CAPISTRANO GRAND OPENING
Dear Mr. Pedalino:
The Community Development Department has reviewed and approved your request
to hold a Grand Opening event for the Capistrano Model Homes on April 12-15,
2007. This approval includes a radio station broadcast, a model home balloon, and
the VIP Grand Opening Party held from 5:30 p.m. to 7:30 p.m. on April 12, 2007.
The approval of the event is granted under Section 9.60.170 of the La Quinta
Municipal Code, and is subject to the following Findings and Conditions of
Approval:
FINDINGS -
A. The public roadways surrounding the event area are capable of handling the
anticipated traffic volumes generated from this event. No significant effects
are anticipated which would be detrimental to the health, safety and public
welfare of the community, with implementation of the proposed traffic
control plan and required conditions of approval.
B. The event is categorically exempt from environmental review under the
California Environmental Quality Act (CEQA), under CEQA Guidelines,
Section 15304(e).
C. Facilities, either existing or temporary, such as parking, restrooms, security,
lighting, seating, and fire, etc., will be provided to accommodate event staff,
visitors, and employees.

D. The required conditions will ensure that tenants within the surrounding area
will not be adversely affected by this event.
CONDITIONS:
1. The applicant agrees to indemnify, defend and hold harmless the City of
La Quinta, its agents, officers, and employees from any claim, action, or
proceeding to attack, set aside, void, or annul the approval of this
Temporary Use Permit. The City of La Quinta shall have the right to select
its defense counsel at its sole discretion.
The City of La Quinta shall promptly notify the applicant of any claim,
action, or proceeding and shall cooperate fully in the defense.
2. The applicant shall comply with all provisions of the La Quinta Municipal
Code (LQMC).
3. The event location shall not deviate from the portion of the site identified
in the attached site plan. Fire lane access shall remain unrestricted at.all
times.
4. The applicant shall obtain all other applicable permits, if required, from
the appropriate agencies (i.e. Fire Department, Sheriffs Department, etc.)
5.. A building permit shall be obtained if temporary electric facilities or stages
are proposed. The Building and Safety Department can be reached at
760-777-7012.
6. The use of amplified equipment for music presentations is permitted. The
applicant shall comply with the City of La Quinta Noise Ordinance (LQMC
9.100.210).
7. If portable generators are used for electricity, they shall be shielded to
prevent accidental contact with guests. If extension cords are used, they
shall be ground -secured to prevent.tripping.
8. Roadways, parking areas, and pedestrian traffic aisles to other businesses
and activities in the vicinity shall be maintained accessible at all times.
9. The site shall be left clean and in its original manner after the event.
Trash receptacles shall be provided so that trash/debris can be deposited
accordingly.
10. The approval of the Minor Use Permit includes a model home balloon. The
balloon shall be installed no earlier than April 12, 2007 and shall be
removed on or before April 15, 2007.
The City may elect to add Conditions to this application request to mitigate any
problems that arise not previously addressed herein.
This decision may be appealed to the Planning Commission, provided the written
appeal and filing fee of $175.00 are submitted to this Department within 15
calendar days. Please contact this office should you _wish to file an appeal, and we
will assist you in that regard.
