This letter is to report approval of your minor adjustment application to reduce the
sideyard setback from 5 feet to 4.5 feet for the construction of a single family home
on Lot 13 within Tract 29349-1, pursuant to Chapter 9.210 of the City of La Quinta
Municipal Code, subject to conditions and according to the attached exhibits.
CONDITION: Obtain a building permit from the Building & Safety Department
After review it was determined that:
1. This adjustment is consistent with the intent and purpose of the Zoning
Ordinance in that the 6 inch error in surveying occurs where the buildig is not
adjacent to the neighboring building.
2. There are special circumstances applicable to the property, including such
factors as size, shape, topography, location or surroundings that justify approval
of the adjustment. In this case, the 6 inch error only occurs on a portion of the
sideyard with the remainder at 6.5 feet where five feet is required.
3. This adjustment will not be detrimental to the health, safety, and general
welfare of this private gated community because the six inch reduction does not
occur immediately adjacent to the building to the west. .
