Re: Legal Status of Lot 114 of tract M.B. 37/96-98 (La Quinta Tract No. 020-002)
Dear Mr. & Mrs. Stupka:
This letter is being sent with regards to the legal status of the above reference property which is
now commonly referred to 49130 Eisenhower Drive located within the La Quinta Estates
development in the City'of La Quinta. As you may already be aware, the referenced lot (#114)
was identified along with lot #117 to be merged and an application was filed with the City of La
Quinta in 1989. We believe that the parcel merger process was not completed and thus the
merger never occurred. Multiple actions have occurred since 1989 that substantiate the
merger process not being completed and the referenced lot remaining independent, which are
described below.
Our records identify Building Permit No. 2006-0583 was issued in 2006 for the construction of a
single family home on Lot 114. Subsequently, a Notice'of Completion was issued for this home
on August 20, 2007.
With respect to Lot 117, our records identify that Building Permit No. 2006-0584 was also
issued in 2006 for the construction of a single family home on this lot, which has a current
address of 49285 Avenida El Nino. A Notice of Completion was also issued for this home on
August 10, 2007. Copies of these separate Notices of Completion are attached for your review.
As further evidence of the distinct and separate nature of Lots 114 and 117, it is our
understanding that Riverside County is and has been taxing these lots as separate improved
parcels. The Assessor's Parcel Number for Lot 114 is #658-290-042-.2. The Assessor's Parcel
Number for these Lot 117 is #658-290-043-3.
A document has been presented to me dated January 28, 1989 from the City of La Quinta to the
Riverside County Recorder's office requesting the recordation of an attempted merger of Lots
114 and 117. Additionally I have been presented a recorded Grant Deed (Instrument No.
11915) which purports to reflect a merger of Lots 114 and 117. Notwithstanding these

documents, given the permitting and building history of these lots as shown in our files, [can
only conclude there was an incomplete attempt to merge these parcels in 1989. This fact is
borne out by the subsequent treatment of these lots by all involved governmental entities since
that time as separate anddistinct parcels up to and including the present.

2. Proof of ownership in the form of a copy of the original
Grant Deed for the properties involved.
3. A new, original, unrecorded Grant Deed with the following
noted on the Deed:
- Correct legal description, showing all involved
properties for which the merger is requested (this must
match, verbatim, the legal for Exhibit "A"),
- "THIS DEED REFLECTS PARCEL MERGER NO. I AS APPROVED
BY THE CITY OF LA QUINTA." (The Parcel Merger number
will be filled in by this office.)
This is required whether or not there is a conveyance
involved, as state law does not recognize a lot line
adjustment by itself as a legal, recordable document.
4. APPLICATION FEE $175 'n cash or check payable to City of
L uinta.
The Planning and Development Department will review and,
if complete and acceptable, the Planning Director will
approve the Merger Application. The Application will then
be forwarded to the County Recorder's Office for recording
purposes.
