permission to promote our grand opening by display-
ing a helium filled balloon on the Palm Royale Country
Club property. The balloon would be tethered at the
corner of the club property at the intersection of Fred
Waring and Washington streets. It's size is 19ft. long
by 7 ft. wide and we wish to fly it at a height of -approx-
imately 38-ft. The balloon is made of heavy duty dacron
and is orange in color. The.signage would read, "Public
Restaurant & Golf". The interior of`the balloon would be
lighted..We wish to `display it week -ends from saturday
4 pm and sundays 9 am to 9 pm.- We would like, permission

ISSUES:
Chapter 5.64 of the Municipal Code regulates "Special Advertising Devices". This
Chapter provides for permits to be issued by the City Council for advertising
devices other than the usual and customary permanent business identification signs.
This provision includes such items as balloons as requested by the applicant.
BACKGROUND:
Palm Royale Country Club has renamed their restaurant and desires to advertise it
to the public along with the golf course. There is no permanent signage for the
restaurant, however, previous owners of the club have received approval for
temporary banners and flags for the project. The approval expired in June for the
banner that was attached to the block wall facing the intersection of Fred Waring
Drive and Washington Street. This banner has been removed. The applicant has
applied for permanent signage near the intersection which will be considered by the
Design Review Board on January 5, 1994, and the Planning Commission in mid -
January.
Request
Palm Royale Country Club/Dave Evans has applied for approval of a lighted helium -
filled balloon to be tethered near the corner of the club property at the intersection
of Fred Waring Drive and Washington Street (Attachments 1 & 2) . The balloon would
be tethered to an existing privately owned light standard located on the inside of the
block wall (Attachment 3) . The applicant desires to use the balloon to advertise the
grand opening of their restaurant. The balloon is 19 feet long and 7 feet wide and
is to be flown at approximately 38 feet high. It is made of heavy duty dacron and is
OSHA orange in color. The balloon would display the following wording: "Public
Restaurant & Golf". Illumination would be provided from the interior of the balloon.

The applicant is requesting that the balloon be allowed to fly on the weekends from
Saturday at 4 : 00 P . M. . ( the applicant gave no indication of an ending time) and
Sundays from 9:00 A.M. to 9:00 P.M. during the period of December 15th through
approximately February 15, 1994. The Palm Royale Country Club balloon would fly
for approximately 18 total days during the time period requested.
ANALYSIS:
The applicant originally requested to have the balloon tethered to the Coachella
Valley Water District pump house located within a small triangular parcel directly at
the corner of the intersection of Fred Waring Drive and Washington Street. The
applicant did not want to wait for a letter from the Water District approving the
tethering of the balloon to their facility, and therefore, revised the request to have
the balloon tethered to the light standard located slightly east of the pump house.
Existing permanent signage for the country club is limited to a monument sign
located on Fred Waring Drive, several yards from the intersection with Washington
Street. The temporary banners and signs that had been displayed for a year or
more have been removed at the request of staff, since these signs were either illegal
or their approvals had expired. Currently, there is no signage advertising the
restaurant. The applicant has applied to the City for approval of a proposed
monument sign to be located at the corner of Fred Waring Drive and Washington
Street. This application will go before the Design Review Board on January 5, 1994,
and the Planning Commission in mid -January for review.
Only one other balloon device has been approved by the City Council, and that was
on July 28, 1993, for Baskin Robbins store (SAD 93-032) , located in the One -Eleven
Center. This device was an inflatable 20 foot ice cream sundae sign tethered to the
roof of the store which was allowed to remain up for 10 days. The only condition
placed upon this request was that the device be removed by a certain date.
Staff transmitted the Palm Royale request to several City departments for review and
comment. The Fire Marshal had no comment. The City Engineer stated that the
balloon could be an additional distraction at a busy intersection. Code Enforcement
recommended to deny this request until Palm Royale stops using their trailer sign in
the evenings and on weekends, and removes the flags and banners (Attachments No.
4 to 6) . The applicant has recently removed the banners and illegal signs.
Findings
Section 5.64.020 of the La Quinta Municipal Code provides, in part, that permits are
to be issued for special purposes, n ...and not on a continuing basis for permanent
advertising or identification purposes", and further that "Each permit shall be
issued for a special period of time subject to renewal for good cause".
Staff recommends that the application be denied because of the potential for traffic
hazards at the intersection of Fred Waring Drive and Washington Street, and because
Washington Street is a designated Image Corridor on the General Plan.

In order to approve the application, the City Council must make all of the following
findings:
1. The device does not constitute a traffic. hazard or nuisance to adjacent or
surroundingproperties or to the public at large.
'2. The device will not be be detrimental to the public convenience or welfare.
3. The device is consistent with the various elements and objectives of the
General Plan and all other officially adopted policies' and regulations of the
City.
