SUB=: Request .to Use Special Advertising Banners
Dear Mr. Webster:
This letter is to report that the City Council at its November 19, 1985,
meeting approved your request to install two banners on a temporary
basis at the Beef and Brew Restaurant. This approval is subject to the
"following conditions:
CONDITIONS OF APPROVAL
4. 1. Design and installation of the signs shall conform with
Exhibits A and B as contained in the Conmunity Development
Department's file for Special Advertisingr.Device/Beef and
Brew and the following conditions, which conditions shall
take precedence in the event of any conflict with the
provisions of the special advertisinq permit.
2. This approval is for the installation of two (2) temporary
banners to be located at the northeast corner of the
Beef and Brew Restaurant building on the north and east
sides, in accordance with Exhibit "B".
3. The design, size and color of the banners shall be in
substantial conformance with Exhibit "A" as follows:
a.. The maximum size shall be ten (10) feet by
three (3) - feet .
b. The word "Brunch" may be a maximum height of.
eighteen (.18) inch capital letters.
c. The phrase "Sat. & Sun. 11-2:30" may be,a
maximum height of six (6) inches.
d. The sign shall be white, with burgandy lettering
for "Brunch" and black lettering for
"Sat.-& Sun. 11-2:30".

4. The sign shall be mounted flush .on the wall of the building
and shall be secured so as to prevent fluttering, flapping
or other movement which may create a nuisance or traffic
safety hazard.
5. The banners shall not be artifically illuminated.
6. The Applicant shall maintain the signs in good repair for the
life of this permitted use.
7. The Applicant shall submit a signed agreement holdinq the city
harmless of any., damaaes,,c.laims,. causes of actions, by reason
of the issuance of the permit and installation of the special
advertising device.
8. The banners may be installed on a temporary basis as follows:
a. The banners may be displayed on weekends only and
shall be installed no sooner than 6:00 p.m. on Friday
and shall be removed no later than 8:00 a.m. Monday.
b.` The period of this approval shall congnence on
Friday, November 23, 1985 and shall expire at.
8:00 a`.m. Monday.February 24, 1986.

A. Applicant's Request
The Applicant, Beef and Brew Restaurant, is requesting approval to hang two
banners to advertise the hours which they serve weekend brunch.. As shown on
the attached exhibits, the banners will be 10-feet long and 3-feet high.. The
white banner will have 18-inch high, burgundy letters for the word "Brunch",.
and 6-inch high, black letters stating the hours. The signs are proposed for
installation on both sides of the northeast corner of the building adjacent to
.the Highway 111 and Washington Street intersection. The Applicant is requesting
approval from the City Council to hang these banners on weekends only for a
period of three (3) months.'
B. Municipal Code Regulations
As provided for in Chapter 5.64 of the Municipal Code entitled "Special
Advertising Devices", the City Council may issue permits for the use of temporary
special advertising devices (copy of text attached). The following is a brief
summary of this code section:
Purpose: To allow special advertising for grand openings and special occasions
and not on a conti.nuinq: basis for permanent advertising or identification purposes.
What Allowed: Banners, balloons, searchlights and other such devices or objects
which are not customarily and routinely used by all cc mmercial or non-commercial
enterprises of a similar nature.
Permit Procedure:.,All applications are reviewed and acted upon by the City
,Council on a case -by -case basis. +
Grounds for Denial: Permits shall not be issued if the City Council makes any of
the following findings:
The special advertising device would constitute a traffic hazard or a
nuisance to adjacent or surrounding properties or to the public at large.

° The device would be detrimental to the public convenience or welfare.
° The device.would not be in harmony with the various elements and
objectives of the General Plan and all other officially adopted
policies and regulations of the City.
STAFF COMMENTS AND ANALYSIS
Intent of the ordinance
This section is intended to compliment the.existing sign regulations while recognizing
that there are.limited special occasions where non -customary, advertising devices or
additional advertising may be appropriate on.a temporary basis. As stated in the
code, permits may be issued for "grand openings and special occasions and not on a
continuing basis for permanent advertising or identification purposes". Although not
explicitly defined, "special occasions" are just what the term implies - those occasions
or events not occurring on a routine or continual basis. Examples include the La Quinta
Arts Festival, golf tournaments, parades or a specially scheduled promotional event with
celebrity appearances. They do not include events or services customarily or routinely
provided by commercial enterprises of a similar nature; for example, a tavern starting
a "happy hour" is not a "special occasion".
The Applicant's Request
"Beef and Brew" is requesting.approval to hang two banners advertising the hours that
the restaurant -serves brunch. This brunch service has been and will continue to be
offered every weekend. This service has been advertised by the customary means
(newspaper ads) and by the placement of an unauthorized A -frame type sign at the corner
of Washington Street and Highway 111. The Applicant has not requested approval for the
placement of any signs on the building's south or west sides facing inwards to the
Plaza La Quinta Center, of which this restaurant is a part.
It seems questionable that a restaurant.serving brunch is the "special occasion"
referred to in the Municipal Code, especially since it is a service customarily
offered'by similar businesses, and it is a service which has been and will continue
to be offered by the Applicant on a routine weekend basis.
Secondly, the request as proposed is not in harmony with the stated goals and objectives
of the proposed La Quinta General Plan. The proposed Community Design Element designates
the corner of Highway 111 and Washington Street as the major entry point into the City
warranting special design treatment. The placement of two, 10' x 31, white banners
with.18-inch high letters stating "Brunch" may not create a favorable first impression
for people entering the City.
Lastly, although the desire of the Applicant to promote his business to the greatest
extent possible is recognized, approval of the request for a special device advertising
a customary or ongoing service or product could lend to similar requests by the other
businesses located within Plaza La Quinta and the Citv as a whole, since it is a
reasonable assumption that all businesses should be treated equally. Obviously, this
would lead to a cluttered and unattractive appearance and may be a detriment to the
City as a whole.
