JUSTIFICATION: No request for a Setback Adjustment shall be granted
unless it is determined that it is consistent with the intend and purpose
of this Ordinance; that there are special circumstances applicable to the
property, including such factors as size, shape, topography, location or
surroundings that justify the approval of the .adjustment of the setback
requirement, and that the adjustment will not be detrimental to the
health, safety, and general welfare of the community or be detrimental to

Dear Mr.' Coronel:
The Community Development Department has reviewed your request to reduce the side yard setback
on Calle Monterey from 10-feet to 9-feet to construct a covered porch for a new single family house
at 53-265 Avenida Villa pursuant to Section 9.210.040 (Minor Adjustments) of the Municipal Code.
We find that we can approve your encroachment request, provided a building permit is obtained for
the project by July 2, 1997. Findings in support of your request are noted below:
1. No impact to the City's General Plan will occur with this adjustment request because the
Land Use Element designates the site for residential purposes.
2. The project is exempt from the provisions of the California Environmental Quality Act
(CEQA) under Section 15305(a) wrich allows minor setback variances for properties with
slopes less than 20 percent.
3. There are special circumstances applicable to the property, including such factors as size,
shape, topography, location or surroundings that justify approval of the adjustment. The
circumstance is that a one -foot deviation in the RC District setback provision for the support
posts from 10-feet to 9-feet will provide articulation along the side of the house and added
design interest to the surrounding neighborhood.
4. TIds minor adjustment will not be detrimental to the health, safety, and general welfare of this
area of the City because the support posts for the covered patio are 9' from the property line.
This administrative decision may be appealed to the Planning Commission if you file a written appeal
within 15 calendar days and pay an appeal fee of $175.00 per application according to Section
9.200.120 of the Municipal Code.
