The Community Development Department hereby approves your request to hold the 2003
La Quinta Arts Festival at your property on the west side of Washington Street, north of
Avenue 48 (pursuant to the attached plan) from March 20-23, 2003, 9 a.m. to 5 p.m. each
day, subject to the following conditions being completed by March 18, 2003.
1. Proof of Liability Insurance naming the City, and its staff, as additionally insured
during the outdoor event in the amount of $1,000,000.00 shall be posted with the
Community Development Department.
2. Permits for temporary structures (e.g., tents exceeding 200 sq. ft. and/or canopies
exceeding 400 sq. ft.) shall be obtained prior to installation. If you have any
questions, the Fire Department personnel can be reached by calling 863-8886 (i.e.,
Planning and Engineering). Fire lanes shall be established and/or maintained
during the special event.
3. A notice shall be given to the existing property/business owners in the immediate
area informing them of the upcoming special event and associated parking
restrictions and access routes. A copy of the written notice shall be given to the
Community Development Department.
4. Approval includes directional signs as submitted (see attached). An encroachment
permit shall be issued by the Public Works Department for any signs placed in the
City's rights-of-way. Signs in the City right-of-way shall be mounted on maximum
2 -inches by 2 -inches wood posts unless otherwise approved by the Public Works
Director. No signs shall be closer than 100 -feet from an intersection. Temporary
signs shall be posted no closer than 5 -feet from the edge of the paved area of any

public road or street and placed a minimum of 200 -feet from an identical sign.
Signs placed on private property shall be installed only if authorization from the
owner has been secured prior to installation. All signs shall be placed in a manner
which does not obstruct traffic visibility, traffic or street signs or other important
equipment. Signs #1, 2, and 30 are not within the City of La Quinta and should
obtain approval from the appropriate jurisdictions.
5. A check (or cash) in the amount of $100.00 shall be posted with the Community
Development Department guaranteeing removal of the temporary signs by March
25, 2002. The posted monies will be refunded when all on-site and off-site signs
are removed as defined herein.
Additional conditions are:
6. Prior to start of the event, a site inspection shall be made by City staff and the Fire
Marshal to insure compliance with all project conditions.
7. Temporary trash receptacles shall be provided so that trash/debris can be
deposited accordingly. The site shall be left clean of any litter at the close of the
event.
8. Portable restrooms shall be provided for guests and volunteers as required by the
Building and Safety Department. Restroom facilities shall be accessible to the
physically challenged.
9. The serving of food and alcoholic beverages at the event shall be subject to the
rules and requirements of the Riverside County Health Department and State
Department of Alcoholic Beverage Control. Alcoholic beverages shall be served
in paper or plastic cups.
10. * All portable overnight security light standards shall not exceed the approved 12 foot
height of the permanent lights nor be within 50 feet of the south property line
(Laguna de La Paz). Temporary lighting shall be dimmed to a level no higher than
needed to provide security and shall not be directed toward surrounding residential
properties or the street and shall be adjusted to eliminate spillover and glare if
requested by the City. Additional light poles may be approved by the Community
Development Department upon request.
11. Portable generators, if used, shall be shielded to prevent accidental contact with
guests. Extension cords shall be secured to the ground to prevent tripping hazards.
Each generator, including lighting units, shall be provided with a 2A-10BC fire
extinguisher.
12. Noise created by musical entertainment shall not be physically annoying to adjacent
residential property owners. The applicant shall comply with noise control
standards established in Sections 9.100.210 (Noise Control) of the Zoning Code.

13. If ground excavation is required, please contact Underground Service Alert (USA)
at 1-800-227-2600. The service is free of charge provided USA is given at least
two days' notice.
14. No overnight camping at the site is permitted. Please note City Codes do not permit
overnight camping at Wal-Mart.
15. The applicant shall strictly adhere to the Air Quality Management Plan as approved
for this project. The applicant shall apply sufficient amounts of water during the off
hours to control dust, but shall be careful not to over water, creating ponding/mud
within the parking lot areas.
16. Any tracked -out or other accumulation of soil material(s) onto paved areas, whether
public or private, shall be wet -swept, water flushed, or otherwise removed (no dry -
sweep methods permitted) by the end of each day, and shall be kept damp during
event operation hours until removed.
17. The applicant shall provide temporary "No Parking Anytime" signs at 150 foot
spacing along the project frontage on Washington street to prohibit on street
parking.
18. All designated private security personnel must be licensed by the State of California
and possess a current Private Security Guard license.
19. Vendors shall obtain a City Business License prior to the beginning of the festival.
20. By holding the outdoor event, the applicant agrees to indemnify, defend and hold
harmless the City of La Quinta in the event of any legal claim or litigation arising out
of the City's approval of this event. The City of La Quinta shall have the right to
select its defense counsel in its sole discretion.
21. The artists' lot shall be temporarily delineated, with parking attendants provided to
ensure the maximum number of artists vehicles are parked there. No parking shall
be allowed on the adjacent cul-de-sac road unless and until the artist parking lot is
full. Temporary parking for drop-off and pick-up shall be permitted.
22. The City owned parking lot on Avenida Bermudas may be used as an off-site
parking site with shuttle service to and from the festival. The lot shall remain open
to the public visiting the village area.
23. Riverside County Sheriffs Deputies shall be employed during the event to provide
security and traffic control supervision as determined necessary by their agency
through prior contractual arrangements. See their attached letter dated March 3,
2003, for specific requirements.

Dear Members of the Laguna de la Paz Board,
This letter is to advise you that La Quinta Arts Foundation is proceeding with the
planning and preparation to hold the 21s1 Annual La Quinta Arts Festival at the
Foundation's property on Washington Street. We have filed a Minor Use Permit
Application with the City of La Quinta for this purpose.
La Quinta Arts Festival is scheduled for March 20-23, 2003. The hours that the Festival
is open to the public this year have been shortened from 9 a.m. to 5 p.m. each day.
There will be no evening hours.
The live entertainment will run each day from 9:30 a. m. to 4:30 p -m. in the amphitheatre
area. A host of local musicians including Mike Costley, Pat Rizzo, Yve Evans and John
Stanley King will perform. Look for upcoming advertisement of the full entertainment
schedule or visit our website at www.lgaf.com.
Based on our experience last year we have revised the traffic patterns on and off-site,
and increased the number of Sheriffs to direct and control the traffic flow more efficiently_
In addition we have developed better directional signage. We are offering free off-site
parking with shuttle service as well.
The food and refreshment areas have been relocated this year to a distance further than
last year from our mutual boundary, addressing easier accessibility, noise and potential
cooking smells reduction.
Overnight security lighting will be in place with 4 light towers at a maximum height of 12
feet directed away from Laguna de la Paz. Parking lot lights (used only for safety of
departing patrons) will be turned on a 4 p, m- and off no later than 11 p. m. each day_
You may recall last year's extreme and unprecedented weather conditions wreaked
havoc on the Festival. Even with the severe conditions, we are pleased to report not a
single incidence of injury, damage, or mishap occurred.

Dear Mr. Sawa,
Thank you for the opportunity to comment on the above described event. The
following issues of concern related to public safety and law enforcement are
presented:
Alcoholic Beverage Sales:
The serving of alcoholic beverages during the event shall be subject to the rules
and requirements of the Riverside County Health Department and State of
California Department of Alcoholic Beverage Control. Alcoholic beverages shall
be served in paper or plastic cups. No open beer or wine will leave the grounds.
Beer or wine will not be sold to anyone under 21 or to intoxicated persons.
Proper and valid government issued identification is required from anyone
appearing to be under 30 years old to purchase beer or wine. Proper no sales to
anyone under 21 signs will be posted.
Private Security:
All designated private security personnel must be licensed by the State of
California and possess a current private security guard license.
Traffic Flow, Parking Issues and Extra Duty Deputy Hours:
Two message boards need to be placed on Washington Street telling motorists if
the parking lot is full, how to locate the overflow parking area at Desert Sands
Unified School District, 47950 Dune Palms Road. and about shuttle service.
Contact Tops N Barricades, 44631 Jackson St., Indio, phone #347-2111, for the
message boards and necessary cones. Shuttle buses shall be used to transport
customers from the overflow parking area to the event and back to the overflow
parking area.
The traffic flow diagram on page 3 shall be used to reduce traffic congestion and
accidents. See page 3 for the diagram.
If the event coordinator decides to close the festival early due to bad weather or
emergency, the coordinator will immediately notify the on duty event deputies,
security guards, and parking duty personnel about the closure. This will allow the
deputies, security guards, and parking personnel to set up a plan for the mass
exit from the event.
La Quinta Police Department extra duty deputies shall be used at the event
during the following dates and times:
• One deputy on March 20 from 1000-1800 hours for traffic control and interior
security,
• One deputy on March 21 from 1000-1800 hours for traffic control and interior
security,
• Two deputies for traffic control from 1000-1800 hours and two deputies for
interior security from 1100-1900 on March 22, and
• Two deputies for traffic control from 1000-1800 hours and two deputies for
interior security from 1100-1900 hours on March 23.

DATES: 21' Annual La Quinta Arts Festival — March 20-23, 2003
La Quinta Arts Foundation requests a permit to hold a "Minor Outdoor Event" within the city
limits of La Quinta on March 20, 21, 22, and 23, 2003. This event, La Quinta Arts Festival will
be conducted in compliance with Chapter 9.216 (#348 of the Riverside County Land Use
Ordinance XIXa), "Temporary Outdoor Events." Anticipated attendance at the 4 -day public
exhibition is not expected to exceed 2,000 at any given time. The hours of the festival are 9am
to 5 pm each day, Thursday, Friday, Saturday and Sunday.
La Quinta Arts Festival will be held on the La Quinta Arts Foundation's site located at 47-555
Washington Street, La Quinta.
The attached plot plan indicates:
1. The area in which the displays will be exhibited;
2. Artist and patron parking areas;
3. Placement of sanitation facilities;
4. Placement of electrical requirements.
5. First Aid location.
ADEQUATE AREA TO CONDUCT THE EVENT: There are 277 artists who will be
displaying their work. The public will be admitted through one gate located on the east side in
the center of the property.
PARKING: Parking for artists will be in the Southwest corner of the site. Public parking will
be located on the east side of the property. Professional attendants will assist the public in
parking.
FOOD SERVICE: Food and beverage services will be provided to the public from outside
professional purveyors who will prepare food or beverages according to Riverside County Health
Department standards.
FIRST AID STATIONS: Red Cross will be asked to provide standby first air response.
Ambulance access will be maintained and the entire facility and parking will have identifiable
locations plotted on a grid for easy location of emergency sites. This will be communicated to
all security and safety personnel.
FIRE PROTECTION: One 2AlOBC fire extinguisher will be installed in each food area. Fire
exits are two twenty -foot wide gated openings in the fence on the west and north side of the
grounds. The gridded plot map will be utilized by fire control personnel.
SANITATIONS FACILITIES: We have arranged for portolets to be brought in by Waste
Management of the Desert to also include to ADA approved units for the physically challenged.
POTABLE WATER: Drinking water will be available from food and beverage vendors.
SOLID WASTE DISPOSAL: Two 30 cubic -yard roll -offs will be placed on the access road on
the west side of the property. Trash containers will be located throughout the festival grounds.
Food and beverage vendors will be required to supply additional receptacles. La Quinta Arts
Foundation will see to the daily transfer of refuse to proper containers on site.
SECURITY OPERATION: Security for the event will be provided by a professional security
service. A private guard will patrol the premises at all times commencing at 6:00 p.m. on
Monday, March 17, and continuing until 10:00 a.m. Tuesday, March 25.
CAMPING: Exhibitors in recreational vehicles will not be permitted to camp overnight in the
parking lots. A list of alternative campsites has been provided to our exhibitors.
PERMISSION TO SERVE ALCOHOLIC BEVERAGES: We will be applying for a permit
from the Alcohol Beverage Control Board for the sale of beer and wine at this year's event. The
sellers will check that each purchaser is over 21 years of age. Alcohol consumption will take
place within the designated fenced grounds only.
SITE INSPECTION: A site inspection will be scheduled with City staff and the Fire Marshall
for 9:00 a.m. Thursday morning, March 20 to insure compliance with all project conditions.
DIRECTIONAL SIGNS: We request that the City of La Quinta authorize placement of signs
to promote La Quinta Arts Festival, a community event, according to the attached map and
descriptions. The directional signs, which are painted on MDO plywood, will be set in place
February 7 and will be taken down by March 25.
On behalf of La Quinta Arts Foundation, we respectfully request that the City of La Quinta grant
a permit to conduct the 21 n Annual La Quinta Arts Festival.

Your letter to Mayor Adolph of January 20, 2003 has been forwarded to
my attention. As you know, City Manager Tom Genovese has refrained
from involvement on this matter due to a possible conflict issue.
Regarding the bullet points contained within your letter:
• 1 am advised that the Community Development and Public Works
Departments have approved revised landscape and design plans
for improvements within the Washington Street parkway that are
generally consistent with the spirit and intent of the original
Specific Plan. I am not aware of plans "awaiting final approval
from Building and Safety." Specifically, for what plans are you
awaiting approval? When were they submitted?
• Please clarify which matters you'd like to group together, rather
than seeking "piecemeal" approval.
• The Public Works Director has determined that a bond is required
for improvements within the Public Rights of Way. This decision
is within his authority pursuant to the Municipal Code. I believe
this decision is justifiable, especially given safety concerns relative
to design of the retaining wall and its proximity to the public
sidewalk. The Municipal Code affords the applicant an opportunity
to appeal the Director's decision to the City Council (Section
14.14.510, et. Seq.).
• Similar to last year, staff understands the Foundation may seek a
Minor Use Permit for the Festival in March: As you know, City
NpAo,
a
• 0
staff offered that option last year when the Foundation was in a
similar position; and not without consequence (i.e., the City
received complaints from neighboring residents alleging "favored
treatment" for the Foundation and suggesting the permit was
granted outside the confines of conditions contained within the
Specific Plan). Staff is sympathetic to the Foundation's financial
status and its challenges in complying with conditions of approval.
And we will process and consider another Minor Use Permit
application this year if submitted. The integrity of the system
must be preserved, however. The length of time associated with
development of the. site, especially those activities within the
public rights of way, further emphasizes cause for the City's
bonding requirement.
Staff understands that the Foundation may again seek financial
assistance from the City. Previously, the City and Foundation had
discussed various forms of potential assistance ultimately resulting
in correspondence forwarded to Ms. Susan Francis dated April 2,
2002 (enclosed). I understood that there were also discussions
previously wherein the Foundation's engineers were attempting to
document the extent that the Foundation property might
contribute to resolution of regional drainage issues. You may wish a
to directly contact Tim Jonasson, Public Works Director, to further
pursue the drainage matter.
We recognize that there have been numerous challenges for the
Foundation in constructing the site per plan and consistent with
approved conditions. The City endeavors to cooperate in processing
plans submitted by the Foundation as best possible. To that end, you
may contact appropriate staff to review status of submitted plans or
options for attaining the Foundation's objectives. As noted earlier, Tom
Genovese has recused himself from matters involving the LOAF project
on Washington Street. Jerry Herman has recused himself on all
Foundation matters through May of 2003. In the interim, Oscar Orci,
Planning Manager, will assist on all planning matters. Tim Jonasson,
City Engineer/Public Works Director, will assist with drainage,
infrastructure and site plans. Tom Hartung, Building and Safety Director,
will assist with matters involving building permits. You may, of course,
contact me regarding any of these matters as required. And, if you
wish, we can arrange another "all hands" meeting to discuss project
status.

Thank you for taking the time to meet with me and members of La Quinta Arts
Foundation's Board of Directors last Friday, January 17, 2003. Your interest in, and
support of our organization is greatly appreciated. Your guidance was wise and very
informative. We were pleased to learn that there will be "no more correcting the
corrections"!
We also thank you for being willing to talk with our City Manager, Tom Genovese to
make certain that our building permit process will continue to move along as
expeditiously as possible. We hope you will advise Tom that:
■ LQAF plans have been approved by two City departments and are awaiting final
approval from Building and Safety.
■ As soon as we receive approval of the plans, we shall put the contract out for
bids so that we can do the remainder of the project in its entirety, which is cost
effective, rather than piecemeal.
■ Tim Jonasson, Public Works Director has asked that we post a bond, which we
request not be required, since it would cause more delay and expense, and we
have already paid for substantial improvements to the property.
■ Since time is short and it is doubtful that we could complete all the required work
necessary to obtain permanent occupancy of the site before our annual Festival
scheduled for March 20-23, 2003, we shall start the application process
immediately for a Minor Use Permit.
• Pursuant to previous discussion with the City, LQAF shall approach the City for
reimbursement of the costs of drainage and certain infrastructure improvements
along the Washington Street corridor.
■ Since we have not secured the permanent occupancy permit, we have not been
able to accommodate several requests from organizations and businesses who
have asked to rent our facilities for special events, thus depriving us of
substantial income.
Again, thank you for your encouragement and willingness to assist us through this
challenging process. We know the City prides itself in being "user friendly" and you
certainly embody that concept.

Dear Ms. Hunt:
The Community Development Department hereby approve%your request to hold the 2002
La Quinta Arts Festival at your property on the west side of Washington Street, north of
Avenue 48 from March 14-17, 2002, with a Patron Appreciation event on March 13, 2002,
from 5 p.m. to 10 p.m., subject to the following conditions being completed by March 12,
2002:
Proof of Liability Insurance naming the City, and its staff, as additionally insured
during the outdoor event in the amount of $1,000,000.00 shall be posted with the
Community Development Department.
2. Permits for temporary structures (e.g., tents exceeding 200 sq. ft. and/or canopies
exceeding 400 sq. ft.) shall be obtained prior to installation. If you have any
questions, the Fire Department personnel can be reached by calling 863-8886 (i.e.,
Planning and Engineering). Fire lanes shall be established and/or maintained
during the special event.
3. A notice shall be given to the existing property/business owners in the immediate
area informing them of the upcoming special event and associated parking
restrictions and access routes. A copy of the written notice shall be given to the
Community Development Department.
4. Approval includes directional signs as submitted. An encroachment permit shall be
issued by the Public Works Department for any signs placed in the City's rights-of-
way. Signs in the City right-of-way shall be mounted on maximum 2 -inches by 2 -
inches wood posts unless otherwise approved by the Public Works Director. No
signs shall be closer than 100 -feet from an intersection. Temporary signs shall be

posted no closer than 5 -feet from the edge of the paved area of any public road or
street and placed a minimum of 200 -feet from an identical sign. Signs placed on
private property shall be installed only if authorization from the owner has been
secured prior to installation. All signs shall be placed in a manner which does not
obstruct traffic visibility, traffic or street signs or other important equipment.
5. A check (or cash) in the amount of $100.00 shall be posted with the Community
Development Department guaranteeing removal of the temporary signs by March
25, 2002. The posted monies will be refunded when all on-site and off-site signs
are removed as defined herein.
Additional conditions are:
6. Prior to start of the event, a site inspection shall be made by City staff and the Fire
Marshal to insure compliance with all project conditions.
7. Temporary trash receptacles shall be provided so that trash/debris can be
deposited accordingly. The site shall be left clean of any litter at the close of the
event.
8. Portable restrooms shall be provided for guests and volunteers as required by the
Building and Safety Department. Restroom facilities shall be accessible to the
physically challenged.
9. The serving of food and alcoholic beverages at the event shall be subject to the
rules and requirements of the Riverside County Health Department and State
Department of Alcoholic Beverage Control. Alcoholic beverages shall be served
in paper or plastic cups.
10. All portable light standards shall not exceed the approved 12 foot height of the
permanent lights nor be within 50 feet of the south property line (Laguna de La
Paz). Area lighting must be adequate to permit patrons proper visibility within the
festival, stage and seating areas. Temporary lighting shall not be directed toward
surrounding residential properties and shall be adjusted to eliminate spillover and
glare if requested by the City. Additional light poles may be approved by the
Community Development Department upon request.
11. Lights used overnight for security shall be lowered and dimmed, if possible, if
deemed necessary by the City to minimize light impacts.
12. Portable generators, if used, shall be shielded to prevent accidental contact. with
guests. Extension cords shall be secured to the ground to prevent tripping. Each
generator shall be provided with a 2A-1 OBC fire extinguisher.

13. Noise.created by musical entertainment shall not be physically annoying to adjacent
residential property owners. The applicant shall comply .with noise control
standards established in Sections 9.100.210 (Noise Control) of the Zoning Code.
14. Riverside County Sheriffs Deputies shall be employed during the event to provide
security and traffic control supervision as determined necessary by their agency
through prior contractual arrangements.
15. If ground excavation is required, please contact Underground Service Alert (USA)
at 1-800-227-2600. The service is free of charge provided USA is given at least
two days' notice.
16. No overnight camping at the site is permitted. Please note City Codes do not permit
ovemight camping at Wal-Mart.
17. The applicant shall strictly adhere to the Air Quality Management Plan as approved
for this project. This is especially critical since the parking areas will not have the
gravel parking surface applied in time for this event. The applicant shall apply
sufficient amounts of water during the off hours to control dust, but shall be careful
not to over water, creating ponding/mud within the parking lot areas.
18. Any tracked -out or other accumulation of soil material(s) onto paved areas, whether
public or private, shall be wet -swept, water flushed, or otherwise removed (no dry -
sweep methods permitted) by the end of each day, and shall be kept damp during
event operation hours until removed.
19. The applicant shall provide temporary "No Parking Anytime" signs at 150 foot
spacing along the project frontage on Washington street to prohibit on street
parking.
20. All designated private security personnel must be licensed by the State of California
_and_posse.ss_a_curr_ent_P_rivate_S.ecurity_Guard-license.. .
21. Parking attendants shall wear reflective vests and carry flashlights after dusk.
22. Vendors shall obtain a City Business License.
23. By holding the outdoor event, the applicant agrees to indemnify, defend and hold
harmless the City of La Quinta in the event of any legal claim or litigation arising out
of the City's approval of this project. The City of La Quinta shall have the right to
select its defense counsel in its sole discretion.
The City may elect to add Conditions to this application request to mitigate any problems
that arise not previously addressed herein.

This letter is to advise you that La Quinta Arts Foundation is proceeding with the
planning and preparation to hold La Quinta Arts Festival 2002 at the new Washington
Street site. This year we celebrate La Quinta Arts Festival's 200 anniversary and we are
very excited to be at the new location.
La Quinta Arts Festival is scheduled for March 14-17, 2002, and will be open to the
public for the hours indicated on the enclosed flyers. Also, on the evening of March 13,
2002 we will host a private patron appreciation event on the grounds from 6pm to Spm.
We hope our neighbors will share our excitement for the 20'" Annual La Quinta Arts
Festival and consider being a part of the very important volunteer team at this beautiful
new location. Volunteering at La Quinta Arts Festival is rewarding and fuel Enclosed are
some volunteer sign up sheets for you to distribute — or have any interested members
call Penny Riley at 564-1244 ext. 109 for more information.
Because of the inexact nature of construction, and our dependency on the installation
schedules of some of the public utilities, it may be necessary to utilize some temporary
power and lighting sources for this event. Thus we have taken the precaution of filing a
minor use permit with the City of La Quinta. As always, we endeavor to host a quality
event and to preserve Laguna de la Paz residents' safety and tranquility_
