,

9.160:060 Permitted Temporary Signs.
A. Definition. "Temporary sign" means any non -illuminated sign which may require a sign permit
and which is intended to be posted for a maximum of 60 days. Temporary signs include without
. limitation: political campaign signs, garage sale signs, and seasonal sales signs.

B. Maximum Time Periods temporary sign . No tem or si shall be posted for more than 60 consecutive days
nor shall such temporary sign or sign displaying similar messages regarding the same event, if any,
which is the subject of such temporary sign be reported upon the same site, or any site which 'is visible
from the original site, within 90 days of the removal of the original temporary sign. In addition, all
temporary signs shall be removed within seven days after the occurrence of the event, if any, which is
the subject of the temporary sign. (For example, a temporary sign advertising a garage sale on a
particular date, or a temporary sign promoting a candidate in a particular election). The date of posting
and permit number shall be permanently and legibly marked on the lower right-hand corner of the face
of the sign.
C. Maximum Sign Area. Temporary signs placed on public property may not exceed six' square
feet in area and temporary signs placed on private property may not exceed 12 square feet in area. The
aggregate area of all temporary signs maintained on any private property parcel of real property in one
ownership may not exceed 24 square feet. Area shall be calculated on the basis of the entire sign area,
as defined in Section 9.160.03.0
D. Maximum Height. Free-standing temporary signs which are placed on public or private property
shall not exceed six feet in height. Temporary signs which are posted, attached or affixed to private
multiple -floor buildings shall not be placed higher than eight feet or the finish floor line of the second
signs which are posted, attached or affixed
floor of such buildings, whichever is less, and temporary
®to private single -floor buildings shall not be higher than the eaveline or top of wall of the building. All
heights shall be measured to the highest point of the surface of the sign.
E. Maximum Number. In no case shall the total number of temporary signs for any permit exceed
50.
F. Placement Restrictions. Temporary signs shall not be posted on sidewalk surfaces, mail boxes;
utility boxes, electric light or power or telephone wires, poles or appendages, hydrants, trees, shrubs,
tree stakes or guards, public bridges, obelisks, fences or walls, fire alarm or police telegraph systems,
drinking fountains, life buoys, life preservers, lifesaving equipment,. street signs, or. traffic signs or
signals. Temporary signs shall be posted no closer than five feet from the edge of the paved area of any
public road or street. Within the public right of way, temporary signs shall be placed no less than 200
feet apart from identical or substantially similar temporary signs and shall not be visible simultaneously
within the boundaries of the City. Temporary .signs shall not be posted in a manner which. obstructs the
visibility of traffic or street signs or signals or emergency equipment.
G. Sign Permit Required. Any person, business, campaign organization, or other entity who
proposes to post more than five temporary signs on private or public property shall make application
to the Community Development Department for a sign permit. To insure sign removal upon expiration
of the permitted posting time, a refundable deposit as established by City Council Resolution shall be
paid in conjunction with the issuance of the sign permit.
L1. Statement ojResponsibility Required. Each applicant for a temporary sign permit shall submit
to the Community Development Department a. statement of responsibility certifying a natural
person who will be responsible for removing each temporarysign for which a permit is issued
by the date removal is required, and who will reimburse the City for any costs incurred by the
City in removing each such sign which violates the provisions of this Section.

9.160: SIGNS
' 2. Standards for Approval.
a. Within ten business days of the Community Development Department's receipt of a
temporary sign permit application, the Community Development Director shall approve or
disapprove such application. If the Director disapproves an application, the .notice of
disapproval shall specify the reasons for disapproval. The Director shall approve or
disapprove any permit application for temporary signs based on character, location, and
design, including design elements such as materials, letter style, colors, sign type or shape,
and the provisions of this Section.
b. The Director's decision with respect to a permit application for a temporary sign may be
appealed to the Planning Commission.
H. Maintenance and Removal of Temporary Signs.
1. Maintenanc. All temporary signs shall be constantly maintained in a state of security, safety
and good repair.
2. Removal from Public Property. If the City determines that a temporary sign located on public
property is unsafe or insecure, is a menace to public safety or has been constructed, erected,
relocated or altered in violation of this Section, it may be removed summarily. If the sign
contains identification, the owner shall be notified that the sign may be recovered within five
days of the date of notice.
3. Removal from Private Property. If the City finds that a temporary sign located on private
property is unsafe or insecure, is a menace to public safety or has been constructed, erected,
relocated or altered in violation of this Section, the City shall give written notice to the owner
of the temporary sign, or the person who has claimed responsibility for the temporary sign
pursuant to Subsection F of this Section, that the temporary sign is in violation of this Section,
shall specify the nature of the violation, and shall direct the owner of the temporary sign or
responsible person to remove or alter such temporary sign. If the City cannot determine the
owner of the sign or person responsible therefor, he shall post such notice on or adjacent to
each temporary sign which is in violation. If the owner of the temporary sign or the person
responsible therefor fails to comply with the notice within five days after.such notice is given,
the temporary sign shall be deemed abandoned, and the City may cause such temporary sign
to be removed and the cost thereof shall be payable by the owner or person responsible for the
temporary sign to the City.
I. The placement of temporarysigns for existing commercial businesses during the construction
of any Department of Public Works contract over 45 -days in length, where the ingress and
egress points to a commercial establishment, have been interrupted, and further when the
construction/modification of the public street involves a distance of more than 3,000 feet in
length, the above regulations pertaining to temporary signs and the associated processing fees,
shall not be enforced for -the duration of the Department of Public Works street contract.
However, the placement of temporary signs must not interfere with site visibility for vehicular
movement.

BACKGROUND AND OVERVIEW:
The Greater Coachella Valley Soap Box Derby (GCVSBD) has applied for a street closure
on April 10 and 11, 1999, to hold their annual event on Avenida Bermudas between Calle
Arroba and Calle Nogales and those interconnecting streets to the west for a distance of
approximately 200 -feet (Attachments 1 and 2). The GCVSBD is requesting the race route
be closed between the hours of 5:00 A.M. and 7:00 P.M.
The City Council is authorized to allow temporary street closures by adoption of a
Resolution pursuant to Chapter 12.32 of the Municipal Code. The Public Works
Department will issue an Encroachment Permit and provide traffic safety measures which
could include traffic barricades, "No Parking" signs and other safety measures.
FINDINGS AND ALTERNATIVES:
Findings for Approval:
This temporary street closure is allowed based on Section 12.32.080(D) of the
Municipal Code which permits the City Council, by Resolution, to designate "No
Parking" areas by signing or applying red- paint to the street curbing. Since this
closure is temporary, signs will be used notifying people that the road is closed.

Additional conditions will be imposed as necessary to regulate vehicle traffic and
ensure pedestrian and participant safety.
2. This temporary street closure will have minor impacts on traffic in the surrounding
area since there are alternate routes available.and personnel will be present for
traffic control.
3. An Encroachment Permit can be granted by the City to allow activities on public
streets for specific periods if legitimate reasons can be found to allow the closure
and safety standards (Chapter 12.16 of the Municipal Code, Traffic Control
Devices) are provided such as traffic barricades and "No Parking" signs to ensure
that the public is not "at risk" during -the event.
4. Approval of the temporary street closure will not create conditions that may threaten
the public's health and safety needs of the community because specific conditions
will be imposed as a part of Minor Use Permit 98-096.
Alternatives available to the Council:
1. Approve the request to close portions of Avenida Bermudas and adjacent streets
along the race route on April 10 and 11, 1999.
2. Deny the request because it will negatively impact the area and create traffic
impacts.

WHEREAS, the Greater Coachella Valley Soap Box Derby has applied for
City Council approval to close portions of Avenida Bermudas between Calle Arroba and
Calle Nogales and those interconnecting streets to the west for a distance of
approximately 200 -feet for their special outdoor event on April 10 and 11, 1999; and
WHEREAS, the City Council on the 3'd day of November, 1998, reviewed and
heard public testimony on this request to temporarily close Avenida Bermudas between
Calle Arroba and Calle Nogales and those interconnecting streets to the west for a
distance of approximately 200 -feet between the hours of 5:00 A.M. and 7:00 P.M.; and
WHEREAS, the City Council finds the following facts and reasons to justify
approval of said temporary street closure:
The temporary street closure is allowed based on Chapter 12.32.080 (D) of the
Municipal Code which permits the City Council, by Resolution, to designate "no
parking" areas by signing or applying red paint to the.street curbing. The posting
of "no parking" signs.and. installation of traffic barricades in all areas necessary to
ensure traffic safety shall be completed as required by the Public Works
Department.
2. The temporary street closure will have minor impacts on the area because other
streets adjoining the site are available to provide access to the immediate
neighbors surrounding the race event. The affected property owners will be notified
of the upcoming event as required by Minor Use Permit 98-096.
3. The City Council can grant an encroachment permit to allow activities on public
streets for specific periods if legitimate reasons can be found to allow the closure

Quinta, California, as follows:
Section 1. That the above citations are true and correct and constitute the
findings and requirements of the City Council in this case.
Section 2. The City Council approves the closure of portions of Avenida
Bermudas between Calle Arroba and Calle Nogales and those interconnecting streets to
the west for a distance of approximately 200 -feet (Exhibit °A") from 5:00 A.M. to 7:00 P.M.
subject to conditions imposed by the Public Works and Community Development
Departments.
Section 3. The City Traffic Engineer, or his designee, can issue an
Encroachment Permit (Chapter 14.16 of the Municipal Code) to the Greater Coachella
Valley Soap Box Derby regulating the closure of the streets provided certain traffic control
standards and the Conditions of Approval for Minor Use Permit 98-096 are met.
Section 4. No parking signs will be posted (Chapters 12.16 and 12.32 of the
Municipal Code) as required by the Public Works Director. The Riverside County Sheriffs
Department will tow any unauthorized vehicle within this area at the time of the event.
Section 5. In case of bad weather, the City Manager is authorized to reschedule
the street closure. provided all conditions of approval under MUP 98-096 are met.
Section 6. A traffic control plan shall be submitted by the applicant and approved
by the Public Works Department. The Greater Coachella Valley Soap Box Derby
personnel shall obtain an Encroachment Permit from the Public Works Department prior
to closing the streets, and install all traffic safety signs and barricades prior to the closure
of said streets.
Section 7. Riverside County Sheriffs Department personnel will be on hand to
assist the applicant with on-site security and provide traffic control measures needed to
carry out the street closure permit.
Section 8. The City Council authorizes City staff or other assigned safety
personnel to close the event if at any time all safety standards are not being met, and thus
could jeopardize those persons attending the function; and

October 6, 1998
At your August 4, 1998 meeting you approved the Community Services Grant request from The
Greater Coachella Valley Soap Boa Derby, in the amount of $1,200.00. First, I want to thank the
staff and Council for their support of this great family event. On September 17, 1998, the All-
American Soap Boa Derby sent us a letter giving dates for the Akron, Ohio race for 1999, and to
inform us that they have raised their Franchise Fees (letter attached).
The reason for this letter is twofold. I am pleased and excited to announce that The Greater
Coachella Valley Soap Boa Derby has a new event sponsor, The Fox Kids Club. KDM the local
Fox Affiliate, has added Soap Box Derby as one of their primary Fox Kids Club activities. This new
Sponsorship will provide the publicity and funds to ship all winning cars to and from Akron, Ohio,
Airfare for the winner of each Division and one of their parents to Akron and hotel accomodations or
financial help with their expenses for the week they're there. As a result of this new Sponsorship,
Soap Box Derby will be adding the Masters Division (their request) and we will probably have to
expanding the event to two days.
Prior to the this, The Greater Coachella Valley Soap Box Derby was rapidly moving toward a two
day event, which will change our request from the City of La Quints Although the Fox Kids Club
will inject some needed dollars into our event, we are still in need of La Quinta's support.
I am requesting that you place on your next City ,Council Agenda, our request for the additional
$400.00 for the Franchise Fee increase and added Division and for the additional In -Kind donation
required for the street'closure for a two day event. We have preliminary scheduled the event for
April 10 & 11, 1999.
I look forward to .the support of and working with, the City on this expanded event. If you have any

Council Member Sniff voiced some concern about the low balance in the Special
Projects Contingency Fund, but supported the Friend's funding request. He felt
the need is there and that their request has been delayed long enough.
MOTION - It was moved by Council Members Sniff/Adolph to approve the
funding request by the Friends of the La Quinta Library in the amount of $3,700
from the Special Projects Contingency Fund.
Council Member Adolph supported granting the request because he felt the
Council had made a commitment to it some time ago.
Council Member Henderson felt the Council has always supported the Friends
and agreed that the funding level has been implied. However, she wished to
see the funding tied to the library expansion so that the Friends can better see
what is needed at that time.
Mayor Pena agreed and noted that the situation has not changed since the
October 20 meeting.
Council Member Sniff felt the funds should be granted rather than wait on the
County to respond.
Council concurred.

2. CONSIDERATION OF COMMUNITY SERVICES GRANT REQUEST BY THE
GREATER COACHELLA VALLEY SOAP BOX DERBY FOR IN-KIND SERVICES.
Ms. Horvitz, Community Services Director, advised that the proposed funding
request is for in-kind services totaling $3,308 for street closures and noticing
of the Greater Coachella Valley Soap Box Derby to be held next spring.
In response to Mayor Pena, Ms. Horvitz advised that the response last year to
the recycling component wasn't as good as expected and would not be included
in this year's event, and that's why the AB939 Fund isn't being used.
Council Member Sniff supported the request.

2. CONTINUED CONSIDERATION OF THE COMMUNITY SERVICES COMMISSION
1998/99 WORK PLAN.
Ms. Horvitz, Community Services Director, advised that the Community
Services Commission 1998/99 Work Plan has been revised as requested by
Council and the Commission has made no further recommendations.
Council Member Sniff suggested that "ADA compliance" under Step #5 on Page
20 be eliminated.
Council Member Henderson suggested that "kits" in Step #3 be eliminated as
well.
Council concurred with both changes.
MOTION - It was moved by Council Members Sniff/Henderson to approve the
Community Services Commission 1998/99 Work Plan as modified (from the
category "Safety" removing the word "kits" and the last bullet point to read
"Promote safe facilities"). Motion carried unanimously. MINUTE ORDER NO.

3. CONSIDERATION OF COMMUNITY SERVICES GRANT REQUEST FROM THE
GREATER COACHELLA VALLEY SOAP BOX DERBY.
Ms. Horvitz, Community Services Director, advised that the Greater Coachella
Valley Soap Box Derby has submitted a proposed funding request for $400 from
the Community Services Grant Program to cover increased costs in the
franchise fee to extend the event to two days. She advised that the request is
in addition to the $1,200 granted in August.
Lucia Moran, P. 0. Box 1305, Race Director for the Greater Coachella Valley
Soap Box Derby, reiterated her comments made at the last meeting regarding
the Fox Kids Club sponsorship and advised that the additional funding is needed
for the franchise fee increase and the addition of a new division. They expect
an increase in participation and plan to expand the event to two days in order
to handle it. She noted that in-kind services for the street closure was not
included in the staff report and asked that it be agendized for the next meeting,
along with a request for an additional day for the street closure.
Council Member Adolph asked if any of the other valley cities have offered to
help fund the event.

Ms. Moran advised that one year they received $500 from Rancho Mirage; and
Desert Hot Springs, which sponsored 16 cars the first year, is very active each
year in soliciting donations for the event. She would like to see every city
sponsor a soap box. She noted that they would, also need to expand the hours
for the street closure in order to get setup earlier in the morning.
In response to Council Member Henderson, Ms. Moran advised that they are
looking to possibly move the finish ,line.to correspond with the sidewalk being
adjacent to the street so as to protect the new landscaping.

4. CONSIDERATION OF FUNDING REQUEST FROM FRIENDS OF THE LA QUINTA
LIBRARY.
Mr. Wilson, Management Assistant, advised that the Friends of the La Quinta
Library have requested a status report on their funding request for $3,700 for
Internet hook-up and to purchase library books. In November. 1997, Council
directed that the funding be held in reserve due to the uncertainty of the library
situation. In August 1998, an MOU was signed with the County, wherein the
County was required to spend $15,000 for library books, in addition to the
$5,000 spent under the previous MOU. The County has indicated that they are
in lease negotiations for the existing library space and the expanded area; and
arein' the - process of . designing 'the expanded .area and preparing for
construction. Staff has asked the County for more detailed information about
the one-time cost and for a time table for completion of the project. The
County's recent correspondence indicates that they have ordered approximately
$15,000 worth of library books and will be delivering detailed plans to the City
for the expansion by October 27. Once the expansion details are final, the
County will be able to provide a time table for completion.
In response to Council Member Henderson, Mr. Wilson advised that it's unclear
at this time what computer systems will be accessing through this improvement
until -a list is received .from the County. The library currently does not have
Internet access.

Dear Mayor Peiia:
At your August 4, 1998 meeting you approved the Community Services Grant request from The
Greater Coachella Valley Soap Bog Derby, in the amount of $1,200.00. First, I want to thank. the
staff and Council for their support of this great family event. On September 17, 1998, the All-
American Soap Bog Derby sent us a letter giving dates for the Akron, Ohio race for 1999, and to
inform us that they have raised their Franchise Fees (letter attached).
The reason for this letter is twofold. I am pleased and excited to announce that The Greater
Coachella Valley Soap Bog Derby has a new event sponsor, The Fog Kids Club. KDFX, the local
Fog Affiliate, has added Soap Bog Derby as one of their primary Fog Kids Club activities. This new
Sponsorship will provide the publicity and funds to ship all winning cars to and from Akron, Ohio,
Airfare for the winner of each Division and one of their parents to Akron and hotel accomodations or
financial help with their expenses for the week they're there. As a result of this new Sponsorship,
Soap Box Derby will be adding the Masters Division (their request) and we will probably have to
expanding the event to two days.
Prior to the this, The Greater Coachella Valley Soap Bog Derby was rapidly moving toward a two
day event, which will change our request from the City of La Quinta. Although the Fox Kids Club
will inject some needed dollars into our event, we are still in need of La Quinta's support.
I am requesting that you place on your next City Council Agenda, our request for the additional
$400.00 for the Franchise Fee increase and added Division and for the additional In -Kind donation
required for the street closure for a two day event. We have &ehminary scheduled the event for
April 10 & 11, 1999.
I look forward to the support of and working with, the City on this expanded event. If you have any
questions prior to the City Council meeting, please give me a call at 347-1412.

BACKGROUND AND OVERVIEW:
The La Quinta Chamber of Commerce has applied for a street closure on November 15,
1998, to hold their 13th Annual 5K/10K Run, Two -Mile Walk and Kids Fun Run
beginning at'the Civic Center, proceeding south along Washington Street to 52nd
Avenue, east on 52nd Avenue to the turnaround point and returning (Attachment 1).
The kid's run will be held entirely on Washington Street. The event has been held at
the La Quinta Civic Center for the last five years. The Temporary Use Permit (TUP 98-
184) for this event is being processed. The event has been held in the past without
any problems.
The Civic Center parking lot, south of City Hall, will be used for the registration,
refreshments, and awards ceremony. The races and walk will begin on Washington
Street adjacent to the parking lot.

The Chamber of Commerce is requesting the race route be closed between the hours
of 7:00 A.M. and 10:30 A.M. (Attachment 2). This closure would affect Washington
Street between Calle Tampico and 52nd Avenue, and 52nd Avenue between
Washington Street and the eastern City limits past Madison Street. Cross traffic on
Jefferson Street will be allowed to pass as runners traffic permits.
The City Council is .authorized to allow temporary street closures by adoption of a
Resolution pursuant to Section 12.32.0880 (d) of the Municipal Code. The Public
Works Department will issue an Encroachment Permit and provide traffic safety
measures which could include traffic barricades, "No Parking" signs -and other safety
measures.
This proposed temporary closure has been reviewed by all applicable City departments,
including the Sheriff's Department and Fire Department. To date, none have objected
to the closure. The applicants are working with the Sheriff's Department to hire
deputies for traffic control.
FINDINGS AND ALTERNATIVES:
Findings for Agproval:
1. This temporary street closure is allowed based on Section 12.32.080(d) of the
Municipal Code which permits the City Council, by Resolution, to designate "No
Parking" areas by signing or applying red paint to the street curbing. Since this
closure is temporary, signs will be used notifying people that the road is closed.
Additional conditions will be imposed as necessary to regulate vehicle traffic
and ensure pedestrian and participant safety.
2. This temporary street closure will have minor impacts on traffic in the
surrounding area since there are alternate routes available and Sheriff's
Department personnel will be present for traffic control.
3. An Encroachment Permit can be granted by the City to allow activities on public
streets for specific periods if legitimate reasons can be found to allow the
closure and safety standards (Chapter 12.16 of the Municipal Code, Traffic
Control Devices) are provided such as traffic barricades and "No Parking" signs
to ensure that the public is not "at risk" during the event.
4. Approval of the temporary street closure will not create conditions that may
threaten the public's health and safety needs of the community because specific
conditions will be imposed as a part of TUP 98-184.
5. This temporary street closure which includes use of the Civic Center parking lot
for the start and finish of the race has been held for the last five years and
created no impacts.

WHEREAS, pursuant to Chapter 9.100.140 (Temporary Outdoor Events)

3. The City Traffic Engineer, or his designee, can issue an Encroachment Permit
(Chapter 14.16 of the Municipal Code) to the La Quinta Chamber of Commerce
regulating the closure of the street provided certain traffic control standards and
the Conditions of Approval for Temporary Use Permit 98-184 are met.
4. The City Council authorizes City staff or other assigned safety personnel, to
close the event if at any time all safety standards are not being met, and thus
could jeopardize those persons attending the function; and,
5. The City Clerk shall cause this Resolution to be posted within 72 -hours after its
adoption in four (4) public places. Those places shall be: City Hall in both the
indoor and outdoor display cases, the La Quinta Post Office and the case
located outside of the Albertsons store in the One Eleven La Quinta Shopping
Center.

KIDS 1 K FUN RUN- ROAD CLOSURE REQUESTS
Dear Stan:
The La Quinta Chamber of Commerce would like to request the appropriate road
closures for our upcoming 1 K -5K -10K Run/2 Mile Walk and Kid's Fun Run, scheduled
for Sunday, November 15, 1998. This year's event will be a duplication of last year's
event.
Participants will once again start at 8:00 a.m. from the Civic Center going southbound
on Washington to Avenue 52. They will then proceed east bound on 52 to the turn-
around point (before Monroe) and return to the Civic Center via the same route. The
last runner/walkers are normally finished no later than 10:30 a.m. We would .
recommend that the road closure be in effect from 7:00 a.m. to 10:30 a.m.
There are a number of awards given out in a ceremony directly following the runtwalk.
This ceremony takes place outside the Civic Center and usually concludes by 11:00
a.m.
Enclosed please find a copy of last years run -route maps and detailed drawings of
necessary road closures. These maps were developed by the City's engineering
department. I hope that this information will be sufficient. We are also planning on

Mr. Genovese, City Manager, recommended that the marketing consultant
interviews, which were originally scheduled for October 27, be rescheduled for

1. DISCUSSION OF JOINT CITY/CHAMBER WORKSHOP ON THE DEVELOPMENT
PERMITTING PROCESS.
Council Member Henderson suggested the possibility of holding an annual
workshop for staff to briefly review the permitting process for local businesses.
Council concurred on referring it to staff for a report and recommendation.

PUBLIC HEARINGS
1. TRACT 28470 — CONSIDERATION OF REVISION TO CONDITION NO. 52 TO
DELAY COMPLETION OF THE PERIMETER WALL ALONG THE NORTH AND
NORTHWEST PROPERTY LINES OF A TRIANGULAR PARCEL WITHIN THE
TRADITION CLUB BY THE TIME OF ISSUANCE OF A CERTIFICATE OF
OCCUPANCY FOR THE 10TH CUSTOM HOME. APPLICANT: WINCHESTER
DEVELOPMENT.
Mayor Pena abstained due to a conflict of interest and left the dais.
The Mayor Pro Tem declared the PUBLIC HEARING OPEN.
Mr. Herman, Community Development Director, advised that the applicant is
requesting a modification to Condition No. 52 for Tract 28470, which deals
with the construction timing of the perimeter wall along the north side of
Avenue 52, adjacent to Avenida Nuestra. Under the current condition, the wall
is required to be in place prior to the issuance of a Certificate of Occupancy for
the 20th home. The requirement for a wall on the north side is part of a
mitigation to the relocation of Avenue 52 (Street Vacation 85-005 A & B and
Specific Plan 85-005 A & B). The Planning Commission has reviewed the
applicant's request and has recommended that the wall be required to be in
place prior to final inspection of the 10th home,. However, it was unclear as to
whether or not the modification dealt with the triangular piece east of Desert
Club and north of Avenue 52, or the entire wall. The applicant has indicated
that it was for the entire wall, but the discussion at the Planning Commission
was generally on the triangular piece. Staff recommended that Condition No.
52(B) be changed to read, "Prior to final inspection for the tenth residential
unit......." and that 52(B)(4) be deleted, which will delay construction of the
entire wall on the north side and require its total completion prior to final
inspection of the 10th residential unit.
In response to Council Member Adolph, Mr. Herman advised that the Planning
Commission did consider setting a date for the wall to be completed, but felt
the condition would be easier to enforce this way. There is no specific date for
completion of the landscaping along the wall. I \
