Dear Mr. Ornelas:
The Community Development Department has reviewed your request for a Minor
Adjustment to the maximum residential building height of 28' in The Madison Club on
Lot 21 A of Tract 33076-1 (Stallone residence) on Ross Avenue. We have determined
this request complies with the following required Findings for approving a Minor
Adjustment:
1. Consistency with General Plan - The request is consistent with the General Plan
in that the use is a residence which is permitted by the Low Density Residential
designation of the property.
2. Consistency with Zoning Code - The request is consistent with'the provisions of
the zoning code in that it permits a 10% height additional allowance with
additional eave height as requested.
3. Compliance with CEQA - Processing and approval of the permit application is in
compliance with the requirements of the California Environmental Quality Actin
that it is exempt form CEQA .requirements.

4. Surrounding Uses - Approval . of the application will not create conditions
.materially detrimental , to the public health, safety and .general welfare .or
injurious to or incompatible with other properties or land, uses in the vicinity.
Furthermore the Madison Club Design Review Committee, has approved the
t request subject to City.approval, determining,the request is compatible with the
surrounding properties and Madison Club community. '
The approval is for that portion of the building and roof that exceeds 28', allowing a
maximum 32'-4" • as shown on the plans on, file in the Community Development
Department and; the attached -partial roof plan. This -is based on a 10% height
allowance and a roof projection allowance as permitted by Section 9.50.060 of the
Municipal Code. - Our approval is subject to processing the building plans through the
Building and Safety Department for compliance with :other applicable codes and
requirements.
This decision may be appealed to the Planning Commission -provided the necessary
paperwork and filing fee of $115.00 are filed with this office "Within 15 days. If you
