The Community Development Department has approved your request to allow a
detached guest house in conjunction with your residence at 57-785 Black Diamond.
You must have the enclosed Covenant and Agreement recorded by the County
Recorder in Riverside, and deliver a copy of the recorded documents to us for our
files. Once recorded, our Department will give the Building and Safety Department
clearance to issue the building permit. Enclosed is a letter addressed to the County
Recorder -indicating our approval of the request.
On the covenant please fill in the date of signing the Covenant on the second page
prior to recordation. You need to sign on the second page, with the signatures
notarized. For your information, Homeowners Association approval may be required
for construction of this nature.

COVENANT AND AGREEMENT RESTRICTING THE USE OF A DETACHED GUEST
HOUSE AT 57-785 BLACK DIAMOND, LA QUINTA, CALIFORNIA
This Covenant and Agreement are made and executed on this the 28" day of
May, 2003, by Weiskopf Partners I, LLC, for property described herein. The City of
La Quinta, a Municipal Corporation, is hereby made a party to this agreement for the
purposes set forth below.
The undersigned hereby certifies that they are the property owners of the
following described real property in the City of La Quinta, County of Riverside, State
of California:
Lot 53, Tract 29147, as shown by map on file as Assessor's Parcel
Number 761-860-007
In consideration of the City of La Quinta issuing a building permit for certain
improvements which will be constructed on said property, the undersigned does
hereby covenant and agree to and with said City to restrict the use of said property
as follows:
1. The guest house may not be rented or sold independent of the main
single family residence (Minor Use Permit 2003-410).
2. The detached guest house is intended for use by the property owner
and does not have a kitchen per the provisions of the Zoning Code. The
guest house is for sleeping or recreation purposes of the on-site
residents and their non-paying guests or employees, pursuant to Section
9.60.100 of the Zoning Code.
This covenant and agreement shall run with the land and shall be binding upon
future owners, their successors, heirs, or assigns, and ourselves, and shall continue
in effect while said second dwelling unit remains on the real property or unless
otherwise released by the authority of the City of La Quinta. This agreement shall

be entitled to the remedy of injunctive relief in addition of any remedy in law or
equity.
This covenant and agreement and the provisions, hereof are irrevocable and
nonmodifiable except by the written consent of all parties to the agreement, including
the City of La Quinta, a municipal corporation. The City shall have the right to
enforce each and every provision hereof and the parties agree that the agreement
shall not be rescinded, revoked, modified, or otherwise amended or changed, without
the expressed written consent of the City first being obtained.
In the event that the owners, their heirs, assigns or successors in interest, shall
fail to perform any obligation hereunder, they hereby agree to pay all costs and
expenses incurred by the City of La Quinta in securing performance of such
obligation, including attorney's fees.

CONSTRUCTION CONTRACTOR AGREES THAT IN ACCORDANCE WITH GENERALLY
ACCEPTED CONSTRUCTION PRACTICES, CONSTRUCTION CONTRACTOR WILL BE
REQUIRED TO ASSUME SOLE AND COMPLETE RESPONSIBILITY FOR JOB SITE
CONDITIONS DURING THE COURSE OF CONSTRUCTION OF THE PROJECT.
INCLUDING SAFETY OF ALL PERSONS AND PROPERTY; THAT THIS REQUIREMENT
SHALL BE MADE TO APPLY CONTINUOUSLY AND NOT BE LIMITED TO NORMAL
WORKING HOURS, MID CONSTRUCTION CONTRACTOR FURTHER AGREES TO
DEFEND, INDEMNIFY AND HOLD DESIGN PROFESSIONAL HARMLESS FROM
ANY AND ALL LIABILITY, REAL OR ALLEGED, IN CONNECTION WITH THE
PERFORMANCE OF WORK ON THIS PROJECT, EXCEPTING LIABILITY ARISING
