La Quinta Golf Estates
The Imperial Irrigation District (District) is in the process of replacing the existing cable and transformer
system in the La Quinta Golf Estates. The old primary cable and transformers are being removed from
some of the rear and side lot lines and being replaced with cable and transformers along the street right-of-
way. Any primary cable, secondary cable, or transformers located within this existing five (5) foot P.U.E.
mentioned above will have to be removed and new facilities installed along San Vicente Street and San
Pedro Street, within an easement granted to the District.

Dear Mr. and Mrs. Knox:
T`1e Community Development Department is currently processing your request to merge two lots into
one parcel to build a new house with guest house at 48-711 San Vicente Street pursuant to the
provisions of the Municipal Code. We anticipate the parcel merger request will be reviewed by the
Community Development Director this week for determination.
Your construction plans propose your single family house being built over the existing public utility
easements (between the merged lots) which were dedicated during the subdivision of this area in
1959. The public easements may have been abandoned prior to the City's incorporation, but we are
not able to deterrrine this. unless we receive copies of your current Title Reports for each lot. Please
send copies of the reports to our Department as soon as they are available.
If the public easements need to be abandoned, we will send you the requirements for this procedure
once City staff has reviewed your property title information. The abandonment request will require,
at a minimum, the following information or materials:
1. Filing of a Street Vacation application requesting abandonment of the existing easements
accompanied by a check, made out to the City in the amount of $400.00.
2. Written correspondence from all public agencies utilizing this easement stating that they do
not object to the abandonment of the easements.
3. Preparation of a legal description by a licensed land surveyor or civil engineer describing the
abandonment area.
To complete the process, the final abandonment paperwork must be recorded with the Riverside
County Recorder's Office. Abandonment of the easements is required before issuance of a building
permit for your project.-

COVEN _AND AGREEMENT RESTRICTING THE USE OF THE RESIDENCE AT
AN VICE�NTE STREET, LA QUINTA, CALIFORNIA
This covenant and agreement are made and executed on this the _th day of April, 1997,
by Charles R. Knox and Shirley A. Knox, husband and wife as joint tenants for property described
herein. The City of La Quinta, a Municipal Corporation, is hereby made a party to this agreement
for the purposes set forth below.
The undersigned hereby certifies that they are property owners of the following described real
property in the City of La Quinta, County of Riverside, State of California:
Lots 14 and 19, La Quinta Golf Estates No. 1, as per map recorded in Book 37, Pages 96-98
of Maps, Records of Riverside County, California (APN: 646-140-009 and -014).
In consideration of the City of La Quinta issuing a building permit for certain improvements
which will be constructed on said property, the undersigned does hereby covenant and agree to and
with said City to restrict the use of said property as follows:
The guest house may not be rented nor sold independent of the main single family
residence (Minor Use Permit No. 97-008);
2. No kitchen or cooking facilities shall be constructed in the guest house per the
provisions of Sections 9.30.030 (RL Zone District) and 9.60.100 (Guest Houses) of
the La Quinta Municipal Code;
All on -site facilities are intended for the sole occupancy of the property owner(s),
nonpaying guests, or domestic employees.
This covenant and agreement shall run with the land and shall be binding upon future owners,
their successors, heirs, or assigns, and ourselves, and shall continue in effect while said accessory
building remains on the real property or unless otherwise released by the authority of the City of La

Quinta. All leases of said dwelling and/or property shall be subject to this restriction. This agreement
shall be entitled to the remedy of injunctive relief in addition of any remedy in law or equity.
This covenant and agreement and the provisions hereof are irrevocable and nonmodifiable
except by the written consent of all parties to the agreement, including the City of La Quinta, a
municipal corporation. The City shall have the right to enforce each and every provision hereof and
the parties agree that the agreement shall not be rescinded, revoked, modified, or otherwise amended
or changed, without -the expressed written consent of the City first being obtained.
If the owners, their heirs, assigns or successors in interest, shall fail to perform any obligation
hereunder, they hereby agree to pay all costs and expenses incurred by the City of La Quinta in
securing performance of such obligation, including attorney's fees.

Subject: Public Utility Easement Relocation (Knox)

I would like to know if public utility easements can be relocated without necessitating an
abandonment hearing before the City Council? I raise this question in hopes of helping Mr. Chuck
Knox build his future home at the La Quinta Golf Estates (PM 96-316, etc.). Information on this
matter is attached. The public utility companies have verbally,, or in writing, stated that they are
working with Mr. Knox to relocate their existing facilities to further development of his project. I
thought one solution would be to have City Council pass a Resolution permitting the public
easements to be relocated (i.e., Business Item) based on the preparation of the legal paperwork by
the applicant's engineer, etc. Please discuss this issue at your next staff meeting. Thanks

Approval of a Summary Street Vacation for Tentative
Tract 25154 (SV 96-033): Applicant: TD Desert
Development
RECOMMENDATION: y
Adopt City Council. Resolution approving the Summary Street Vacation as requested.
FISCAL IMPLICATIONS:
None.
BACKGROUND AND OVERVIEW:
TD Desert Development, the developers of Rancho La Quinta, acquired Tentative Tract
25154, which is located south and west of their development, east of Parc La Quinta, and
east of Sagebrush Avenue. It is a recorded tract map consisting of 98 residential lots. The
new owners wish to convert the public streets into private streets. Chapter 4, Section 8334
of the Streets and Highway Code provides for Summary Vacation under the circumstances'
presented by the request of TD Desert Development.
The attached resolution provides for the conversion of these streets, maintains the
easements for utilities and emergency services, and provides for the dedication to the
ultimate homeowners' association who. will be responsible for maintaining these streets.
FINDINGS AND ALTERNATIVES:
Options available to the City Council are:
1. Approve the Summary Street Vacation 'by adoption of City Council Resolution. '
2. Deny the request.
3. Provide staff with further direction. i
