IMPROVEMENTS TO EXISTING TELECOMMUNICATION FACILITY
Dear Ms. Leinart:
The Planning Department has reviewed and approved your request to replace three
existing antennas with newer panel antennas and new radio remote -head antennas
and equipment cabinets at an existing telecommunication facility, located at 46-
600 Adams Street, within the Storage USA site. The approval of this application is
subject to the exhibits on file in the Minor Use Permit and the following Findings
and Conditions of Approval:
FINDINGS
1. Consistency with the General Plan: The proposed new antennas and
equipment cabinets at the existing telecommunication facility are
consistent with the goals, objectives and policies of the General Plan, in
that the new antennas will increase the community's ability for quality
access to wireless communication services.
2. Public Welfare: Approval of the new antennas on an existing
telecommunication facility will not create conditions materially detrimental
to the public health, safety and general welfare.
3. The proposed new antennas at the existing telecommunication facility will
minimize adverse visual impacts through the design and placement of the
antennas in the existing antenna array. -
4. The proposed new antennas are designed tofunction within the existing
antenna array, which is at an adequate height to achieve the service
provider's objectives for coverage within this portion of the community.
5. The proposed new antennas are necessary to improve community access
to wireless services.
CONDITIONS
1. The . applicant/property owner agrees todefend, indemnify, and hold
harmless the City of La Quinta. (the "City"), its agents;. officers .and.
employees from any claim, or litigation -arising out of the City's approval
of this project. This indemnification shall include any award toward
attorney's fees.
The City of La Quinta :shall have the right to .select its defense counsel in
its sole discretion. The City of La Quinta shall promptly notify the
applicant of any claim, action, or. proceeding and shall cooperate fully in
the defense.
2. The, applicant shall comply with all provisions of La Quinta Municipal
Code Section 9.170 "Wireless Telecommunication Facilities".
3. The applicant shall comply with all provisions contained in Conditions of
Approval for Conditional Use Permit 2001-063 (CUP 01-063).
4. The applicant shall provide proper maintenance to the remaining Date
Palms at the site, including irrigation improvements and proper trimming.
5. The applicant shall install new. faux palm fronds at the top of the tower to
help screen the existing arrays and .existing and new antennae. A
minimum of seventy-five (75) faux fronds shall be installed at the top of
the tower.
6. The applicant is permitted to install an additional three (3) panel antennas_
on- the existing antenna- arrays. on the ,- tower; one panel per array.
Additionally, the applicant is permitted to place six (6) new radio remote -
head antennas on the existing arrays, behind the panel antennas. All new
antennas shall be painted to match the existing antennas on the array.
7. New equipment shall be contained in the existing equipment shelter.

8. New cables .running from the equipment shelter to the new antennas shall
be contained within .the interior of the tower and shall not be visible from
surrounding properties.
9. The applicant shall obtain a building permit for the City's building and
Safety-Departrhe'nt (760) 777-7012.
Approval of this Minor Use Permit application will not result in conditions
--detrimental—to- -public—health,safety—and—general—welfare; - nor—injurioas--t6--Or
incompatible with other properties and uses in the vicinity. The City may elect to
add Conditions to this application request to mitigate any problems that arise not
previously addressed herein.
This decision may be appealed to the Planning Commission by anyone provided
they submit the necessary paperwork and filing fee. of $175.00 to this office within
15 days of approval of this permit.-

1, The applicant agrees to defend, indemnify, and hold harmless the City of La
Quinta (the "City"), Its agents, officers and employees from any claim, action
or proceeding to attack, set aside, void, or annul the approval of this Conditional
Use Permit. The City shall have sole discretion in selecting its defense counsel.
This indemnification shall include any award toward attorney's fees.
The City shall promptly notify the applicant of any claim, action or proceeding
and shall cooperate fully in the defense.
2. Prior to the issuance of an improvement or building permit, the applid;ant shall
obtain permits and/or clearances from The following public agencies, or
departments:
• Community Development Department
• Building and Safety Department
• Riverside County Fire Department
• Imperlal Irrigation District (IID)
• Federal Communication Commission IFCCI
• Federal Aeronautical Association (FAA)
The applicant is responsible for any requirements of the permits or clearances
from those jurisdictions. If the requirements Include approval of improvement
plans, applicant shall furnish proof of said approvals prior to obtaining City
approval of the plans.
3. Development of this site shall be in substantial conformance with Exhibits
approved and contained in the file for Conditional Use Permit 2001-063, unless
amended by the following conditions.
4. The applicant shall pay all deposits and fees required by the City for plan
checking and construction inspection. Deposits and fee amounts shall be those
in effect when the applicant makes application for the plan checks, permits, and
inspections.

6. Before any cranes, forklifts, or other aerial equipment are raised, please check
for overhead wires pursuant to the provisions of California Title 8 (Electrical
Safety orders). Non-qualified electrical workers can get no closer than 6 feet
from I1D distribution lines and no closer than 10 feet from transmission lines.
People operating boom type lifting or hoisting equipment can get no closer than
10 feet from IID distribution lines and not clasar then 17 feet from transmission
lines.
7, If ground excavation is required, even for seemingly benign applications such as
anchoring a tent, please contact Underground Service Alert (USA). This service
is free of charge provided IDSA is given at least two working days' notice (800-
227-2600). ,
MISCELLANEOUS
8. A minimum of two 40 foot tall palm trees shall be planted in close proximity to
the monopalm communication tower and vines shall be esplanade on the outside
of the security walls in 15 -foot increments. An automatic timer irrigation
system is required.
B. A minimum of two service vehicle parking spaces Shall be provided, These
apeces shall be signed to preclude use by other mini storage users.
10. Heavy gauge, opaque metal gates shall be Installed. Chain link fencing is not
