The Community Development Department has reviewed your request to allow a 1-foot
adjustment for a portion of the rear setback from 10-foot to a 9-foot, for Lot No. 89 in
Desert Club Manor Tract Unit #1, in compliance with the provision of Section 9.210.040
(Minor Adjustments) of the Zoning Ordinance. We find that the request can be approved
-in conjunction with the building permit issued for this house.
The following findings can be made to justify approval of this request:
1.. Consistency with General Plan: No impact to the City's General Plan will occur with
this minor adjustment request because the Land Use Element. designates the site
for residential purposes.
2. Consistency with Zoning Code: This minor adjustment -is consistent with the intent
and purpose of the Zoning Code, as the proposed project is a'single family
residence located within the Medium Density Residential Zoning District.
3. Compliance with CEQA: The minor adjustment is exempt from the provisions of the
California Environmental Quality Act (CEQA) under Section 15305(a) which allows
setback adjustments not resulting in the creation of any new parcel.
4. Surrounding Uses: Approval of the minor adjustment will not create conditions -
materially detrimental to the public health, safety and general welfare or injurious
to or incompatible with other properties or land uses in the vicinity, as the request
is for only one setback adjustment not exceeding ten percent of the required rear
setback.
