CONSTRUCTION MATERIALS AND EQUIPMENT STORAGE AREA
Dear Mr. Prevost:
The Planning Department has reviewed and approved your request for a temporary
construction materials and equipment storage area located within the Madison
Club, subject to the exhibits on file and the following Conditions of Approval:
1. The applicant/property owner agrees to defend, indemnify, and hold
harmless the City of La Quinta (the "City"), its agents, officers and
employees from any claim, or litigation arising out of the City's approval
of this project. This indemnification shall include any award toward
attorney's fees.
The City of La Quinta shall have the right to select its defense counsel in
its sole discretion. The City of La Quinta shall promptly notify the
applicant of any claim, action, or proceeding and shall cooperate fully in
the defense.
2. The applicant shall comply with all provisions of La Quinta Municipal
Code Section 9.60.210.
3. The temporary storage area shall be utilized for no more than three years
from the date of this approval.
4. Use of the area shall be for equipment and materials storage only. No
other use may occur within the site, including construction activity.
5. The storage area location shall not deviate from the portion of the site
identified in the submitted site plan. No materials stored at the site shall
be visible from outside of the adjacent perimeter wall. Sounds resulting
from the accessing of the site, such as beeping from vehicles, shall be
kept to a minimum. No materials shall be stored that result in any
nuisance odors. Lighting of the storage area is prohibited.
6. Roadways/traffic aisles to structures and activities in and around the
storage area shall be maintained accessible to emergency vehicles at all
times.
Approval of this Minor Use Permit application will not result in conditions
detrimental to public health, safety and general welfare, nor injurious to or
incompatible with other properties and uses in the vicinity. The City may elect to
add Conditions to this application request to mitigate any problems that arise not
previously addressed herein.
This decision may be appealed to the Planning Commission by anyone provided
they submit the 'necessary paperwork and filing fee of $175.00 to this office within
15 days of approval of this permit.

Re: Establishment of a materials and equipment storage yard; Minor Use Permit required
Dear Mr. Prevost:
An inspection at the Madison Club on Ave. 53A Palazo St. revealed that the trailers have been removed
as you indicated. However, approximately fifty pallets of various construction materials remain stored
behind the block wall abutting the Carmela Development in violation of La Quinta Municipal Code
9.60.210 & 9.210.020 Minor Use Permit required. Also the strobe lights mounted on the 4 x 4 posts
are not fully shielded and emanate towards adjacent residential housing in violation of La Quinta
Municipal Code 9.100.150 (F) (1) (a).
As the initial notification regarding this violation was mailed to you and the Madison Club on April 1,
2011, the time provided to resolve this Issue will be limited.
Please exercise either of these two options to resolve these code violations. Remove the stored
materials and strobe lights no.later than September 7, 2011 or remove the strobe lights and submit the
enclosed application for a Minor Use Permit with respective fees to store the referenced construction
materials no'later than September 7, 2011. A failure to correct these violations in the time provided will
result in an administrative citation or other legal remedy.

Attached, please find the letter authored by Anthony Moreno; pertaining to the stored construction materials. The
letter states strobe Lights mounted on 4"x4" posts are not shielded from the adjacent property. The strobe light fixtures

WHEREAS, pursuant to Sections 8322 and 8323 of the Public Streets,
Highways and Service Easement Vacation Law, due notice of the Public Hearing was
given by public posting in the time and manner prescribed by law; and
WHEREAS, following its discussion of the street vacation application on
November 14, 2006, the Planning Commission of the City of La Quinta has determined
that the vacation of said length of Avenue 53 west of Monroe Street, is not in conflict
with the Circulation Element or other policies of the General Plan of the City of La
Quinta; and
WHEREAS, the City Council of the City of Le Quinta has conducted the required
public hearing upon due notice and, upon hearing and considering all testimony and
arguments of all interested, parties and persons desiring to be heard, did find the facts
to exist justifying the approval and adoption of said length of Avenue 53 west of
Monroe Street vacation, as follows:
1. Vacation of the subject length of Avenue 53 west of Monroe Street will not
adversely affect the City of La Quinta or adversely impact the Circulation
Element of the City of La Quints General Plan.
2. The affected length of Avenue 53 west of Monroe Zireet is unnecessary for
either present or prospective. public use or purposes, including use as a non -
motorized transportation facility..
3. No local public agency or utility has submitted an objection to the proposed
vacation of the length of Avenue 53 west of Monroe Street.
4. Approval and adoption of the proposed vacation of a length of Avenue 53 west
of Monroe Street will not cause a significant negative impact upon the
environment, due, in part, to the fact that extinguishment of the right-of-way
will restore possession of the vacated. length of Avenue 53 west of Monroe
Street to the vested owners of the abutting parcel of real property.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LA QUINTA, CALIFORNIA, AS FOLLOWS.-
SECTION
OLLOWS:
SECTION 1: The City Coiuncil, having elected to proceed under•the.provisions of
Chapter 3 of the Public Streets, Highways and Service Easement Vacation Law of the
State of California, and having held a public hearing upon due notice as provided
therein, hereby finds from all evidence submitted that the length of Avenue 53 west of
Monroe Street, specifically described in Attachments 1-2, attached hereto and
incorporated herein, is unnecessary for either present or prospective public use or
purposes, including use as non -motorized transportation facilities.
SECTION 2: The City Council hereby orders the vacation of the length of
Avenue 63 west of Monroe Street, as shown in Attachments 1-2 attached hereto and
incorporated heroin.
SECTION 3: The City Council hereby determines that adoption of the vacation
will cause no significant negative environmental Impact.
SECTION 4: The City Council hereby orders that the vacation shall not be
effective until a certified copy of this Resolution has been recorded with the Riverside
County Recorder.
SECTION 5: The City Council hereby determines and orders that the City Clerk
is hereby authorized and directed to record a certified copy of this Resolution in the
Office of the County Recorder of Riverside County, Carifornia.

Council held on ibis 6th day of December, 2006, by the following vote to wit:
