A nonrefundable fee of $200 is required when the Application is submitted. The check must be made payable to the "City
of La Quinta". A Minor Adjustment Permit (Section 9.210.040/Zoning Ordinance) may be approved only for deviations
of up to ten percent of a numerical development standard (for example, a reduction of one foot from a ten -foot setback
requirement) or for deviations specifically identified in the La Quinta Zoning Ordinance. Other deviations shall require
consideration of a variance (pursuant to Section 9.210.030NariancelZoning Ordinance). If the Applicant is not the owner
of the property, a letter must be submitted by the owner authorizing the Applicant to execute this document in his behalf.

Please let this letter is notification that .the Community' Development
Department' has reviewed your Minor Adjustment application, pursuant to
Section 9.210.040 of the City of La Quinta Zoning Code. Your request for
encroachments for Lots 4,8,19, and 21(as per the attached exhibit) in order
to make legal the setback requirements has been- approved based on the
following Findings:
FINDINGS:
1 . The Minor Adjustments are consistent with :the La Quinta General
Plan, in that the request does not alter the approved land use for the
property, or affect land uses on surrounding properties. The
Adjustment allows the property owner to save build the approved
units.
2. The Minor Adjustment is consistent with the intent of the La Quinta
Zoning Code, in. that the. request is for a deviation of no more., than
10% of a development standard. Ten percent is the maximum
deviation of any code pursuant to Section 9.210.040 of the Zoning
Code.
3. Approval and execution of'the Minor Adjustment is not detrimental to
the public health, safety and general welfare, nor injurious or
incompatible with other properties and land uses in the vicinity. The

adjustment has no impact on health and' safety issues, and will not
affect physical land use characteristics in the vicinity.
4. Processing. and approving the Minor Adjustment is Categorically
Exempt. with regard to the requirements of the. California .
Environmental Quality Act (CEQA), pursuant to CEQA Guidelines J
Section 15305(a). No further .environmental analysis is required.
Please be advised that this approval relates only to the allowance in a
reduction setback for Lots 4,8,19, and 21 (see attached exhibit). as stated
above. . This' approval does not imply any entitlement or .' approval of a
building permit for any structure(s) shown onthe plans on. file. All other
setback provisions and development standards of the La Quinta Zoning Code
are applicable and shall be adhered to in preparing plans for the Building
Department.

Dear Sirs,
This letter will serve as formal monument to the factual representation as to the
design and development for the homes to be built in Desert Shell Estates, tract
32201 La Quinta, Calif. myself, Gabriel Lujan, who is the principal designer
and City of La Quinta Planner, Martin Magana started on the concepts, and
agreed designs back in February, March and April of 2004.
As very clearly observed on the tract map, we had 3 cul-de-sac type easement
scenarios, and the front entrance Lot # 1 and #24's side to front set backs
scenarios. More specifically because the way the radius requirements on the
roads encroached on my building envelopes, we agreed that the small amount of
"garage corner" encroaching in the front 20 foot easements was VERY
ACCEPTABLE! As you can clearly see, these 3 model homes fit on all the lots
except for a very small amount of the garage corner on the radius lots of this
development.
I know Martin also was aware of my knowledge to 10% of encroaching on an
easement is staff approvable, and Martin adamantly agreed this was an easy
case for that "staff approval." In a nut shell, this has become a problem because
of Martin Magana's putrid professional handling, or better yet NON handling of
this prestigious community. In fact Choice Enterprise has documented almost 4
weeks of NON returned calls from Martin Magana with the final outcome
being, he was leaving the city. This was back in December of 2004 when I was
just finishing dotting my "I's" and crossing my "T's" on this project.
Myself and Company since has made a lot of compromises to accommodate a
very apparent disorganized planning department. I do see great improvement in
the past months and at this point very adamantly request these small
encroachments be approved so myself, family and building company may
continue to make our living, building homes! I look forward to your quick and
expeditious approval to this matter.
