Staff is in receipt of your letter dated December 19, 2001, requesting an amendment
to the above -noted permit. In reviewing your request, it is staff's determination that
this amendment to MUP 2001-319 to allow increasing a model home site for lots 2-4
to include Lots 5-12 of Tract 30125-1 can be approved. Therefore, let this letter
serve as your approval for your request contingent upon the original Conditions of
Approval as follows:
1. Mounted on the exterior of the sales office door shall be a written notice
providing emergency personnel your 24-hour emergency phone number they can
call in case problems arise that need your prompt attention(i.e., minimum 1 "
high letters).
2. Install one 2A10BC fire extinguisher inside the sales office and each model.
3. A cash deposit, in the amount of $1,000.00, shall be posted with the City to
insure the garage conversions to model/sales office are removed within 90 days
after the expiration of this permit.
4. No temporary signs or flags are permitted unless separately approved by this
Department. The following advertising, devices or activities are expressly
prohibited within or outside the project: banners, balloons, portable trailer signs,
or human indicators. Permanent identification signs for the project shall be
approved by the Planning Commission.
5. The final landscaping and- irrigation plan for the model complex shall be
submitted for review and approval to this Department prior to occupancy. All
landscaping and irrigation improvements shall be installed prior to use of the
model complex. Perimeter walls and gates shall be included with this submittal. ��
6. The installation of trap fencing and parking lot improvements will require review
and approval by the Public Works Department. The parking lot design and
improvements shall comply with Chapter 9.150 (Parking) of the Municipal Code.-

7. The physically challenged parking space shall comply with the Americans with
Disabilities Act ,provisions which require hard surfacing with striping and signs.

9. The model complex is permitted to remain until November 28, 2002. Prior to
expiration of the permit, a six-month time extension request may be made in
writing to the Community Development Department. The Community

model complex for another six-month period.
10. The City may elect to add conditions to this application request to mitigate any
problems that arise not previously addressed herein.
11. The applicant will indemnify, defend and hold harmless the City of La Quinta in
case of any legal claim or litigation arising out of the City's approval of this
project. The City of La Quinta will have the right to select its defense counsel
at its sole discretion.

ThIe Community Development Department hereby approves your request to establish a
model home site on Lots 2, 3, and 4, with a parking area on Lot 1 of Tract 30125 pursuant
to Section 9.60.250 of the Municipal Code, subject to the following conditions:
1. Mounted on the exterior of the sales office door shall be a written notice providing
