SUBJECT: MINOR ADJUSTMENT'97-447 FOR SITE DEVELOPMENT PERMIT 97-611
Dear Mr. Knight:
The Community Development Department has reviewed your request to reduce the required rear yard
building setback for Lots 7, 8, 71. 73,t'75, 84, 86, 88, 97, 99, 101, 102, and 106. in Tract 27899
(Marbella) pursuant to Section 9.210.040 (Minor Adjustments) of the Municipal Code. We find that
we can approve your encroachment requests provided building permits are obtained for the project
by February 10, 1998. Findings in support of your request are noted below:
No impact to the City's General Plan will occur with this adjustment request because the
Land Use Clement designates the site for fesidential purposes.
2. The project is exempt from the provisions of the California Environmental Quality Act
(CEQA) under Section 15305(a) which allows minor setback variances for properties with
slopes less than 20 percent.
3. There are special circumstances applicable to the property, including such factors as size,
shape, topography, location or surroundings that justify approval of the adjustment. The
circumstance is that minor deviations in the RL District setback provisions will provide
articulation along the various street frontages and added design interest to the surrounding
neighborhood.
4. This minor adjustment XVill not be detrimental to the health, safety, and general welfare of this
area of the City because a Code deviation of only 10% (maximum) is being allowed.
This administrative decision may be appealed to the Planning Commission if you file a written appeal
within 15 calendar day_ s and pay an appeal fee of $175:00 according to Section 9.200.120 of the
�,,9unicipal Code.
