A. Actions which cannot mitigate fugitive dust emissions because all potential mitigations would, as
determined by the director, conflict with the federal or State Endangered Species Act or with city statutes
or ordinances as they pertain to weed abatement or fire hazard control;
B. Agricultural operations including growing, harvesting, tilling, cultivating, or the raising of animals,
fowl, or bees; excluding unpaved roads associated with such operations;
C. Any construction and/or demolition activity which does not require issuance of a separate grading
permit or a demolition permit (e.g., single-family homes on individual lots);
D. Any construction and/or demolition activity meeting any of the following activity levels or requirements:
1. Occurring entirely within an enclosed structure from which no visible airborne particulate matter escapes,
2. Modifications or additions to existing detached single-family residential dwellings,
E. Unpaved roads with an average daily traffic (ADT) volume of less than twenty vehicles, as determined
by the city;
F. Unpaved roads used for activities lasting three consecutive days or less; and five cumulative days
or less within a calendar month, provided that vehicle activity never exceeds one hundred vehicles per day.

by Chapter 9.160 of the city land use ordinance, provided that said use does not generate more than six thousand

6.16.040 Subject activities and uses.
A. Construction or Demolition Activities.
1. A person applying for a grading or demolition permit shall not conduct any operations unless he or
she has first obtained an approved fugitive dust (PM10) mitigation plan (hereinafter "plan") or has received
an exemption from the planning director.
2. A proposed plan shall be submitted to the director concurrent with the grading or demolition permit
application. A grading or demolition permit shall not be issued unless a proposed plan has been submitted
and subsequently approved.
3. A person with an approved plan shall comply with all of the requirements of the plan as of the approval
date.
4. A person seeking any amendment to an approved grading or demolition permit shall also resubmit
the plan for review and possible amendment by the director.
5. A person possessing an approved plan may submit a proposed amended plan at any time for review
by the director. The activity will continue to be subject to the requirements of the approved plan until such
time that an amended plan is approved by the director.
6. A person possessing a grading or demolition permit approved prior to adoption of this chapter must
submit a plan six months after the effective date,of the ordinance codified in this chapter, unless all permitted
activity has been completed.
B. Existing Open Areas or Staging Areas, and Public or Private Unpaved Roads.
1. The owner of any existing unpaved roadway with average daily traffic (ADT) volumes between twenty
and one hundred fifty vehicles determined by the city shall undertake any feasible measures to reduce vehicular
speeds to fifteen miles per hour or less. Such measures may include, but shall not be limited to; posting advisory
speed limit signs or installation of speed control devices in accordance with city procedures and/or standards.
2. The owner of any existing open area or staging area(s), or, public or private unpaved road(s) with
ADT volumes greater than one hundred fifty vehicles shall submit to the director a proposed plan no later
than six months after the effective date of the ordinance codified in this chapter.
3. The owner of any existing open areas or staging area(s), or, public or private unpaved road (s) having
ADT volumes greater than one hundred vehicles which have received approval of a plan must comply with
all of the. requirements. of the plan within sixty -days after approval date of the plan.
4. The owner of any existing open areas or staging area(s), or public or private unpaved road (s) having
ADT volumes greater than one hundred fifty vehicles which have received a denial of a plan must, within

CONDITIONS FOR FDCP APPLICATION 2000-87:

1. Applicant shall comply with all control measures as set forth in the approved FDCP
2000-87 application, and the following conditional measures.
2.. The full amount of any security required for the approved FDCP (form and amount to
be determined by Public Works) shall be available to the City for any measure(s)
deemed necessary by the City to achieve adequate dust control, whether or not such
additional measures are included by the applicant for this application.
3. Applicant shall submit copies of all records/invoices related to cost accounting for the
dust control measures assumed during earthwork. Said records shall be submitted
within 30 days after completion of all dust control measures as outlined in the plan,
including any measures made part of the plan as a condition to its approval. Security
may be withheld pending submittal of this information. All such invoices shall be
provided along with a completed PM 10 Program Report Form, which can be obtained
from the Public Works or Community Development Departments. Applicant shall have
completed all dust control measures prior to release of any posted security.
4. All proposed fencing shall be maintained indefinitely, pending dismantling, development
or other disturbance of the site's interior. No vehicular traffic of any kind shall be.
permitted on unpaved right-of-way areas along the site perimeter, or any previously
stabilized or other inactive soil areas. All disturbed areas shall be stabilized once
erection of fencing has been completed.
5. Any area(s) disturbed within the site shall be watered daily until an appropriate
chemical binder, as approved by the California Water Quality Control Board, Region 7,
has been applied. All disturbed area where no construction will occur shall be
compacted and stabilized within 48 hours to preclude blowing dust being entrained
from the site area disturbed as part of this fencing permit.
6. The contractor/vendor responsible for provision of soil stabilization shall submit the
appropriate Material Safety Data Sheet(s), along with approval from the Water Quality
Control Board, to the Public Works Department prior to any site application. Application
of stabilizing .agents must be in compliance with NPDES and the. state Water Quality
Control Board requirements.
7. Approval of this dust. control. plan does not constitute or otherwise authorize any site
disturbance, preparation or construction. The applicant is required to obtain. .the
necessary permits and clearances pertaining to the site, including approval of MUP
2000-206. This includes any type of testing, monitoring or sampling required as a
condition of development approval, such as that conducted for archaeologic; hydrologic
and geologic reporting purposes.

Dear Developer/Builder: .
The Coachella Valley PM 10 Program has been in its implementation phase since December, 1992.
Among the required control measures was the enactment by Valley cities of dust control ordinances
which require builders to implement dust control actions during construction, demo litibn and paving
activities. In conjunction with City staff members, we ask your help with the reporting requirements.
A significant aspect of the PM 10 Program is the need to report statistical information to the Federal
Environmental Protection Agency via the South Coast AQMD and the State of California Air Resources
Board. In response to this requirement, a Dust Control Reporting Form has been created, a copy of
which is attached. It is requested that if any project developers have amounts to report for any PM 10
mitigation, these forms must be filled out. This form is -intended to supplement Attachment "B" of the
Fugitive Dust Control Plan by providing specific cost figures. related only to dust control measures.
The South Coast AQMD has requested that the retroactive operative date be January 1, 1993, for.
reporting purposes. This means that each jurisdiction is requested to review projects since that date
where PM 10 control measure expenses have been incurred by developers, whether or not they, have
been incorporated as part of a Dust Control Plan, and forward this data to CVAG as soon as practical.
Your cooperation in completing these forms -as --part -of the grading -permit procedure will help assure
that the Coachella Valley and the development community as a whole receive deserved credit for the
effort to attain Clean Air Act standards for PM 10.
