Permit:
1. Consistency with General Plan. The project is consistent with the General Plan.
2. Consistency with Zoning Code. The project is consistent with the provisions of the Zoning Code.

The Community Development Department has approved your request for a minor
adjustment of the required 20 foot front yard setback at 77380 Avenida Montezuma,
pursuant to Section 9.210.040 of the La Quinta Zoning Code. The approval permits the
front yard setback to be reduced from 20 feet to 18 feet to permit a patio post for a
new residence per the attached plan. You may proceed to obtain a building permit for
the residence.
The findings necessary to approve this Minor Adjustment are as follows:
1. This adjustment is consistent with the La Quinta General Plan, in that the
proposed encroachment into the setback does not affect the physical land use
characteristics of the property designated Low Density Residential, and.is not in
conflict with any related General Plan policy.
2. This adjustment is consistent with the intent and purposes of the Zoning Code
in allowing development of single family residences. This adjustment will allow
an adequate front yard and will only reduce the setback at the patio post which
is almost imperceptible. `
3. This adjustment is in compliance with the California Environmental Quality Act
(CEQA), in that it is exempt from such review pursuant to Section 153301 of the
CEQA guidelines.
4. This adjustment will not be detrimental to the health, safety, and general welfare
of the community because the encroachment is minimal and the majority of the
residence complies with the required setback requirements.
