Subject: Minor Adjustment 99-476 and Minor Adjustment 99-477
Dear Mr. Westom:
(760) 777-7000
(TDD) (760) 777-1,227
The Community Development Department has reviewed your request to allow a two
foot adjustment in the rear setback from a twenty foot to an eighteen foot setback
for lot No. 9 and Lot No. 16 in Tract 23955-5; per Section 9.210.040 (Minor
Adjustments) of the Zoning Ordinance. We find that we can approve the request
provided a building permit is obtained from the Building & Safety Department.
Otherwise, this approval shall expire and be of no use unless extended by this
Department.
After review it was determined that:
1 . No impact to the City's General Plan will occur with this adjustment, request
because the Land Use Element designates the site for residential purposes.
This minor adjustment is consistent with the intent and purpose of the Zoning
Code.
2. The project is exempt from the provisions of the California Environmental
Quality Act (CEQA) under Section 15303(e) which allows. the conversion of
small accessory structures for parking purposes.
3. There are special circumstances applicable to the property, including factors
such as size, shape, location or surroundings that justify approval of the
adjustment.
MA 99-476 & MA 99-477
g
4. This minor adjustment will not be detrimental to the health, safety, and general
welfare of this area of the City because the irregular shaped lots are in an
approved Tentative Tract 23995 previously determined to be not detrimental
to the health, safety, and general welfare of this area of the City.
Please feel free to contact me at 760-777-7065, should you. have any questions.
Very truly yours,
JERRY HERMAN
