SUBJECT: Minor Adjustment 98-457 for 51275 Calle Quito
Dear Mr. Xalogeris,

The Community Development Department has -reviewed your request for a minor
adjustment allowing a one foot encroachment into the maximum 17 foot height
restriction for an addition to a residence at 51275 Calle Quito and determined that
it cannot be approved because findings cannot be made in accordance with Section
9.210.040, as follows:
The uses surrounding this use are single family residential uses or vacant lots
proposed for single family residential. The encroachment above the 17 foot
height limit would not be compatible with the surrounding residences and
neighborhood because it would exceed the height of most of the residences.
Additionally, the plans shown a four foot side yard setback on the north side of the
residence. The Zoning Code requires a five foot setback along this side. This will
need to be corrected.
This decision of the Community Development Director may be appealed to the
Planning Commission within 15. days of the decision. Please contact us for
information on appeal procedures.
