SUBJECT: MINOR USE PERMIT 2003-397 FOR TRACT NO. 30487

This: is to report that the Community Development Department has approved your
r,equest to have a temporary sales office and parking lot on Lots 1 and 2 of Tract
30487 pursuant to Section 9.60.250 of the Zoning Code, based on the following
findings:
A. Adequate off-street parking will be installed to accommodate guests and
employees; and
B. The public roadways surrounding the project are capable of handling the traffic.
No problems are anticipated which would be detrimental to the community
based on the recommended conditions.
The following Conditions of Approval shall be met at all times during use of the
property for sales activities:
1 . A building permit must be obtained. Please apply to the Building and Safety
Department for a permit (760-777-7012).
2. A check in the amount of $1,000.00 shall be posted with the City to insure the
temporary improvements are removed before a building permit can be issued.
Please contact the Community Development to complete this requirement.
3. The temporary sales office and accessory parking lot can remain on-site until
March 28. 2004, unless an extension of time is granted by this Department.
A request for a time extension shall be made in writing in February 2004. The

Community Development Director may, after reviewing the facts, extend the
use of the office and parking area for another six-month period.
4. Use of the sales office shall be limited to the hours of construction as listed in
the La Quinta Municipal Code (Chapter 6.08, Nuisances). A copy of this time
schedule can be obtained at the Building and Safety Department.
5. A minimum of ten parking spaces shall be installed ensuring that the parking
improvements comply with all provisions of Chapter 9.150 of the Zoning
Ordinance (i.e., AC paving, striping, etc.). A design for the parking lot shall be
approved by the Community Development Department before any on-site work
begins.
6. A landscape and irrigation plan shall be submitted to the Community
Development Department for review and approval within 30 days for all areas
within 20 feet of the trailer and/or parking lot. Trees may be placed in 24" box
containers surrounding the parking lot area as an option to planting the trees in
the ground during the operation of this temporary facility. Groundcover shall
consist of gravel or turf, or a combination thereof. At a minimum, five gallon
shrubs shall be installed on the south side of the trailer to augment other
landscape improvements. Site improvements shall be completed within 90
days. If the office and its affiliated parking areas are enclosed by a chain link
fence that is covered in green vinyl mesh, the improvements listed above do not
have to be installed.
7. The trailer shall be placed at least 90 feet from the west property line. The
trailer may not be brought on-site unless a grading permit has been obtained.
8. Dust control measures shall be employed at all times as prescribed by Chapter
6.16 of the Municipal Code.
9. Install one 2A10BC fire extinguisher inside the building by the exit door, and
provide a "Door to remain open during business hours" sign above the exit door.
10. No signs are permitted unless separately approved by this Department.
1 1 . Mounted close to the front door shall be a written notice informing emergency
personnel of your 24-hour emergency phone number that they can call in case
problems arise that need your prompt attention (i.e., minimum 1 " high letters).

12. All applicable conditions and mitigation measures pertaining to TTM 30487 and
EA 2002-442 shall be met during construction activities.
13. The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.
The property owner agrees to indemnify, defend and hold harmless the City of La
Quinta in the event of any legal claim or litigation arising out of the City's approval of
this application. The City of La Quinta shall have the right to select its defense
counsel in its sole discretion. The City shall promptly notify the applicant/developer
of any claim, action or proceeding and shall cooperate fully in the defense.
Please contact this Department when all on-site improvements have been installed, and
we will conduct a final inspection to determine compliance with all Conditions of
Approval.
