If you receive the request from a planner, they should give you a letter
signed by the applicant - with the application number noted.
Check the Model Home Deposit Log Book to pull the Model Home
Deposit Pink Copy.
Pull the appropriate file; i.e., MUP 2006-734.
Contact Greg, or Kay, in Building and Safety and verify that the
models have been converted and there are no outstanding issues that
would delay the refunding of this deposit; i.e., model home garage
was not converted back, etc. (It is best if you send an e-mail so that
you have the verification.)
When verified, prepareor a Demand/Check Request, noting this is a
"Refund of Model Home Deposit for MUP XXXX-XXX, deposited to
101-0000-228.10-00 (This is the GL Account No.) on XX/XX/XXXX.
In checking with Building & Safety, all models have been finalled and
funds are eligible for refund. Appropriate documentation is attached."
Attach the documentation which will include copies of whatever Diane
M. gave you (usually a copy of the check and deposit slip), plus the
original application. Request that the check be returned to you for
mailing.
Give to Les for signature.
Make a black -&-white copy of everything and take the original signed
copy and attachments to Finance (Sandra).
If you do not want to keep the MUP file at your desk until the check is
processed, you can file it back with a note in it saying - "MHD Refund
Pending - See (your initials)" and you can retrieve it when you get the
check. (Or you can put a copy of the check request in with a note
saying "Check Pending".
❑ When you receive the check, make a copy and include it in the
appropriate file; i.e. VYP 006-734, before you mail it out.
❑ NOTE: According to Phyllis (2/1/10) - if any refundable deposits are
made -- you have to notify the City Clerk. This includes MUP's for
model home deposits, developer deposits, or any refundable deposit
required as noted in the Conditions of Approval for a project.

SUBJECT: MINOR USE PERMIT 2006-769
Dear Mr. Pedalino:
The Community Development Department has reviewed and approved your request for
a model home complex for Tract 31.910, located at the northeast corner of Via San
Clemente and Camino San Juan, subject to the exhibits on file end the following
Conditions:
1. Prior to use of the model home complex, a cash deposit in the amount of
$1,000.00 shall be posted with the Community Development Department to
insure the removal of the improvements once the permit has expired or the
use terminated as required by the City Council Ordinance #361. The deposit
will be refunded when all model home improvements have been removed.
2. If a building permit is required, contact the Building and Safety Department at
(760) 777-7012 for permit requirements.
3. Provide restroom facilities in the office to accommodate personnel.
4. Mounted on the exterior of the sales office shall be a written notice providing
emergency personnel your 24-hour emergency phone number they can call in
case problems arise that need your prompt attention (i.e., minimum 1" high
letters).
5. Install one 2A10BC fire extinguisher inside the sales office.
6. The model home complex shall be permitted to remain open for one year
from the time it opens, unless a time extension is applied for and granted by
this Department. The Community Development Director may extend the
permit for a set time period if needed. No fee is charged to extend this
permit.

7. This approval includes the following signs:
a. Eight (8) "Capistrano at La Quinta" flags
b. One (1) triangular directional sign's
8. The proposed temporary fence/wall along Monroe Street shall be removed
and replaced by the permanent perimeter wall by the time building on lots 63,
64, and 65 has been completed or use of the model complex has ceased,
whichever occurs first.
9. The applicant/property owner agrees to defend, indemnify, and hold harmless
the City of La Quinta (the "City"), it's agents, officers and employees from any
claim, or litigation arising out of the City's approval of this project. This
indemnification shall include any award toward attorney's fees. The City of La
Quinta shall have the right to select its defense counsel in its sole discretion.
The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.
This decision may be appealed to the Planning Commission by anyone provided .they.
submit the necessary paperwork. and. filing.fee of $1.75.00.*.0.1his office.within 15 days of
approval of this permit.

The original check was from "Desert Elite Inc. — Capistrano Account" with the address of 78-401 Highway 111, Suite
G, La Quinta 92253.
The City's procedure is to send the refund check back to the same name/address as the original deposit check.

Attached please find application package for the Application for Minor Use Permit Approval for the
Capistrano Model Complex and Sales Office.
Please note the following;
1)The Model Complex is located on Lots 66,67,68 in Tract 31910 on Camino Pacifica.
2)The Sales Office and Parking Lot is located on Lot 69 in Tract 31910.
The application package includes five (3) copies of the following;
1)Model Complex Planting Plan
2)Exhibit "A" — The Project Site Plan indicating 30OLF between the south side of the Well Site and the
Project Entry (Highlighted in Blue). We are requesting the installation of 5' decorative steel fencing on
top of 1' of Mission Slumpstone Block Wall with a sack finish so that the Models may be viewed from
Monroe St. This will be a temporary condition during the marketing period of the homes for the
project. During the final phase of construction the decorative steel fencing shall be removed and the
perimeter wall will be constructed per the project conditions of approval.
3)Exhibit `B" — The Project Site Plan indicating the location of six (6) flags within the Model
Complex and two (2) flags at the front entry of the project along Monroe St.
4)Description of Flags — A total of eight (8) flags will be installed.
5)Description of 3 Sided Triangle Sign located at the front entry of the Sales Office Parking Lot.
6)One (1) check in the amount of $75.00.
