SUBJECT: MINOR USE PERMIT 2002-350 FOR SDP 98-634, AMENDMENT #2
REF: MUP 2001-300, EXISTING MODEL HOME SALES COMPLEX
Dear Ms. Hesse:
This is to report that the Community Development Department has approved your
request to have a temporary sales office and parking lot on 'Lots 24 and 25 of Tract
28838-4 on Legends. Way in PGA West, subject to the following Conditions:
1 . A check in the amount of $1,000.00 shall be posted with the City to insure the
temporary improvements are removed when the model home/office is converted
to a single family house for sale to a private party.
2. The model home sales office and accessory parking lot.can remain on-site until
June 13, 2003, unless an extension of time is granted by this Department. A
request for a time extension shall be made in writing in May 2003. The
Community Development Director may, after reviewing the facts, extend the
use of the model home and parking area for another six-month period.
3. Use of the sales office shall be limited to the .hours of construction as listed in
the La Quinta Municipal Code (Chapter 6.08, Nuisances). A copy of this time
schedule can be obtained at the Building and Safety Department.
4. A building permit is required for this application. Please apply to the Building
and Safety Department for a permit (777-7012).
5. Install one 2A10BC fire extinguisher inside the building by the exit door, and
provide a "Door to remain open during business hours" sign above the exit door.
6. No signs are permitted unless separately approved by this Department.

7. Temporary landscaping shall be installed around the perimeter of the parking lot.
The landscape/irrigation plan shall be submitted to the Community Development
Department within 30 days. All improvements shall be installed before the on-
site sales activities commence.
8. Mounted close to the front door shall be a written notice informing emergency
personnel of your 24-hour emergency phone number that they can call in case
problems arise that need your prompt attention (i.e., minimum 1 " high letters).
9. All requirements addressed in Section 9.60.250 of the Municipal Code shall be
met where applicable.
10. The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.
The property owner agrees to indemnify,defend and hold harmless the City of La
Quinta in the event of any legal claim or litigation arising out of the City's approval of
this application. The City of La Quinta shall have the right to select its defense
counsel in its sole discretion. The City shall promptly notify the applicant/developer
of any claim, action or proceeding and shall cooperate fully in the defense.

will conduct a final inspection to determine compliance with all Conditions of Approval.
