Dear Mr. Ornelas:
The Community Development Department has reviewed your request for a Minor
Adjustment to the maximum residential building height of 28' in The Madison Club on
Lot 22A of Tract 33076-1 (Stallone residence) on Ross Avenue.'
After a thorough review of the request, we have determined that we can only approve
a portion of the request. For the area above the great room we can allow the 10%
height adjustment, which permits a height of 30'-9.6", but have determined the
additional roof projection allowance to permit the extra height above 30'-9.6" cannot
be approved based on the requirements for a roof projection.
For the portion of the request we can approve, we have determined the following
required Findings apply:
1. Consistency with General Plan - The request is consistent with the General Plan
in that the use is a residence which is permitted by the Low Density Residential
designation of the property.
2. Consistency with Zoning Code - The request is consistent with the provisions of
the zoning code in that it permits a. 10% height additional allowance with
additional eave height as requested.
3. Compliance with CEQA - Processing and approval of the permit application is in
compliance with the requirements of the California Environmental Quality Act in
that it is exempt form CEQA requirements.
