SUBJECT: City Policy Regarding Development Across Lot Lines.
Dear Mr. Dougherty:
Per your request on February 28, 1986, this letter defines the City of
La Quinta's policy regarding development across lot lines.
The City does not issue building permits for structures which are located
across lot lines. Structures include walls, swumung pools, and houses.
To facilitate development, the City's Building Division will issue permits
for projects which build across lot lines when an application for either a
parcel merger or lot line adjustment has been submitted and certified as
complete by the Planning Division. In this case, an occupancy permit and
utilities will not be released until the Riverside County Recorder's Office
has recorded the merger/lot line adjustment.
For developTents in the Cove area, the La Quinta General Plan encourages the
merging of smaller residential lots. The CmTmz ity Development Department
is delighted that you have chosen to build upon two lots in the Cove area.
We also understand your problem in that the property owner, for wham you are
building, is out of the country and is therefore unable to sign the appropriate
parcel merger application. Tb accommodate your needs and facilitate development
in the City, the CcuIminity Development Director has authorized the Building
Division to issue you a swinming pool permit (across lot lines) upon your
submittal of the parcel merger application.and application fee.
In addition, a letter should be included specifying that the owner's consent
has been obtained and that the application will be signed by the owner at a
later date. The letter should also indicate that it is understood that occupancy
permits and utilities for the improvements upon both subject parcels will not be
released until the parcel merger has been recorded.
