SUBJECT: Minor Use Permit 2003-433 (2004 La Quinta Arts Festival)
Dear Ms. Salamone;
The Community Development Department hereby approves your request to
hold the 2004 La Quinta Arts Festival at your property on Washington Street
(pursuant to the attached plans) on March 18-21, 2004, 9 am to 5 p.m.
each day, subject to the following conditions:
1. Proof of Liability naming the City and its Staff as additionally insured,
during the outdoor event, in the amount of $1,000,000 shall be
submitted to the Community Development Department by March 1,
2004.
2. A bond or other type of guarantee acceptable to the City Engineer
shall be posted with the Public Works Department by March 1, 2004,
insuring blow sand accumulated on any unpaved gravel parking lots
for the event are stabilized during and after the event is completed
pursuant to Chapter 6.16 of the Municipal Code (Fugitive Dust Control
Ordinance). The bond will be released once the applicant has provided
a letter from their contractor stating that the stabilizer material has
been installed after the event (i.e, chemical emulsion, etc.) and City
staff has made a field inspection to verify compliance. The
aforementioned, does not preclude compliance with provisions of the
Fugitive Dust Control Ordinance during the event. A copy of the
contractor's letter shall also be submitted to the Community
Development Department for filing.
3. The applicant shall strictly adhere to the Air Quality Management Plan
as approved for this project. The applicant shall apply sufficient

amounts of water during the off hours to control dust, but shall take
precautions as to not over water, creating ponding/mud within the
parking lot areas.
4. Any tracked -out or other accumulation of soil material(s) onto paved
areas, whether public or private, shall be wet -swept, water flushed, or
otherwise removed (no dry -sweep methods permitted) by the end of
.each day, and shall be kept damp during event operation hours until
removed.
5. The applicant shall provide temporary "No Parking Anytime" signs at
150 foot spacing along the project frontage on Washington Street to
prohibit on street parking.
6. The site shall be cleared of all tumbleweeds prior to the start of the
event.
7. Permits for temporary structures (e.g., tents exceeding 200 sq.. ft.
and/or canopies exceeding 400 sq. ft.) shall be obtained prior to
installation. If you have any questions, the Fire Department personnel
can be reached at 863-8886. Fire lanes shall be established and/or
maintained during the special event.
8. A notice shall be given to the existing property/business owners in the
immediate area informing them of the upcoming event and associated
parking restrictions and access routes. A copy of the written notice
shall be given to the Community Development Department.
9. Approval includes directional signs as submitted (see attached sign
information). An encroachment permit shall be requested and issued
by the Public Works Department for any signs in the City street right-
of-way. Signs in the City street right-of-way shall be mounted on
maximum 2" by 2" wood posts unless . otherwise approved by the
Public Works Department. No signs shall be closer than 100 feet from
an intersection. Temporary signs shall be posted no closer than 5 feet
from the edge of the paved area of any public road or street and
placed a minimum of 200 feet from an identical sign. Signs placed on
private property shall be installed only if authorization from the owner
has been secured prior to installation. All signs shall be placed in a
manner that does not obstruct traffic or pedestrian visibility, traffic of
street signs or other important safety devises. Signs #1,2 and 30 are
not in the City of La Quinta and the applicant should obtain the
applicable jurisdictions approval for those signs.

10. A check (or cash deposit) in the amount of $100.00 shall be given to
the Community Development Department guaranteeing removal of all
temporary signs by March 1, 2004. The posted money will be
refunded when said signs are removed.
11. Prior to start of the event, a site inspection shall be made by City Staff
and the Fire Marshal to insure safety and compliance with all
conditions of approval.
12. Temporary trash/recycling receptacles shall be provided. The site shall
be left cleared of all litter and other items at the end of the event.
13. Portable restrooms shall be provided as required by the Building and
Safety Department. Restroom facilities for the handicapped shall be
provided.
14. The serving of food and alcoholic beverages shall be subject to the
Riverside County Health Department and State Department of
Alcoholic Beverage Control.
15. All portable overnight security light standards shall not exceed 12 feet
in height, nor be within 50 feet of the south property line adjacent to
Laguna de La Paz. Temporary lighting shall be dimmed to a level no
higher than needed to provide security and shall not be directed
towards residential uses or the street. The City may request
adjustment of the lights if necessary.
16. Portable generators, if used, shall be shielded to prevent accidental
contact with guests. Extension cords shall be secured to the ground
to prevent tripping hazards. Each generator, including lighting units,
shall be provided with a 2A-10BC rated fire extinguisher.
17. Noise created by musical entertainment shall not be physically
annoying to surrounding residential properties. The applicant shall
comply with noise control standards in Sections 9.100.210 (Noise
Control) of the Zoning Code.
18. If ground excavation is required, contact Underground Service Alert
(USA) at 1-800-227-2600. The service is free of charge provided
they are given at least two days notice.
19. Artists are not permitted to camp out at the site or in the City of La
Quinta, except at an established campground. Please note City Codes
do not permit overnight camping at Wal-Mart.

20. All designated private security personnel must be licensed by the State
of California and possess a current private Security Guard License.
21. All vendors shall obtain a City Business License prior to the start of
the event.
22. The applicant agrees to defend, indemnify, and hold harmless the City
of La Quinta (the "City"), its agents, officers and employees from any
claim, action or proceeding to attack, set aside, void, .or annul the
approval of this Minor Use Permit. The City shall have sole discretion
in selecting its defense counsel.
The City shall promptly notify the applicant of any claim, action or
proceeding and shall cooperate fully in the defense.
22. Riverside County Sheriff's Deputies shall be employed during the event
for traffic control and security as determined necessary by their
agency through prior contractual arrangements. See their attached
letter dated October 30, 2003, for specific requirements.
23. The south half of perpendicular parking spaces on the perimeter road
east of the artists parking lot shall be used for unloading and loading
only.
24. The City may add conditions to this application to mitigate any
unforeseen problems or concerns that arise before or during the event.
Please note that this is the last Arts Festival event that the City of La Quinta
will approve on this site.
This approval may be appealed to the Planning Commission provided the
required forms and filing fee of $175.00 are filed with this office within 15
days of this decision.

22"d Annual La Quinta Arts Festival — March 18-21, 2004
La Quinta Arts Foundation requests a permit to hold a "Minor Outdoor Event" within the city
limits of La Quinta on March 18, 19, 20, and 21, 2004. This event, La Quinta Arts Festival will
be conducted in compliance with Chapter 9.216 (#348 of the Riverside County Land Use
Ordinance XIXa), "Temporary Outdoor Events." Anticipated attendance at the 4 -day public
exhibition is not expected to exceed 2,000 at any given time. The hours of the festival are 9am
to 5 pm each day, Thursday, Friday, Saturday and Sunday.
La Quinta Arts Festival will be held on the La Quinta Arts Foundation's site located at 47-555
Washington Street, La Quinta.
The attached plot plan indicates:
1. The area in which the displays will be exhibited;
2. Artist and patron parking areas;
3. Placement of sanitation facilities;
4. Placement of electrical requirements.
5. First Aid location.

ADEQUATE AREA TO CONDUCT TAE EVENT: There are not more than 280 artists who
will be displaying their work. The public will be admitted through one gate located on the east
side in the center of the property.
PARKING: Parking for artists will be in the Southwest comer of the site. Public parking will
be located on the east side of the property. Professional attendants will assist the public in
parking.
FOOD SERVICE: Food and beverage services will be provided to the public from outside
professional purveyors who will prepare food or beverages according to Riverside County Health
Department standards.
FIRST AID STATIONS: Red Cross will be asked to provide standby first air response.
Ambulance access will be maintained and the entire facility and parking will have identifiable
locations plotted on a grid for easy location of emergency sites. This will be communicated to
all security and safety personnel.

FIRE PROTECTION: One 2A l OBC fire extinguisher will be installed in each food area. Fire
exits are two twenty -foot wide gated openings in the fence on the west and north side of the
grounds. The gridded plot map will be utilized by fire control personnel.
SANITATIONS FACILITIES: We have arranged for portolets to be brought in by Waste
Management of the Desert to also include to ADA approved units for the physically challenged.
POTABLE WATER: Drinking water will be available from food and beverage vendors.
SOLID WASTE DISPOSAL: Two 30 cubic -yard roll -offs will be placed on the access road on
the west side of the property. Trash containers will be located throughout the festival grounds.
Food and beverage vendors will be required to supply additional receptacles. La Quinta Arts
Foundation will see to the daily transfer of refuse to proper containers on site.
SECURITY OPERATION: Security for the event will be provided by a professional security
service. A private guard will patrol the premises at all times commencing at 6:00 p.m. on
Monday, March 15, and continuing until 10:00 a.m. Tuesday, March 23.
CROWD CONTROL & TRAFFI FLOW: In addition to the private security force and the
professional parking attendants, off-duty police will be utilized to provide crowd control and
traffic direction at peak festival hours. The traffic and parking patterns developed for last year's
festival per the attached diagram will be re -instituted.
CAMPING: Exhibitors in recreational vehicles will not be permitted to camp overnight in the
parking lots. A list of alternative campsites has been provided to our exhibitors.
PERMISSION TO SERVE ALCOHOLIC BEVERAGES: We will be applying for a permit
from the Alcohol Beverage Control Board for the sale of alcohol at this year's event. The sellers
will check that each purchaser is over 21 years of age. Alcohol consumption will take place
within the designated fenced grounds only.
SITE INSPECTION: A site inspection will be scheduled with City staff and the Fire Marshall
for 9:00 a.m. Thursday morning, March 18, to insure compliance with all project conditions.
DIRECTIONAL SIGNS: We request that the City of La Quinta authorize placement of signs
to promote La Quinta Arts Festival, a community event, according to the attached map and
descriptions. The directional signs, which are painted on MDO plywood, will be set in place
February 9 and will be taken down by March 26.
On behalf of La Quinta Arts Foundation, we respectfully request that the City of La Quinta grant
a permit to conduct the 22"d Annual La Quinta Arts Festival.

I have reviewed the plans associated with this upcoming project. My comments are given to
provide more detailed information about the traffic control plans used last year. Last year's event went
very smoothly with only minor traffic issues mentioned. Only one traffic collision occurred on
Washington Street near the event while it was underway. This was due to a driver not watching the
roadway and instead focusing on the vehicles entering and leaving the festival. These type collisions
occur frequently due to other normal daily events and I do not feel that is was directly related to the
festival.
I suggest that the event maintain the same staffing levels of law enforcement personnel as last year
in the same locations (Refer to table below that indicates last years staffing levels per day of the event). I
also recommend that the Arts Festival use the DSUSD Administrative. parking lots as overflow parking
and use shuttle buses from that location to the event. This was also done last year and worked very well.
The proposed use of the parking area at the city lot off Calle Tampico is a longer distance from the event
and much more difficult for out of area visitors to locate.

This letter is to advise you, members of the City Council, and appropriate staff at
the City of La Quinta of La Quinta Arts Foundation's (LQAF) submission of an
Application for Minor Use Permit Approval to host the 22nd annual La Quinta Arts
Festival (March 18-21, 2004) on LQAF"s Washington Street site.
We submit this application with the express understanding that this will be the
final festival held at this location due to the property's impending sale. As you
know the property is under contract with a potential purchaser who has met with
the City staff in the course of performing their due diligence. Our discussions
with the potential purchaser indicate their plans for the property's development
conform with the existing entitlements, and we have negotiated use of the site for
festival in our contract with them.
We have spent the last several months scouting alternative locations to host the
festival wirhin the City of La Quinta, and as you know our request to use the new
City owned soccer park at Westward Ho was denied. Unfortunately there are
few sites anywhere in the valley that are large enough to accommodate the
festival safely, without extraordinary logistical expense required to relocate the
festival.
LQAF has successfully orchestrated the festival at the Washington Street
location without a single incidence of injury, damage or mishap for the past two
years. You will see from the attached permit application our intention to again
host a quality event that will be a credit to the City of La Quinta. We respectfully
request your approval to hold festival on the Washington Street property and
keep the 22nd Annual La Quinta Arts Festival in La Quinta.

La Quinta Arts Foundation will be holding the 22nd Annual La Quinta Arts
Festival, March 18 -21, 2004 at our location on Washington Street, immediately
adjacent to St. Francis Church.
La Quinta Arts Festival is a four-day fine art festival featuring the work of 271
acclaimed artists from around the nation and this year, two foreign countries.
The festival hours are 9 am to 5 pm daily. Live entertainment, food and
beverages are also offered to the public. An average of 7,500 people visit the
festival each day.
A professional parking service and La Quinta sheriff are used to insure efficient
and safe traffic flow during festival hours. A private security force is also utilized
during all festival hours and overnight. Security lighting for the 4 days will remain
on throughout the nighttime hours. This is the 22nd annual festival produced by
La Quinta Arts Foundation and the 3"d on the Washington Street location, all
without a single incidence of injury, damage or mishap to festival patrons.
In accordance with an easement agreement number 501398 dated December
18, 2000 between La Quinta Arts Foundation and The Roman Catholic Bishop of
San Bernardino, et. al., this letter is to request use of St. Francis Church grassy
parking lot adjacent to our site for overflow parking during the days of La Quinta
Arts Festival. We understand there is some overlap with the hours of your
services and would not expect that parking would be made available when in use
by St. Francis of Assisi. We would be happy to provide you with a certificate of
insurance with limits of coverage as provided for in the easement agreement. I

This letter is to advise you that La Quinta Arts Foundation is proceeding with the
planning and preparation to hold the 22nd Annual La Quinta Arts Festival at the
Foundation's property on Washington Street. We have filed a Minor Use Permit
Application with the City of La Quinta for this purpose with the understanding that this
will be the final festival held at this location due to the property's impending sale.
La Quinta Arts Festival is scheduled for March 18-21, 2004. The hours that the Festival
is open to the public are from 9:00 a.m. to 5:00 p. m. each day. There will be no evening
hours.
The live entertainment will run each day from 9:30 a. m. to 4:30 p. m. in the
amphitheatre area. A host of local musicians similar to last year's performers are slated.
Look for upcoming advertisement for the full entertainment schedule or visit our website

Some of the changes instituted last year, such as the shorter hours, the revised traffic
control patterns, more effective signage, and relocation of the food and refreshment
areas were well received by festival attendees and your members as well. We will model
La Quinta Arts Festival 2004 in the same pattern.
Overnight security lighting will be in place with 4 light towers at a maximum height of 12
feet directed away from Laguna de la Paz. Parking lot lights (used only for safety of
departing patrons) will be turned on at 4:00 p.m. and off no later than 11:00 p.m. each
day. A professional security patrol will be in place during all hours of the festival,
supplemented by off-duty police at peak hours for crowd control and traffic direction.
Again, we are pleased to report not a single incidence of injury, damage, or mishap
occurred for the last two festivals held at the Washington Street location.
As always, we endeavor to host a quality event and to preserve Laguna de la Paz
residents' safety and tranquility. We hope your residents will support the festival and the
work we do in service to our community.

Introduction
1. This is the Official Preliminary Punchlist. It should be
noted, however, it is preliminary in the sense that new items
can be added as needed if city staff becomes aware of
additional deficiencies after its issuance but before the City
Council votes to accept the improvements. Having noted that
exception, however, this punchlist does represent a complete
review of the project by city engineering staff as of the date
the punchlist was issued; it is good for sixty (60) days. If
the deficiencies noted on this punchlist are not completed
within 60 -days city engineering staff will make a complete
review of the project again.
2. The City Engineer's Office, and its administrative staff, are
the City's representative in the field. Completion of
improvements to the satisfaction of the City Engineer and its
administrative staff does not mean the improvements are
accepted; it means the City Engineer is willing to make a
recommendation to the City Council that the improvements are
satisfactorily completed. The City Council has the ultimate
decision authority with respect to deciding whether the
improvements are satisfactorily completed and worthy of
acceptance.
3. Typically, new deficiency items are added to the punchlist
because a member of the general public has pointed out a
deficiency and city staff concurs that correcting the
deficiency is a valid responsibility of the developer.
Naturally, the City Engineer is not going to make a
recommendation to the City Council stating the improvements
are worthy of acceptance if there are members of the general
public who have legitimate issues regarding the quality of
City required improvements. Whenever new deficiency items are
added to the Official Preliminary Punchlist, it is done so by

amending the punchlist.
4. The City Council meets on the 18` and 3`a Tuesdays of each
month, except for August and September each year when it
typically goes dark the last meeting of August and the first
meeting in September. All punchlist items must be complete in
totality on the 2°a Thursday before a scheduled City Council
meeting to be placed on the agenda, no exceptions. Please
plan accordingly.

1. The City shall be provided with updated original mylars for.
all improvements to reflect the "as built" condition. Each
sheet of the drawings shall have the words "As -Built" or
"As -Constructed" clearly marked on each sheet and be stamped
and signed by the civil engineer certifying to the as -built
conditions. (NOT COMPLETED, SEE LQAF LETTER DATED 10/11/02
FOR EXPLANATION).
2. All monumentation shall be performed and certified by a
Registered Land Surveyor or Civil Engineer. A letter
certifying the monumentation has been performed shall be
provided to the City.
3. Centerline ties at all street intersections should be provided
to the City. NOT.APPLICABLE
4. The City shall be provided with letters from all applicable
utility companies and public agencies, certifying that all
underground improvements. are in place, completed,. and
accepted. (IID - COMPLETED, CVWD - NO WRITTEN CONFIRMATION OF
ACCEPTANCE)
5. All improvements shall be cleaned and access provided to all
drainage improvements to verify condition, drainage, flow
test, and functionality.
6. Certification letter from the Engineer/Surveyor shall be
submitted stating payment for services has been received.
(WARNER ENGINEERING, NOT PAID IN FULL. SEE LQAF LETTER DATED
10/11/02 FOR EXPLANATION).

Requested Engineering Conditions
1. A bond or other type of guarantee acceptable to the City Engineer shall be posted
with the Public Works Department insuring blow sand accumulated on any
unpaved gravel parking lots for the event are stabilized during and after the event
is completed pursuant to Chapter 6.16 of the Municipal Code (Fugitive Dust Control
Ordinance). The bond will be released once the applicant has provided a letter
from their contractor stating that the stabilizer material has been installed after the
event (Le, chemical emulsion, etc.) and City staff has made a field inspection to
verify compliance.The aforementioned, does not preclude compliance with
provisions of the Fugitive Dust Control Ordinance during the event. A copy of the
contractor's letter shall also be submitted to the Community Development
Department for filing.
2. The applicant shall strictly adhere to the Air Quality Management Plan as approved for
this project. The, applicant shall apply sufficient amounts of water during the off hours to
control dust, but shall take precautions as to not over water, creating ponding/mud within
the parking lot areas.
3. Any tracked -out or other accumulation of soil material(s) onto paved areas, whether
public or private, shall be wet -swept, water flushed, or otherwise removed (no dry -sweep
methods permitted) by the end of each day, and shall be kept damp during event
operation hours until removed.
4. The applicant shall provide temporary "No Parking Anytime" signs at 150 foot spacing
along the project frontage on Washington Street to prohibit on street parking.
5. As a condition of this approval, the applicant shall complete all improvements
required of the Official Preliminary Punchlist dated November 8, 2002, 2"d Punchlist.

Imperial Irrigation District facilities will not be impacted by the Minor Use Permit 2003-
433. However, we would like to caution the applicant of the two safety concerns listed
below.
The cumulative impact of projects of this size increase the electrical demand on the IID's
existing facilities at peak loading periods, and results in the need for additional
generation, transmission, substation, and distribution facilities. When additional facilities
are needed, projects of this magnitude directly impact power rates in the IID's service
area and may results in higher electric rates in future years.
Before any cranes, forklifts, or other aerial equipment are raised, please check for
overhead wires. Please note that California Title 8, Electrical Safety Orders, specifies the
closest distance that non-qualified electrical workers can get to electrically energized
conductors. Non-qualified electrical workers can get no closer than six (6) feet from our
distribution lines and no closer than ten (10) feet from our transmission lines. People
operating boom type lifting or hoisting equipment can get no closer than ten (10) feet
from our distribution lines and no closer than seventeen (17) feet from our transmission
lines.
If ground excavation is required, even for seemingly benign applications such as
anchoring a tent, please contact Underground Service Alert (USA). This service is free
of charge provided USA is given at least two (2) working days' notice. You may call toll
