Dear Assessor:
This letter is to request your assistance on behalf of Fred J. Rios and Anna L. Rios
in properly documenting the status of two lots which were merged into a single lot
by the City of La Quinta in 1988 (Parcel Merger 88-073) .
The City approved the merger of the Rios' lots on June 7, 1988, and the merger was
subsequently recorded on June 14, 1988 (Document #161125) . The Rios apparently
failed to pay property taxes due upon the merged lot, however, and the Assessor's
Parcel Map consequently depicted the merged lot as two separate lots which were
either unmerged or never merged into ont lot.
As you know, the County is not authorized to unmerge lots which have been merged
by the proper jurisdiction. Therefore, we request your assistance in properly
reflecting the merger on the assessment rolls, assessor's parcel maps, and any other
applicable lists and records. Attached is a copy of the recorded Grant Deed merging
the properties.
It is imperative that such records properly reflect mergers and other subdivision and
^, parcel map actions which are taken by the City of La Quinta. Unfortunately, the
City relied on the erroneous Assessor's Parcel Map designation in installing two
sewer line hookups on the merged lot when only one was necessary. Prompt .
attention to this matter will prevent future errors of this nature.

I have enclosed the letter we prepared to assist the Rios in
convincing the County to show that their parcels have been merged.
Please let me know if you have any comments or questions..
You also asked us to make a recommendation as to how the
properties should be treated with respect to Assessment District
91-1. I discussed this matter with Fritz Stradling and he believes
that the Rios should only be required to pay the assessment amount
which should be charged to the merged parcel, rather than the
assessment amount which would be charged to two separate parcels.
It would not be fair to charge the Rios the higher amount, because
they timely processed the parcel merger. Any costs incurred by the
City which are not covered by the Rios' assessment can be obtained
from the Assessment District's contingency fund, if there is an
adequate amount in the fund to do so. Again, please let me know if
you wish to discuss this matter further.

SUBJECT: PARCEL MERGER 88-073 (LOTS 20 & 21, BLOCK 96,
SANTA CARMELITA AT VALE LA QUINTA, UNIT#11),
The Planning & Development Department approved Mr. & Mrs. Rios'
Parcel Merger joining 2 lots on June 7, 1988, and the deeds
were subsequently recorded. This was prior to the deadline for
Parcel Mergers for. Assessment District #4 (July 3, 1991). In
the meanwhile, however, Mr. & Mrs. Rios did.not pay property
taxes on the above lots. The County then revoked the Parcel
Merger. This proved to 'be a problem•when Assessment District
#4 was formed and even though the Rios' had merged their 2
lots, the tax records showed that the lots'had been "unmerged"
by the County. . Mr. & Mrs. Rios have now been charged
assessment rates for 2 lots even though they have merged. their
properties.- Please indicate if the County can "unmerge"
properties as a result of failure to pay property taxes.- I
believe the taxes were .paid up 'to date at the, time the parcel
merger was recorded but fell delinquent- at a• later, date when
the County then "unmerged" the lots.
The following issues need to be resolved:
1. Can the County unmerge properties at will? If so, will
the City have'to remerge the properties?.
2. If the County cannot unmerge the lots, should the owners
be reimbursed the additional assessment fees levied
against them as a result of the County's action?
