The Community Development ,has approved your request to install a temporary
communication facility at the CVWD well site (#5712) within the One Eleven -La Quinta
Shopping Center pursuant to the provisions of Section 9.100.070 of the Zoning Ordinance,
subject to the following conditions being met:
1. A building permit shall be obtained.
2. The mobile communication facility shall be removed by September 14, 2002, unless
an extension is granted by the Community Development Director.
3. Two mature Date Palm trees, measuring 25' and 35' tall, shall be installed adjacent
to proposed communication antenna to mitigate its visibility from Highway 111, a
Primary Image Corridor. The palm trees must be planted in the ground and shall
be irrigated by a permanent water source ensuring a healthy appearance.
4. The applicant and property owner(s) agree to indemnify, defend and hold harmless
the City of La Quinta in the event of any legal claim or litigation arising out of the
City's approval of this project. The City of La Quinta shall have the right to select
its defense counsel in its sole discretion.
5. The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.
