SUBJECT: ME'40R ADJUSTMENTS 96 439,_96-440 AND 96-441
Dear Mr. Cunningham:
The Community Development Department has reviewed your request to reduce the front yard
setback to 18-feet for three new single family houses in the Rancho Ocotillo development (i.e., 79
170 Camino Rosada, 79-175 Camino Rosada, and 44-395 Camino Azul) pursuant to Section
9.210.040 (Minor Adjustments) of the Municipal Code. We find that we can approve a modified
request provided the following Conditions are met:
1. The garage door(s) shall be located 19-feet from the front property line. A sectional, roll -up
garage door shall be installed for each new house.
2. Obtain building permits from the Building & Safety Department for this project by February
14, 1997. Otherwise, this approval shall expire and be of no use unless extended by this
Department.
After review it was determined that:
No impact to the Cify's General Plan will occur with this adjustment request because the
Land Use Element designates the site for residential purposes. This minor adjustment is
consistent with the intent and purpose of the RL District because parking in front of the
garage on the driveway for two cars will be available.
2. The project is exempt from the provisions of the California Environmental Quality Act
(CEQA) under Section 15305(a) which allows minor setback variances for properties with
slopes less than 20 percent.
3. There are special circumstances applicable to the property, including such factors as size,
shape, topography, location or surroundings that justify approval of the adjustment. Those
circumstances are that the garage structures will provide a minimum of 19-feet clearance from
the property line to the front of the sectional garage door for off-street parking purposes. A
one -foot deviation in the RL District setback provision from 20-feet to 19-feet will not be

noticeable and provide a better streetscape design as required by Chapter 9.50 (Residential
Development Standards, Table 501) of the Zoning Ordinance which encourages varied front
yard setbacks for large developments of more than ten houses.
4. This minor adjustment will not be detrimental to the health, safety, and general welfare of this
area of the City because parking in front of the garage will be provided as required. This
clearance distance of 19' is consistent with the intent of Chapter 9.150 (Parking) of the
Zoning Code which requires 19' long parking stalls for large parking lots for residential land
uses (e.g., apartment c6mplexes).
This administrative decision may be appealed to the Planning Commission if you file a written appeal
within 15 calendar days and pay an appeal fee of $175.00 per application according to Section
9.200.120 of 'he Municipal Code.
