The Community Development Department hereby approves your application request
for a fence approximately 2,800 feet long and six feet high at the northwest corner
of Eisenhower Drive and Avenida Fernando, subject to the following conditions:
1. The permit is valid for one year, expiring on February 1, 2002. A time
extension can be granted for an additional year pursuant to Section 9.200.080
of the LQMC.
2. Lighting of the site is not permitted under this permit.
3. Chain link fencing will be installed having a maximum height of six feet. A
colored mesh screening material shall be installed on the entire length of the
fencing. Barbed wire, razor wire or similar materials in or on the fence is
prohibited per Section 9.100.030 of the LQMC. The fence cannot be installed
in the street right-of-way.
4. The applicant will indemnify, defend and hold harmless the City of La Quinta in
case of any legal claim or litigation arising out of the City's approval of this
project. The City of La Quinta will have the right to select its defense counsel .
at its sole discretion.
The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.

This decision may be appealed to the Planning Commission. The appeal form can be
obtained from this Department. The appeal form must be completed and filled with
the required processing fee within 15 calendar days from the date of this letter.

SUBJECT: EXPIRATION OF MINOR USE PERMIT 2001-266 (NORTHWEST
CORNER OF EISENHOWER DRIVE AND AVENIDA FERNANDO)
Dear Mr. Robbins:
The Community Development Department on February 1, 2001, approved a Minor
Use Permit for KSL to install a 2,800 foot long temporary chain link construction
fence around your property generally located at the northwest corner of Eisenhower
Drive and Avenida Fernando (see attachment). The approval expired on February 1,
2002, with no time extension approved. Since no project has been approved for this
property, the fence must be removed. Within 30 days please provide us with proof
the fence will be removed within a maximum 60 days from the date of this letter.
