charged full fee, with remaining related applications discounted 50% for each. This discount does not apply
to Environmental Information form.

SUBJECT: MINOR USE PERMIT 2009-1005
TEMPORARY CONTAINER: 51-890 AVENIDA ALVARADO
Dear Ms. Gregg:
The Planning Department has reviewed your request to place a temporary container at the
property located at 51-890 Avenida Alvarado in La Quinta, California. Our Department
hereby approves your request subject to the exhibits on file and the following Conditions:
1. The applicant/property owner agrees to defend, indemnify, and hold harmless the
City of La Quinta (the "City"), it's agents, officers and employees from any claim,
or litigation arising out of the City's approval of this project. This indemnification
shall include any award toward attorney's fees. The City of La Quinta shall have
the right to select its defense counsel in its sole discretion.
The City of La Quinta shall promptly notify he applicant of any claim, action, or
proceeding and shall cooperate fully in the defense.
2. The applicant shall comply with all provisions of the La Quinta Municipal Code
(LQMC).
3. The container can remain on-site from March 9 — March 16 2009. Unless there is
evidence of an extreme extenuating circumstance, the Planning Department may
or may not grant an extension for this application. The container shall be
removed from the site prior to March 17, 2009.
4. Use of the container shall be for trash and debris purposes only. Construction
activity is limited to the house of construction as listed in the La Quinta Municipal
Code (Chapter 6.08 Nuisances). A copy of this time schedule can be obtained
form the Building and Safety Department.

5. The container shall be placed on the subject property, behind the existing
walls/fences on the property. The container may not be located on the street or
on the front lawn.
6. The container shall comply with Code Section 9.60.050 Storage and Other
Accessory Buildings, and shall comply with Code Section 9.60.210 Construction
and Guard Offices.
7. The container shall be immediately removed by the authorized disposal service
at the applicants expense if any noxious or nuisance odors are found to emanate
from the container.
8. It is the responsibility of the applicant to ensure that refuse stays within the
container by use of a tarp or netting under windy or other adverse weather
conditions.
9. The container may not be used to remove hazardous waste. It is the
responsibility of the applicant to properly dispose of any and all waste.
10. Approval of this Minor Use Permit application will not result in conditions
detrimental to public health, safety and general welfare, nor injurious to or
incompatible with other properties and uses in the vicinity.
The City may elect to add Conditions to this application request to mitigate any problems
that arise not previously addressed herein.
This decision may be appealed to the Planning Commission by anyone provided they
submit the necessary paperwork and filing fee of $175.00 to this office within 15 days of
approval of this permit.
