SUBJECT: REQUEST FROM ACACIA CONSTRUCTION, INC., TO PLACE 13
FLAGS ALONG MILES AVENUE AND EIGHT FLAGS AROUND
PROPOSED MODEL HOME COMPLEX FOR TRACT 23268-ACACIA.
BACKGROUND:
Municipal Code Chapter 5.64, "Special Advertising Devices", provides for a permit to be issued
by the City Council for advertising devices other than the usual and customary permanent
business identification signs. This includes items such as tract flags.
REQUEST:
Acacia Construction, Inc., originally requested the approval to place 15 tract flags along the
north side of Miles Avenue between North Harland Drive and Seeley Drive, and eight flags
around the proposed model home complex along West Harland Drive east of Seeley Drive.
Flags have been previously approved and erected at this location. The flag holders are still
present and the applicant proposes to reuse the holders. The applicant has revised the request
for fewer flags upon staff's recommendation. A total of 21 flags is requested.
The flags are 40 inches by 65 inches in size, in blue, white and bright pink colors. Lettering
is in blue script and reads "Acacia". The flags will be 12 feet above grade: The flag poles are
white.
FINDINGS:
Section 5.64.020 provides, in part, that permits are to be issued for special purposes, "...and
not on a continuing basis for permanent advertising or identification purposes", and further that
"Each permit shall be issued for a special period of time subject to renewal for good cause
shown."

The Council's consideration of granting this permit must find that the special advertising device
applied for would not:
1. Constitute a traffic hazard or nuisance to adjacent or surrounding properties or to the
public at large; or,
2. Be detrimental to the public convenience or welfare; or,
3. Be inconsistent with the various elements and objectives of the General Plan and all other
officially adopted policies and regulations of the City.
ANALYSTS:
On September 10, 1990, a standard operating procedure was approved by Council regarding the
number of flags in residential subdivisions. The procedure states that a maximum of 20 or 21
flags may be approved. The rationale is that more than 20 flags is excessive, that 20 flags is
sufficient to provide an advertising statement. The applicant originally requested a total of 23
flags, 15 along Miles Avenue and North Harland Drive and eight around the proposed model
home complex.
After informing the applicant that its request was two flags over the maximum permitted, the
applicant verbally agreed to remove two of the requested flags to comply with the policy. Two
of the four flags proposed for North Harland Drive will be dropped from this request. Thus the
total number of flags will be 13/8. See Attachment #2, revised site plan for staff's
recommended flag placement.
Flags have been used by many developers in La Quinta and should not be detrimental to the
surrounding neighborhood if used properly. Staff recommends that the flags be allowed to
remain for a period of one year from date of approval.
RECOMMENDATION:
By Minute Motion 93- approve the request of Acacia Construction, Inc., for 21 flags as
recommended by staff, subject to the findings contained in the staff report, for a period of one
year.

Sub.iect: Special Advertising Device 93-035 - Acacia Flags
This memorandum is in response to , Mr Hunt's inquiry concerning
the Acacia flags being installed prior to City Council approval. I
discovered that the flags were already installed when I visited the
project site about a week before the Council meeting. The
application was received on October i8, 1993. However, it appears
that Acacia Construction had put up these flags either prior to the
application or shortly after with the assumption that they would
be approved. After I visited the site and saw that they were ,up, I
told Acacia that they would have to remove them if Council did
not approve their application.
It is customary to proceed with applications where it is known that
the requested items) is already in place, especially when there is
no other apparent reason to recommend denial. Since it would be
more time consuming to go through the process of getting the
applicant to remove the flags and then go through the approval
process through the City Council, I decided to proceed with the
approval process.
