SUBJECT: MINOR USE PERMIT 2001-325
Dear Ms. Shute:
The Community Development Department approves your request to have a 16 minute
fireworks show on New Year's Eve for club members and guests, pursuant to Section
9.60.170 (Special Outdoor Events) of the Zoning Ordinance, based on the following
findings:
A. The shooting of fireworks for a private party will be done on the golf driving
range and conducted by a licensed company in pyrotechnics. Therefore, no
problems are anticipated which would be detrimental to the community based
on the recommended conditions. A similar fireworks display was allowed last
year and no problems were observed.
B. This project is categorically exempt under Section 15304 (Class 4(e)) of the
California Environmental Quality Act (CEQA) because the outdoor event is being
conducted on an existing golf course driving range and no permanent
environmental impacts were identified.
C. Provisions are being made to ensure that surrounding property owners will not
be adversely affected by this special event as required by the Fire Department.
The following Conditions of Approval shall be completed one week prior to the event:
1 . Obtain a permit from the Riverside County Fire Department. If you have any
questions, the Riverside County Fire Department personnel can be reached by
calling 863-8886 (i.e., Planning and Engineering).
2. All property owners within 500 feet of the Citrus Resort and Club shall be
mailed a notice informing them of the special event. A copy of the notice shall
be given to the Community Development Department.
MUP 325-53/ss
Additional Conditions of Approval are:
3. The fireworks vendor shall obtain a City Business License.
4. Vehicles containing explosive materials shall not be parked within 500 feet of
an existing single family house. For security reasons, vehicles containing
explosive material shall not be left unattended.
5. The site shall be left clean of any litter and/or fireworks display materials.
6. If ground excavation is required, please contact Underground Service Alert
(USA) at 1-800-227-2600 or 1-800-4.22-4133. The service is free of charge
provided USA is given at least two days' notice.
7. The applicant agrees to indemnify, defend and hold harmless the City of La
Quinta in the event of any legal claim or litigation arising out of the City's
approval of this special event. The City of La Quinta shall have the right to
select its defense counsel in its sole discretion.
This Department has submitted paperwork to the Finance Department to refund
$25.00 of your filing fee due to overpayment.
If you have any questions, please contact me at 760-777-7067.
Sincerely,
JE )Y MAN
