Model Homes and Sales Center on Lots 8 - 13, TR 24197 (Monticello)
Gentlemen:
It has come to our attention, based on Building and Safety Department records and provisions
of Municipal Code Section 9.60.250, that the above use will need to be abandoned. This
determination is made pursuant to the following findings:
It is our understanding that the Monticello facilities are being used in marketing Century
product lines in tracts located outside our City limits, specifically in the City of Indio.
Section 9.60.250.A.2 of the Zoning Code (excerpt enclosed) prohibits any model home
or temporary sales office use which is not part of the project for which the use is
established.
2. Section 9.60.250.A.1 further prohibits model home or temporary sales office uses
unless used solely for the original sale of new homes in projects of 20 units or more.
As there are currently only two remaining lots awaiting permits in the Monticello
project, the use must be terminated under this requirement.
3. Approval for this use has expired as of June 6, 2002, with no extension request having
been filed prior to that date.

SUBJECT: Minor Use Permit 2001-286 Amendment #1 (Model Complex for
Monticello)
Dear Ms. Butler,
The Community Development Department has approved your amendment request
for eight subdivision flags and a design center on Lot 11 of Tract 24197 on
Dandelion Drive, west of Monticello Drive per the attached plan, subject to the
following conditions:
1. All prior conditions for the Minor Use Permit 2001-286 (see attached) shall
be met.
2. A building permit shall be obtained for all structural changes to the garage on
Lot 11 to provide the design center.
3. The eight subdivision flag locations are approved as shown on attached plan.
The flags shall comply with the following standards:
A. The flag poles shall be a maximum 20 feet in height.
B. Flags shall be a maximum 18 square feet in size.
C. Flag colors may vary, with no flourescent colors allowed.
D. Commercial or advertising copy on the flags is prohibited.
4. Flags are approved until February 23, 2001. A six month time extension may
be requested in writing prior to the expiration.
This decision may be appealed to the Planning Commission provided the required
forms and filing fee of $175.00 are filed with this office within 15 days of this
decision.

SUBJECT: Minor Use Permit 2001-286 (Model Complex for Monticello)
Dear Ms. Butler,
The Community Development Department has approved your request for a model
complex with parking lot on Lots 8-13 (parking lot on Lot 13) of Tract 24197 on
Dandelion Drive, west of Monticello Drive per the attached plan, subject to the
following conditions:
1. Prior to issuance of a building permit for any temporary garage conversion to
a sales office, a Certificate of Deposit, Letter of Credit, or cash deposit in the
amount of $1,500.00 shall be posted with the City to insure the conversion
back to a garage for residential uses and removal of trap fencing and parking
lot prior to their sale. The City shall be named as the controlling party to
insure compliance. The deposit, etc. will be refunded or released when all
model improvements have been removed and house improvements
completed.
2. Mounted close to the exterior of the front door of the sales facility shall be
a written notice informing emergency personnel of your 24- hour emergency
phone numbers in case of problems, in minimum 1" high letters.
3. Install one 2A10BC fire extinguisher inside each garage conversion area by
the exit door and provide a door to remain open during business hours" sign
above the exit door. If you have questions, please contact Fire Safety
Specialist for Riverside County at (760) 863-8886.
4. This approval shall be valid for a maximum one year time period from date of
approval. Upon request, a time extension of up to one year may be approved
by the Community Development Director.
5. Subdivision signs and Model home flags are not approved as a part of this
request. On-site signs and flags must comply with Zoning Code Section
9.60.250 (B & C), respectively and approved by the Community Development
Department prior to fabrication and installation.

6. Final plans for landscaping and irrigation improvements, including trap
fencing, etc. shall be submitted for Community Department approval prior to
installation. Improvements shall be installed prior to the use of the model
complex.
7. The plans for installation of trap fencing and parking lot improvements shall
be reviewed and approved by the Public Works Department prior to their
installation. Parking space size, aisles, etc., shall comply with Zoning Code
Section 9.150.080.
8. The City may elect to add conditions to this application to mitigate any
problems that arise not previously addressed herein.
9. Contact this Department when all model complex improvements have been
installed to determine compliance with all conditions of approval.
10. The plans for Lot 12 appear to show an expanded garage for the sales office.
Final working plans and precise grading plan for said expansion shall be
approved by the Community Development Department. Setbacks shall be in
compliance with the RL zoning requirements.
11. The use of the trap fence across Dandelion Drive is approved for the original
one year period. Should an extension of time be requested, the City may
require that the trap fence be removed from the street to allow traffic use of
the street.
This decision may be appealed to the Planning Commission provided the required
forms and filing fee of $175.00 are filed with this office within 15 days of this
decision.

We will be permitting the last two lots this week in the Monticello project. We will need
six months to construct them as well as selling the 4 models that are presently in the

We can open the street, allowing Dandelion to be a through street while we are
constructing the last two homes on that street.

9.60: SUPPLEMENTAL RESIDENTUL REGULATIONS
E. Landscaping Standards. A landscape plan shall be prepared and implemented for all affected _
projects. Perimeter and common open area landscaping shall be installed and maintained in accordance
with the following standards:.
1. Height of landscaping along all streets and boundaries shall comply with Section 9.60.030
(Fences and Walls).
2. All landscaped areas shall be separated .from adjacent parking or vehicular areas by a curb or
other barrier at least six inches higher than the parking or vehicular area to prevent vehicular
damage to the landscaped area.
3. All landscaping shall be maintained in a neat, clean and healthy condition, including proper
pruning, mowing of lawns, weeding, removal of litter, fertilizing, replacement of plants when
necessary, and regular watering. Permanent automatic irrigation facilities shall be provided for
all landscaped areas.
F. Perimeter setback and parkway areas shall have undulating terrain. Seventy-five percent of the
longitudinal length adjacent to the street shall have above curb level berms and mounds exceeding two
feet, but not more than three feet. The berms and mounds shall be undulated and tluctuating in. position
to accommodate _ the meandering sidewalk and shall cover not less than sixty five percent of the
landscape setback area. No retention of storm waters -is allowed within the setback area other than
incidental stormwater that falls on the setback. The maximum slope -steepness shall not exceed 4:1
anywhere in the landscape setback area, and shall not exceed 8:1 in the first six feet adjacent to the curb
in the right of way..
9.60.250 Model Home Complexes.
A. Model Home Complex and Sales Offices. Temporary model home complexes, real estate sales
offices and related signage may be established if a minor use permit is approved in accordance with
Section 9.210.020 and the following requirements are satisfied:
1. The complex is used :solely for the original sale of new, homes or the. first rental of apartments
in projects of 20 or more units.
_ 2. The complex is located within the area of -the project for which it is established. The temporary
sales office shall not be located within 100 feet of an. existing dwelling unit which is not a part
of the new project..
3. Notwithstanding other provisions of this Code, the.parcel of land on which a temporary real
estate office is established is not required to be a building site provided the parcel is precisely
-described.
4. The following structures and. facilities are permitted in conjunction with the establishment of
a temporary real estate office in conformance with. an approved minor use permit;
