SUBJECT: MINOR ADJUSTMENT 97-444 (STARLIGHT DUNES)
Dear Mr. Taylor:
The Community Development Department is unable to continue processing Minor Adjustment 97-
444 because the various site plan drawings do not include adequate information such as lot and house
sizes, roof eave projections, house plan types, two story elements, etc. Please also review whether
or not setback adjustments are necessary for cul=de-sac. lots which are irregular in shape based on
standards outlined under Section 9.50.070 (Irregular Lots) ofthe Zoning Code. For example, Lot
#8 would not require an adjustment to the side and rear yard setbacks if your plans are drawing
correctly for a one story house. See the attached information.
Under Section 9.50.060 (Architectural Projections) of the Zoning Code, roof overhangs may
encroach a maximum of two feet into any required setback provided such projections are not closer
than 3.5-feet from any property line unless an adjustment is permitted by this Department.
Should you wish to withdraw any of the lot adjustment requests, please write a letter requesting a
refund for the fees that were paid (e.g., $200/application).

The Community Development Department cannot approve the 15 single family houses in Tract 23773
for the following reasons:
1. The final construction drawings have not been approved.
2. Lot Line Adjustment 97-249 has not been recorded.
3. Minor Adjustment 97-444 has not been approved.
4. A Precise Plot Plan has not been approved.
Once these matters have been resolved, the Community Development Department will recommend
issuance of a building permits for these houses.
Please forward a copy of the construction drawings to our Department for review and approval. If
you have any questions, please contact me.

3. If a site development permit is approved per Section 9.210.010, balconies, exterior stairways,
and elevated decks may encroach a maximum of four feet into required front and rear setbacks
provided such projections are no closer than 3'% feet from any property line. Such projections
shall not encroach into required side setbacks.
9.50.070 Irregular Lots.
A. Purpose. Setback distances
established for residential districts are
based on rectangular lots.
Nonrectangular lots, lots with three sides
or more than four sides, and other
nonstandard lots require special
measurement techniques in order to
achieve the purpose of setback
requirements, i.e. the appropriate
separation'of structures from streets and
other properties. The purpose of this
Subsection is to provide standards for
the establishment and measurement of
setbacks on irregular lots. (See Chapter
9.280 for definition of lot lines.)

C. Rear Setbacks. In the case of an irregularly shaped
lot, a ten foot line which is within the lot and parallel to

be measured at the closest point between the building and the angled lot line.

3. No Structures in Panhandle: No structures shall be permitted in the panhandle portion of the
lot nor shall that portion be credited to minimum lot area requirements.
4. Minimum Lot Frontage. Minimum lot frontage for flag lots shall be 10 feet.
G. Determination by Director. Where a building site is situated such that any of the front, side or
rear property lines are not readily determinable, required setbacks shall be as determined by the Director
in compliance with the following criterion: required setbacks shall not permit the placement of buildings
on the site in a manner that will constitute a grant of special privileges inconsistent with the limitations
placed on other properties in the vicinity and incompatible with surrounding uses.
9.50.080 Setbacks from Surface Easements.
Where a surface easement for street, vehicular access, bikeway, or recreation trail purposes has
been granted across any portion of a lot, the building setback shall be measured from the property line
or to the edge of easement, whichever is closer to the building.
